All Ayes. Motion carried. Approval of the Minutes for the April 18, 2011 City Council Executive Session Weidt made motion, Klein seconded, to approve the minutes for the April 18, 2011 City Council executive session as presented. Approval of the Minutes for the April 21, 2011 Board of Equalization Meeting Klein made motion, Haas seconded, to approve the minutes for the April 21, 2011 Board of Equalization meeting as presented. Hugo City Council Meeting Minutes for May 2, 2011 Page 2 of 8 Approve Proclamation Proclaiming May 1St as Sergeant Joe Bergeron Day in Hugo At its April 18, 2011 meeting, the Hugo City Council discussed the need to remember the one- year anniversary of the loss of life of Hugo resident and Maplewood Police Department Sergeant Joe Bergeron who was killed in the line of duty on May 1, 2010. Council directed staff to prepare a proclamation proclaiming the first day in May as Sergeant Joe Bergeron Day in the City of Hugo. City staff has prepared the proclamation noting as well May 15-21, 2011 as National Police Week. Three deputies from the Washington County Sheriff's Department were in attendance including Deputy Pete Godfrey who offered to bring the signed proclamation to Joe's wife Gail. Weidt made motion, Haas seconded, to approve the Proclamation proclaiming May 1St as Joe Bergeron Day in the City of Hugo. All Ayes. Motion carried. Acting Mayor Becky Petryk presented the Proclamation to Deputy Godfrey on behalf of the City of Hugo, and Deputy Godfrey accepted the Proclamation on behalf of Joe's widowed wife Gail. Approve Gluten Free Workshop Sponsored by Festival Foods and HealthEast on Monday, May 16, 2011 City staff was contacted by representatives from Festival Foods and the HealthEast Hugo Clinic regarding the interest in holding the City's first ever Gluten Free Workshop. Representatives from both businesses would like to use the City of Hugo's Oneka Room to hold the event, which is scheduled for Monday, May 16, 2011 at 6:30 p.m. Mark Hartmann from Festival Foods was present to explain the event to the Council and public, which will include a 5K/1 OK Walk/Run on Saturday, May 21, 2011, gluten free sampling events, and representatives from HealthEast to provide free health screening and nutritional information. Weidt made motion, Haas seconded, to approve the Gluten Free Workshop at Festival Foods and HealthEast on Monday, May 16, 2011 at Hugo City Hall from 6:30 to 8 p.m., and Saturday, May 21, 2011 from noon to 5 p.m. at Festival Foods. All Ayes. Motion carried. Health Up and GO Walking Club City Administrator Mike Ericson informed Council of the success of the Health Up and Go Wellness Challenge kickoff event that took place at Hugo City Hall on Saturday, April 30, 2011. The event included free health screening, kids programs, and connections with local gyms and fitness options. As part of this a summer -long 148 day wellness challenge, Hugo Chiropractor Bill Barrett began the Hugo Walking Club, which started tonight at Hugo City Hall at 6:30 p.m. The public is encouraged to contact City Hall for information on Health Up and GO Wellness Challenge Events. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve of 2 A.M. Liquor License for the Blue Heron Blue Heron Grill, Inc., 14725 Victor Hugo Boulevard North, has applied to the City for renewal of its 2:00 a.m. closing time license. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the application for a 2:00 a.m. closing time for Blue Heron Grill. Approve Pay Request No. 10 from Arnt Construction for 147th Street/TH61 Intersection Improvement Project The City of Hugo has received Pay Request No. 10 from Amt Construction for work completed to date on the TH61/147th Street Intersection Improvement Project. City Engineer Jay Kennedy and Senior Engineering Technician Steve Duff have reviewed the pay request, which is the final pay request for the project, and found it to be satisfactory for work completed on this major project in 2010. Adoption of the Consent Agenda approved Pay Request No. 10 to Arnt Construction in the amount of $259,442.02 for work completed to date on the TH61/147th Street Intersection Improvement Project. Hugo City Council Meeting Minutes for May 2, 2011 Page 4 of 8 Approve Revisions to City Buildings Rental Policy The Hanifl Fields Athletic Park gathering room and pavilion will be available to the public for rent or use. Currently, the public may reserve the Oneka Room at City Hall and the Rice Lake Centre at the Public Works building. The General Policy Guidelines Regulating the Use of the City of Hugo Public Buildings for Meeting and Other Purposes were set by the City Council on March 4, 2002. In anticipation of additional facility use requests, staff simplified the current agreements, policies, and applications for potential renters. Minor text changes were made only. City Attorney Dave Snyder reviewed the documents and agrees with the revisions. The Policy continues to be that the public facilities are available at no charge for non -profits, $100 for residents and $200 for non-residents. The users are required to be responsible of the facility, its clean up and any activities in the facility. To address ongoing resident requests, staff is recommending that a permit now be granted allowing residents to have priority use of the picnic shelters in neighborhood parks. The permit would cost $5 and is enforced only by the permit holder. The shelter and building at Lions Park would continue to be reserved through the Lions Club. Adoption of the Consent Agenda approved the Facility Use Application, the Policy Regulating the Use of the City of Hugo Public Facilities and the Park Shelter Permit. Approve Annual Performance Review for Parks Planner Shavla Severson On May 11, 2009, the City Council approved the hiring of Shayla Syverson as the Economic Development/Parks Intern. At its April 19, 2010 meeting, Council approved the creation of a Parks Planner position, and on May 3, 2010, Council approved the hiring of Intern Shayla Syverson as the new Parks Planner. Shayla works with the Parks Commission and the Public Works Department on the development of and uses within the City parks, as well as other recreational activities and programs. Adoption of the Consent Agenda approved the annual performance review for Parks Planner Shayla Syverson. Approve Appointment of Lorraine Gadbois as Associate Member on the Historical Commission At its April 4, 2011 meeting, the Hugo City Council appointed Associate Member Kathy Brevig as the newest regular commission member on the Hugo Historical Commission, where she replaced charter member Pam Videen who moved out of Hugo. The City of Hugo subsequently received an application from long time resident Lorraine Gadbois to be an Associate Member on the Historical Commission. Adoption of the Consent Agenda approved the appointment of Lorraine Gadbois as an associate member on the Hugo Historical Commission. Approve Release of Letter of Credit for Victor Gardens Mainstreet Holdings, LLC for Victor Gardens East City staff has received a request from Mainstreet Holdings to release the letter of credit being held by the City in the amount of $46,783 for Victor Gardens East. Senior Engineering Technician Steve Duff has reviewed the work completed on site and has determined that the project is complete to City specifications and the one-year warranty period has expired. Street trees are required to be installed with the construction each home within the development. Adoption of the Consent Agenda approved the release of the letter of credit for Victor Gardens East. Hugo City Council Meeting Minutes for May 2, 2011 Page 5 of 8 Approve Hire of Seasonal Public Works Employees At its February 22, 2011 meeting, the Hugo City Council authorized Public Works Director Scott Anderson to advertise for the Summer Seasonal Public Works employees, which provide the City of Hugo a cost effective way to maintain the City parks, open space, and facilities. Adoption of the Consent Agenda approved the hiring/rehiring of Erik Lundell, Nicole Gilbert, Kevin Nelson, and Samantha Geunther as seasonal full-time employees and Marc Smith and Tom Cardinal as seasonal part-time employees. Approve Advertisement of Bid for 2011 Seal Coating Proiects Each year, the City of Hugo seal coats a portion of its bituminous roads. Staff seeks authorization from the City Council to advertise for the 2011 seal coating project and receive bids. Bids would then be awarded in June 2011 and work would take place during the month of June and July. Adoption of the Consent Agenda approved the advertisement of bid for the 2011 seal coating project. Approve Agreement with Connexus Energy and City of Hugo for Overhead Power Lines Along Elmcrest Avenue Council Member Haas removed this item from the Consent Agenda. City staff had received a request from Connexus Energy to upgrade a section of overhead power lines along Elmcrest Avenue. According to City Code, the type of improvements requested by Connexus would require the lines to be located underground. Haas questioned why the City would grant an exception to this. Community Development Director Bryan Bear explained the request was to replace a section of overhead lines approximately 300 feet in length, and Connexus has asked for a waiver of that requirement due to the costs involved. The upgrades will involve only slight modifications to the visual appearance of the existing overhead lines. Bear added that underground power lines could prove to be in the way when improvements are done to Elmcrest Avenue. Also, at the time the City of Lino Lakes improves Otter Lake Road, which would be the alternative route parallel to Elmcrest, the lines would be replaced with lines underground providing power to residents on Elmcrest Avenue. The lines would be removed or located underground at no cost to the City or its rate payers once future development provides an alternate right-of-way for the power lines. Haas make motion, Klein seconded, to approve the agreement with Connexus Energy and the City of Hugo for Overhead Power lines along Elmcrest Avenue. All Ayes. Motion carried. Approve Tobacco Use in City Parks Policy Council Member Haas removed this item from the Consent Agenda. At its November 15, 2010 meeting, the City Council had a discussion on a Tobacco Use Policy, which was tabled to allow additional discussion by the Parks, Recreation and Open Space Commission. For the past several months, the Parks Commission members have debated a tobacco use policy. At its April 13, 2010 meeting, the Parks, Recreation and Open Space Commission drafted a resolution and recommended City Council approve the resolution adopting the Tobacco Free Parks Policy. Hugo City Council Meeting Minutes for May 2, 2011 Page 6 of 8 Haas asked how enforcement be done would be done, and Community Development Director Bryan Bear explained it would be voluntary compliance. Klein asked if it was necessary to put time into something the City would not be enforcing. Weidt commented that smoking in the parks has not been an issue. Haas indicated he was opposed to this policy. Petryk noted the absence of the Mayor at this meeting and made a motion to table this item until his return. Motion failed for lack of a second. Brittany McFadden, Program Director for Tobacco Free Youth Recreation Program offered to present education and information on the subject to the Council. She also stated she does not know of there ever being enforcement issues such as altercations between smokers and nonsmokers. Rachel Berger, Parks Commission Vice Chair, indicated the Parks Commission was not unanimous on this policy, especially the enforcement of it. She said she felt this policy would be in the best interest to the community. Haas made motion, Weidt seconded, to not approve the Tobacco Use in City Parks Policy. Update on Victor Gardens Drainage Improvement Proiect — Tony Schwab At its September 20, 2010 meeting, Council discussed solutions to address the groundwater that has been affecting a number of residents following construction of their homes in Victor Gardens. Those residents requested Council approve a grant to match a grant from Rice Creek Watershed District to help pay for a specific project that will assist residents in dealing with the issue. At its October 4, 2010 meeting, Council approved a grant not to exceed $45,875 for the City's portion of the project. At the Council meeting on November 15, 2010, resident Tony Schwab updated the Council on the project and offered to attend a spring 2011 meeting to provide Council another update on the drainage improvement project. Tony Schwab was in attendance this evening and informed the Council the improvements were working flawlessly. He also volunteered to work on water reuse/redistribution in the Victor Gardens area. Community Development Director Bryan Bear informed the Council and Tony that City staff was working with the Rice Creek Watershed District on potential projects involving water reuse, and the Victor Gardens area was one of them. Haas made motion, Weidt seconded, to accept the report from Tony Schwab and invite Tony to proceed in working with staff on water reuse possibilities for the area. All Ayes. Motion carried. Hugo City Council Meeting Minutes for May 2, 2011 Page 7 of 8 Lemonade Day on June 5, 2011 This was added to the agenda to provide the Council and public on Lemonade Day in the City of Hugo. Rachel Berger, 14318 Cossette Way, informed Council that National Lemonade Day was started in 2007 and was co-founded to enrich children to start their own business. This year's Lemonade Day would be on June 5th, and 35 children have already registered to start their own lemonade business. Rachel requested staff put up signs at City Hall to promote the event, allow kids to come to City Hall to sign up, and schedule a workshop at City Hall for parents with children who are signed up. Petryk made motion, Weidt seconded, to approve the City to help facilitate and promote the Lemonade Day Event. All Ayes. Motion carried. Yellow Ribbon Network Update Council Member Haas added this to the agenda to provide an update on the events of the Yellow Ribbon Network. Haas had distributed thank your cards to be given out to veterans, and he was happy to report there were 92 people who attended the last Burger Night at the Hugo American Legion. Burger Night is on the fourth Wednesday of each month from 5-7 p.m. The YMCA will be providing free day passes to military family, and a pool party and BBQ is being scheduled at the facility. Cub Foods is also providing tickets to the Minnesota Saints game on May 12, 2011 for military families. Update on Charitable Gambling Council Member Haas added this to the agenda to request an update from staff on charitable gambling organizations. City Clerk Michele Lindau stated she was gathering the Lawful Expenditure Reports and the receipt and expense reports from the four gambling organization in Hugo and will be providing the information to the Council. City Administrator Performance Review on May 16 or May 26, 2011 At its April 18, 2011 meeting, the Hugo City Council directed City staff to schedule the City Administrator's performance review for Monday, May 16, 2011 immediately following the regularly scheduled Hugo City Council meeting or Thursday, May 26, 2011. Staff informed Council there would be time to conduct the performance review after the regular Council meeting on May 16, 2011. Update on April 21, 2011 Lake Air/Bald Eagle Estates Neighborhood Meeting Staff will add to the May 16, 2011 agenda an update on the neighborhood meeting held on April 21, 2011 with the residents from the Lake Air Estates and Bald Eagle Estates neighborhood on a potential improvement project.
