HomeMy WebLinkAbout2011.03.07 CC MinutesMINUTES FOR THE HUGO CITY COUNCIL MEETING ON MARCH 7, 2011 Mayor Fran Miron called the meeting to order at 7:01 p.m. PRESENT: Haas, Klein, Petryk, Weidt, Miron ALSO PRESENT: City Administrator Mike Ericson, Community Development Director Bryan Bear, City Engineer Jay Kennedy, City Attorney Dave Snyder, Community Development Assistant Dennis Fields, Finance Director Ron Otkin, Accounting Clerk Anna Wobse, and City Clerk Michele Lindau Moment of Silence for Retired Washington County Commissioner Dick Stafford and Brooklyn Park Mayor Steve Lampi Mayor Fran Miron requested a moment of silence in remembrance of longtime Washington County Commissioner Dick Stafford and Brooklyn Park Mayor Steve Lampi. Dick passed away on Thursday, February 24, 2011. He served Washington County for many years, both as County Commissioner and as the County Auditor. Brooklyn Park Mayor Steve Lampi passed away from cancer early last week. Mayor Fran Miron said his sympathy goes out to the families of these two dedicated public servants. The Mayor also said his thoughts go out to the family of Washington County Judge Albertson as well. Judge Albertson passed away on January 31, 2011 at the age of 83. Approval of the Minutes for the City Council Meeting on February 22, 2011 Weidt made motion, Klein seconded, to approve the minutes for the City Council meeting held on February 22, 2011 as presented. Approval of the Minutes for the South Ethan Avenue Neighborhood meeting on February 24, 2011 Klein made motion, Petryk seconded, to approve the minutes for the South Ethan Avenue Neighborhood meeting held on February 24, 2011 as presented. All Ayes. Motion carried. Approval of the Agenda Miron made motion, Haas seconded, to approve the Agenda as amended: Add to Administrative Presentations: Cancel Council Meeting for March 21, 2011 Update on the Hugo American Legion All Ayes. Hugo City Council Meeting Minutes for March 7, 2011 Page 2 of 7 Presentation of GFOA Award for Excellence in Financial Reporting — Accounting Clerk Anna Wobse Finance Director Ron Otkin received notification from the Government Finance Officers Association of the United States and Canada that the Hugo Finance Department has received the 17th Certificate of Achievement for excellence in financial reporting. This certificate is the highest form of recognition in governmental accounting and financial reporting, and its attainment represents a significant accomplishment by a government and its management. Accounting Clerk Anna Wobse credited the award to the teamwork of the department and leadership of Finance Director Ron Otkin. Mayor Fran Miron presented Anna and Ron with the official plaque. 2010 Annual Building and Economic Development Report Each year the Community Development Department prepares its Annual Building Department Report which highlights building activity that has taken place in the City of Hugo over the past year. At its February 24, 2011 meeting, Community Development Assistant Dennis Fields presented the Annual Report to the Planning Commission, and the Planning Commission unanimously recommended approval of the 2010 Building Report. At its February 14, 2011 meeting, Planner Rachel Juba presented the annual Economic Development Authority Report to the EDA. The EDA recommended approval of the 2010 Annual Report. Community Development Director Bryan Bear presented a compilation of these two reports to the Council. Weidt made motion, Haas seconded, to accept the 2010 Annual Building/Economic Development Report and the Parks Report. All Ayes. Motion carried. All Ayes. Motion carried Hugo City Council Meeting Minutes for March 7, 2011 Page 3 of 7 Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Review of Special Use Permit for Bald Eagle Sportsman Association The Bald Eagle Sportsman Association (BESA) has a Special Use Permit (SUP) to operate a gun club on property located at 6557 125th Street. Condition #19 of the existing permit states that it shall be reviewed prior to December 1St of the even -numbered years or if the SUP is amended or violated. Staff visited the gun club on January 13, 2011, and is not aware of any violations of the existing special use permit. The new gun range office has been constructed, which was part of its SUP amendment and review in 2008. There have been a few trees and a fence installed by the 50 and 25 yard shooting range to help with sound abatement. Staff finds BESA to be in compliance with the special use permit. At its February 24, 2011 meeting, the Planning Commission considered review of the SUP and unanimously recommended approval to the Council. Adoption of the Consent Agenda approved the SUP review as presented. Approve Pay Request to Olson's Sewer for JD2 Ditch Maintenance The City of Hugo received a request from Olson's Sewer for approval of its first pay request for the 2010-2011 maintenance on Judicial Ditch #2. This project was approved by the Council at its meeting on January 18, 2011. Adoption of the Consent Agenda approved the partial payment to Olson's Sewer Service in the amount of $21,692.45 Approve Leave of Absence for Hugo Firefighter Jennifer Mader Hugo Firefighter Jennifer Mader has requested a leave of absence from the Hugo Fire Department. Adoption of the Consent Agenda approved the leave of absence for Hugo Firefighter Jennifer Mader for a six-month period until September 1, 2011. Recognition of Completion of Firefighter II Training for Firefighters Bryan Hamilton, Jim Roettger, and Nickolas Young Bryan Hamilton, Jim Roettger, and Nickolas Young were hired by the City of Hugo as new probationary firefighters. Bryan, Jim, and Nickolas have just recently completed all class work necessary for the Firefighter II Training certification. Adoption of the Consent Agenda recognized Firefighters Bryan Hamilton, Jim Roettger, and Nickolas Young for completion of their Firefighter II Training as part of their probationary firefighter education for future appointment as a regular firefighter. Approve the Use of Public Streets for Two Run Events Hosted by Tri -Fitness and Final Stretch Inc. For several years, White Bear Lake running officials have held running events around the Bald Eagle Lake area. Races are held at the Ramsey County Beach on Bald Eagle Lake and follow a secured route which includes a short portion in the City of Hugo. Final Stretch Inc. and Tri - Fitness contacted Hugo City staff about the run events. Final Stretch Inc. will hold their event on May 14, 2011, and Tri -Fitness on April 9, 2011. The events do not require a Special Event Hugo City Council Meeting Minutes for March 7, 2011 Page 4 of 7 Permit because the starting line, finish line, parking, registration, and facilities will be located outside of City limits. Both organizations have been in contact with Washington, Anoka, and Ramsey County law enforcement to notify them of the event. Adoption of the Consent Agenda approved the use of the City's public roadways for these events. Approve 2011 City Focus Goals and Ongoing Priorities Council Member Haas removed this item from the Consent Agenda. At its February 15, 2011 meeting, the Hugo City Council finalized the City's Focus Goals as prepared by City Staff. City staff has revised the City's 2011 Focus Goals to include the appropriate completion dates and recommended formal approval by the Hugo City Council. Council Member Haas noted that one of the ongoing priorities was to build and maintain regional partnership. He stated the City of Stillwater was looking into a grant from the State Fire Marshall for shared services, which was being evaluated by an outside contractor, and City staff should look into it. Haas also spoke about a section in the employee handbook that classifies employees as full time, part time, paid on call, etc., and he said the City Council should be recognized in the handbook as well. Haas made motion, Klein seconded, to approve the 2011 City Focus Goals and Ongoing Priorities as presented. All Ayes. Motion carried. Storm Water Pollution Prevention Program (SWPPP) Public Hearing Each year, the City of Hugo is required to hold a public hearing in order to take public comment on the City's Stormwater Pollution Prevention Plan (SWPPP) as part of the City's MS4 NPDES permit with the Minnesota Pollution Control Agency. The City scheduled a public hearing for this meeting at Hugo City Hall, to present and discuss the Storm Water Pollution Prevention Plan (SWPPP). Senior Engineer Technician Steve Duff presented the SWPPP to the Council outlining City activities as a result of implementing the SWPPP. Mayor Miron opened the public hearing to take any and all public comment on the City's SWPPP. Rick Gwynn, 12277 Ethan Avenue North, said he is on the Advisory Committee for the Rice Creek Watershed District. He said there are a lot of studies currently on ponds and rain gardens that were done with grant money. There were no other comments. Haas made motion, Petryk seconded, to accept the SWPPP report as presented. All Ayes. Motion carried. Hugo City Council Meeting Minutes for March 7, 2011 Page 5 of 7 Approval of Animal Ordinance Revisions At its regularly scheduled meeting on December 6, 2010, the City Council was given a presentation that outlined proposed revisions to the Animal Ordinance. The City Council held a public hearing at this meeting in which they took public comment from various residents and animal professionals. City Council then directed staff to meet with the residents and address their concerns with the proposed changes to the ordinance. Staff met with residents and incorporated changes to the proposed ordinance based on the discussion and Council direction. Community Development Assistant Dennis Fields presented the proposed changes to the ordinance which included sections on impounding of dogs, animal bites and rabies, dangerous and potentially dangerous dogs, penalties for violations, and appointment of a hearing officer. Kerry Reimer, 14165 Irish Avenue North, said he liked the ordinance except for the section allowing for the disposal of an impounded animal within only ten days after it is impounded. Camille McArkle, veterinarian and resident of Hugo, pointed out that a dog is easier to watch in a park if it is leashed because the dog would remain closer to the owner. Deb Barnes, 6491 132nd Street North, expressed a strong support for a dog park. Haas made motion, Miron seconded, to approve ORDINANCE 2011-455 AMENDING CHAPTER 10, ANIMALS, with the deletion of Section10.34 (2) stating dogs shall not be allowed to run at large, because it is already stated in Section 10.34 (1). Haas made motion, Weidt seconded, to amend the motion to include the deletion of section 10.28 which required that dogs be licensed by the City of Hugo. Vote on amendment: All Ayes. Motion carried. Approve Plans and Specifications for South Ethan Avenue Neighborhood Street Reconstruction Proiect At its November 1, 2010 meeting, the Hugo City Council ordered the South Ethan Avenue Street and Utility project, and ordered the preparation of the project plans and specifications. The project plans and specifications have been completed and shared with residents at an open house held on Thursday, February 24, 2011. City Engineer Jay Kennedy reviewed some of the key plan components with the City Council which include a three-way stop at the Everton Avenue/122nd intersection, traffic calming measures to include driver feedback signs, and improvements to the 120th Street/Everton Avenue curve. Construction would begin in May, 2011 with an assessment hearing in September. Work would be substantially completed by September, 2011.. City Engineer Jay Kennedy stated that the City of Hugo would be applying for the RCWD grant, which was due by March 16, 2011. Hugo City Council Meeting Minutes for March 7, 2011 Page 6 of 7 Petryk made motion, Weidt seconded, to approve RESOLUTION 2011-2 APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR THE SOUTH ETHAN AVENUE AREA ROADWAY, DRAINAGE, AND UTILITY IMPROVEMENTS. Ayes: Weidt, Haas, Petryk, Klein, Miron Nays: None Motion carried. Discussion on Emergency Notification Policy for Elected Officials After a request from Council Member Haas, staff prepared a draft City Emergency Notification Policy for Mayor and Council Members regarding disasters and other emergency related items. Staff provided this notification policy to the Council for review. Debra Barnes, writer for The Citizen, requested to be notified as well. Haas made motion, Petryk seconded, to adopt the draft notification policy for elected officials. All Ayes. Motion carried. Approve Resolution Approving County Proiect in the City of Hugo for Pavement Preservation on CSAH 9 Washington County Public Works is planning to complete a pavement maintenance project on County State -Aid Highway 9, a small portion of which lies within the City of Hugo. City Engineer Jay Kennedy reviewed the proposed plans for the project which will be cold -in-place recycling with no changes to the alignment or width of the road within Hugo. This project will be done at no cost to the City and is expected to be completed during spring/summer of this year. Jake Gave, Washington County project manager, explained this was simply a pavement maintenance project. Haas made motion, Weidt seconded, to approve RESOLUTION 2011-3 APPROVING WASHINGTON COUNTY CSAH 9 PROJECT WITHIN MUNICIPAL CORPORATE LIMITS. Ayes: Haas, Petryk, Klein, Weidt, Miron Nays: None Motion carried. Update on the Yellow Ribbon Network Council Member Chuck Haas provided an update to the Council on the activities of the Yellow Ribbon Network (YRN). YRN will be partnering with the MN Patriot Guard to send cookies and coffee to the soldiers overseas, and he encouraged donations of cookies or postage. Burger night at the Hugo American Legion has been a success. Burger Night is the 4th Wednesday of each month. Haas also welcomed home the son of Parks Commissioner Roger Clarke. Hugo City Council Meeting Minutes for March 7, 2011 Page 7 of 7 Update on the Hugo American Legion The City of Hugo has been working with State Senator Ray Vandeveer and State Representative Bob Dettmer on the tax classification of the Hugo American Legion as it applies to monies spent from charitable gambling proceeds. Council Member Haas was happy to report that the County Assessor has notified the American Legion that the interpretation of the State Statutes considers room rental fees as a local contribution, therefore reducing the amount of taxes the Legion will have to pay. Announcement of Sandy Rummel as the new Met Council Representative for Hugo Governor Mark Dayton filed "Notice of Intent to Appoint" forms with the Secretary of State for the sixteen Metropolitan Council Districts, including Sandra Rummel as the representative of the Hugo Area. Former Senator Rummel has a strong interest in water quality and usage policies and has worked on the Senate Environment Committee and Clean Water Legacy Subcommittee. After the five-day review period, Sandy Rummel was appointed to the Metropolitan Council on Monday, March 7, 2011. Haas made motion, Petryk seconded, to extend to Sandy Rummel an invite to a Council meeting and the I-35 W/E Coalition meetings. All Ayes. Motion carried. Cancellation of Meeting Staff informed Council there were no pertinent agenda items for the second meeting in March, and recommended cancelling the meeting. Haas made motion, Weidt seconded, to cancel the second Council meeting in March scheduled for March 21, 2011. All Ayes. Motion carried.
