Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claim Roster as presented. Approve Advertisement of Bid for 2010 Seal Coating Proiects Each year, the City of Hugo seal coats and crack fills a portion of its bituminous roads. Staff seeks authorization from the City Council to advertise for the 2010 seal coating & crack filling projects. Bids would then be awarded in May 2010 and work would take place during the month of June. Adoption of the Consent Agenda approved advertisement of bid for the 2010 seal coating and crack filling projects. Approve Advertisement of Bid for 2010 Graveling Project Each year, the City of Hugo re -gravels a portion of its gravel roads. Staff seeks authorization from the City Council to advertise for the 2010 graveling project. Bids would then be awarded in May 2010 and work would take place during the month of July. City staff recommends Council authorize advertisement of bid for the 2010 graveling project. Approve Advertisement of Bid for 2010 Dust Control Proiect The City of Hugo currently applies dust control to approximately 23 miles of gravel roads located within its municipal boundaries. The City has budgeted $117,000 for the dust control project in 2010. Staff seeks authorization from the City Council to advertise for the 2010 Dust Control Project. Bids would then be awarded in May 2010. The dust control/stabilization would be applied in two separate applications, once in mid-May and again in early to mid-August. Hugo City Council minutes for March 1, 2010 Page 3 of 8 Approve 2009 Building Department Annual Report Annually, the Community Development Department prepares its Annual Building Department Report which highlights building activity that has taken place in the City of Hugo over the past year. 2009 was a solid year for the City of Hugo in regard to residential and commercial construction activities. The City issued 147 residential building permits, which is down from 188 in 2008 but still very strong considering the economy and surrounding communities. This issue was tabled by the City Council on February 1, 2010 in order to allow the Planning Commission to receive the report at its February 11, 2010 meeting. The Planning Commission unanimously recommended approval of the 2009 Building Department Annual Report. Adoption of the Consent Agenda approved the 2009 Building Department Annual Report. Approve Resolution Extending the MOA for Maintenance on Judicial Ditch #2 On July 27, 2005, the City of Hugo and the Rice Creek Watershed District (RCWD) entered into a Memorandum of Agreement (MOA) to provide for the minor maintenance of Judicial Ditch #2. At its Wednesday, February 24, 2010 meeting, the RCWD agreed to extend the MOA for an additional five years, until December 31, 2014. All other terms of the MOA remain unchanged. Adoption of the Consent Agenda approved the attached MOA for the maintenance of Judicial Ditch #2. Approve Lawful Gambling Permit for Pheasant Forever Event at Sal's Angus Grill on March 8, 2010 The City of Hugo has received an application for a lawful gambling permit for Pheasants Forever who will be holding a charitable event at Sal's Angus Grill on Monday, March 8, 2010. City staff has reviewed the application and found it to be satisfactorily complete. The charitable gambling permit allows for the Pheasants Forever organization to conduct a charitable raffle. Adoption of the Consent Agenda approved the lawful gambling permit for Pheasants Forever at its charitable event at Sal's Angus Grill on Monday, March 8, 2010. Approve Resolution for P.U.D. General Plan and Final Plat for Positive Companies Retail Building in Victor Gardens Positive Companies, Inc. requested approval of a PUD general plan for an 11,933 -square foot shopping center on property located north of Frenchmen Road (CSAH 8) and east of Elmcrest Avenue North. The applicant is also seeking approval of a final plat for a subdivision to be known as "Positive" for the creation of 1 lot and 3 outlots. At its February 11, 2010 meeting, the Hugo Planning Commission unanimously recommended approval of the P.U.D. General Plan for Positive Companies. Adoption of the Consent Agenda approved RESOLUTION 2010-5 APPROVING A PUD GENERAL PLAN FOR POSITIVE COMPANIES, INC. FOR "POSITIVE" DEVELOPMENT ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (CSAH 8) AND EAST OF ELMCREST AVENUE NORTH and RESOLUTION 2010-6 APPROVING A FINAL PLAT FOR POSITIVE COMPANIES, INC. FOR "POSITIVE"ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (CSAH 8) AND EAST OF ELMCREST AVENUE NORTH. Hugo City Council minutes for March 1, 2010 Page 4 of 8 Approve Amended Supplemental Law Enforcement Services Agreement for Bald Eagle Lake The Bald Eagle Lake Homeowners Association has notified White Bear Township that it is financially not able to meet the terms of the agreement and has therefore requested to be removed from the Supplemental Law Enforcement Services Agreement. The effect of the removal of their prorate share of the agreement reduces Ramsey County Sheriff's patrol hours down to 120 hours from 160 hours. The cost of this law enforcement service to the City of Hugo will remain the same. Adoption of the Consent Agenda approved the amended Supplemental Law Enforcement Services Agreement for Bald Eagle Lake. Approve Recommendation to Promote Associate Planner Rachel Simone to City Planner Rachel Simone was hired by the City of Hugo as an Associate Planner on January 2, 2007, after completing an internship for nearly a year. Over the past four years, Rachel has worked hard to develop the skills necessary to be a successful City Planner. Rachel now is completely responsible for the development of the Economic Development Authority agenda and background material as well as making presentations to the Planning Commission and Board of Zoning Appeals and Adjustments. Rachel has become more independent with experience and no longer requires close supervision. Community Development Director Bryan Bear has completed Rachel's Annual Performance Appraisal and has determined that Rachel is ready to advance from her entry-level Associate Planner position. Adoption of the Consent Agenda approved the recommendation from Community Development Director Bryan Bear to promote Associate Planner Rachel Simone to City Planner. Approve City Focus Goals and Ongoing Priorities for 2010 At its January 25, 2010 meeting, Council conducted its annual goal setting session with recommendations from City commissions and the Fire Department. After discussion, Council agreed to set the City's Focus Goals with Ongoing Priorities for 2010 with final revisions solicited from individual Councilmembers. Adoption of the Consent Agenda approved the City's Focus Goals and Ongoing Priorities for 2010. Approve Application from Final Stretch, Inc. for a Running Event in City of Hugo on May 22,2010 For the past nine years, White Bear Lake running officials have held a running event in May with a 10 mile and 30K race. Races are held at the Ramsey County Beach on Bald Eagle Lake and follow a secured route which includes a short portion in the City of Hugo. The club Final Stretch, Inc., has made application for approval of the race route with the City of White Bear, White Bear Township, and the City of Hugo, along with the assistance of Ramsey County Sheriffs Department officials. Final Stretch, Inc., has obtained the additional liability insurance coverage which applies to volunteers and runners. Adoption of the Consent Agenda approved the application of Final Stretch, Inc., for a 10 -mile and 3 O race to be held on Saturday, May 22, 2010 for a route to follow Elmcrest Avenue on the north end of Bald Eagle Lake from 129th Street North to Frenchman Road. Hugo City Council minutes for March 1, 2010 Page 5 of 8 Approve Authorization to Advertise for 2010 Public Works Seasonal Positions Staff is requesting authorization to advertise and hire a total of five (5) seasonal employees for the public works department. In the 2010 General Fund Budget, Council approved the five seasonal positions. Seasonal Public Works Employees assist with mowing, garbage/litter removal, park maintenance, boulevard maintenance and general public works maintenance. Adoption of the Consent Agenda approved the authorization to advertise for these seasonal positions. Approve Retirement of Building Official John Benson Effective March 29, 2010 John Benson was hired as the City of Hugo's Building Official on May 9, 1988. For the past 22 years, John has demonstrated a work ethic and commitment to excellence in his building inspection profession second to none. John was a "one man" shop for many years serving as the City's Building Inspector as well as Code Enforcement Officer. Beginning in the late 1990's, John received additional help from new building inspectors along the way, including the hiring of both Chuck Preisler and Scott Baller in 2004 and 2006 respectively. In John's 22 years with the City of Hugo, he has completed tens of thousands inspections in varying degrees on the City's residential, commercial, and industrial buildings. John is well known and respected by contractors as someone who is knowledgeable and fair with a great sense of humor. City staff is in the process of preparing a resolution recognizing his retirement and will present it to Council at its March 15, 2010 meeting. Adoption of the Consent Agenda approved the letter of resignation from Building Official John Benson and recognize his retirement from the City of Hugo effective March 29, 2010. Approve City of Hugo Spring Clean Up Event For Saturday, April 24, 2010 Last fall, after the success of the fall clean up event and the overwhelming resident response, Council directed staff to organize a spring clean up event to be held at the Public Works Facility. The event has been scheduled for April 24, 2010 from 8:00 to noon. The event will be coordinated with a Washington County household hazardous waste event as it has been in the past. Adoption of the Consent Agenda approved Saturday, April 24, 2010 from 8 a.m.-noon at the Hugo Public Works Department at 6900 137' St. North. Approve Grant Application to White Bear Lake Community Education to Purchase Youth Soccer Goals The City of Hugo was informed of a grant opportunity with the White Bear Lake Community Education Department, which would help fund the cost of youth soccer goals with nets. Staff met recently with Parks and Recreation Commission Chair Jim Taylor and Vice -Chair Rachel Berger who agreed that additional youth goals are needed. Adoption of the Consent Agenda approved the grant application to the White Bear Lake Community Education Department to assist in funding the purchase of youth soccer goals with nets. Hugo City Council minutes for March 1, 2010 Page 6 of 8 Update on South Ethan Avenue Neighborhood Meeting City Engineer Jay Kennedy and Senior Engineering Technician Steve Duff, along with Mayor Fran Miron and Councilmember Becky Petryk, held a neighborhood meeting on Monday, February 22, 2010 at which a number of residents were in attendance. City Engineer Jay Kennedy provided Council with an update on this meeting where neighbors expressed concerns about traffic speeds, connection fees, assessments and deferments. Rick Gwynn, 12277 Ethan Avenue, was present and the Mayor thanked him for his leadership in going door-to-door soliciting comments and questions from the residents and bringing their concerns to City staff. Rick stated the meeting was beneficial to the staff and residents who received answers to those questions and raised additional issues that will be address at the next meeting on April 26, 2010 at 7:00 p.m. in the Oneka Room at City Hall. Council discussed the need to address the traffic concerns in that area. Miron made motion, Petryk seconded, to direct staff to install a speed indicator sign temporarily and to work with the Sheriff's office to increase patrol in the area. All Ayes. Motion carried. Discussion on Approval of Revised Burning Ordinance At its August 17, 2009 City Council meeting, Fire Chief Jim Compton recommended the City consider adopting a formal burning ordinance. The Council had directed staff to prepare a draft burning ordinance for Council consideration, and they discussed various drafts of the ordinance on three separate occasions. Community Development Director presented the most recent draft and explained that this ordinance could be administered with current staffing levels. The proposed ordinance includes requiring permits for open burning but not when ground is snow covered, establishment of fees for illegal burns based on response and administrative costs, limits on recreational burning, and prohibiting burning in barrels or using turkey flyers on decks. The Council discussed whether using turkey flyers and grilling on decks should be prohibited, and Assistant City Attorney Christine Eid suggested adding precatory language instead. Council also questioned what was allowed by Home Owner's Associations (HOA) regarding grilling on decks, and they discussed prohibiting recreational fires from 2 a.m. to 6 a.m. Haas made motion, Petryk seconded, to approve ORDINANCE 2010-443 AMENDING HUGO CITY CODE, CHAPTER 34, FIRE PREVENTION AND PROTECTION with revisions by staff removing prohibitive language regarding turkey fryers and similar activities, and adding language prohibiting fires between 2 a.m. and 6 a.m. Included in this motion was direction to staff to provide information on HOA's regarding burning on decks, and direction to the Fire Chief to keep data on winter burning responses by the Fire Department and report back to the City Council. Hugo City Council minutes for March 1, 2010 Page 7 of 8 Update on Highway 61 Speed Study Completed by MN DOT Residents living adjacent to Highway 61 expressed concern regarding the location of the speed transition on Highway 61 in the area north of 147th Street. The City Council had requested that MnDOT complete a speed study on Highway 61 between 147th Street and 165th Street, which has been completed. City Engineer Jay Kennedy shared the results of the speed study explaining what the current speed limits were and the lack of a transition zone near the Post Office (150th Street) where the speed limit goes from 35 mph to 55 mph. MN DOT had recommended a speed limit of 45 mph between 152nd Street (entrance to the Peloquin Industrial Park) and 150th Street. Jay also noted speed limits would be reevaluated after lights were installed at the intersection of 147th Street and Highway 61. Haas made motion, Klein seconded, to notify MN DOT that Council approves of their recommendation and requests signage changes. All Ayes. Motion carried. Approve Recommendation from EDA to Co -Sponsor Hugo Business Association Kidz `n Biz Fest on April 17 and Spring Savings Show on May 8 At its February 8, 2010 meeting, the Hugo Economic Development Authority (EDA) discussed the sponsorship request from the Hugo Business Association for the City's sixth annual Hugo Kidz 'n Biz Fest as well as the first annual sponsorship of the Hugo Business Association's Spring Savings Show. After discussion regarding the success of the Hugo Kidz 'n Biz Fest, the EDA agreed to recommend to the City Council the sponsorship of the event with funds in the amount of $750 for the sixth annual Kidz `n Biz Fest. After discussion, the EDA agreed to co- sponsor the Hugo Business Association's first annual Spring Savings Show with no funds except for formal approval and use of the Hugo City Hall on Saturday, May 8, 2010. Klein made motion, Haas seconded, to approve the recommendation from the EDA to co- sponsor the Hugo Business Association sixth annual Kidz `n Biz Fest on April 17, 2010 from 11 a.m. to 2 p.m. and the Hugo Business Association Spring Savings Show on May 8, 2010 from 11 a.m. to 5 p.m.. All Ayes. Motion carried. New Metro Area Management Association (MAMA) President -City Administrator Mike Ericson Councilmember Chuck Haas publicly announced and recognized City Administrator Mike Ericson for his new leadership role as the 2010 President of the Metro Area Management Association (MAMA), which is the official professional association serving the city managers and city administrators in the Twin Cities area communities. Mike has served as officer on the Board of Directors for the past two years and is firmly committed to providing professional development opportunities for the members of the professional association of city managers and city administrators. Mayor Fran Miron congratulated Mike in this leadership role. Hugo City Council minutes for March 1, 2010 Page 8 of 8 2010 LMC Annual Conference and Marketplace on June 23-25 in St. Cloud The League of Minnesota Cities will hold its 2010 Annual Conference and Marketplace on June 24-25, 2010 at the St. Cloud Civic Center in St. Cloud with a pre -conference workshop on June 23. City Administrator Mike Ericson asked Council to contact City Clerk Michele Lindau if they would like to attend this event.
