Approval of Minutes for City Council Meeting on April 5, 2010

Approval of Minutes for Meeting with Local Business on TH61/130th St. Intersection
Improvements on April 13, 2010 at Wilson Tool International
Weidt made motion, Haas seconded, to approve the minutes for the April 13, 2010 meeting with
local businesses regarding the intersection improvements at TH61 and 130th Street held at
Wilson Tool International as presented.

Approve Special Event Permit for 1" Annual Sarah's Daisy Dash 5K Fun Run on June 5, 2010
Recently, City staff was contacted by representative from Tri Fitness and friends of Sarah
Condon Mitzuk who passed away in January. Two friends, Jill Rosenthal and Elena Reicher,
inquired as to what it would take to conduct a fun -run in the City of Hugo to commemorate the
life and spirit of Sarah Condon Mitzuk. City staff spent time with the two friends and Tri Fitness
who was contacted to be the race organizer. After discussion, friends agreed to hold the event at
Lions Park and use the same route the City used in the 2006 Centennial 5K Run. Staff has

worked very closely with Tri Fitness and Sarah's two friends to prepare for the race which
includes a Special Event Permit for use of Lions Park and the Hardwood Creek trail. Elena
Reicher was at the meeting with several of Sarah's friends and Sarah's mom to show support for
the Special Event Permit and to raise public awareness about the event. Elena stated that all the
proceeds would go to a scholarship fund for Sarah's son Michael.
Weidt made motion, Petryk seconded, to recommend approval of the Special Event Permit for
the lst Annual Sarah's Daisy Dash 5K Fun Run as well as the half -mile Kids Race scheduled for
Saturday, June 5, 2010.

Ordinance, which was unanimously approved by Council. Staff prepared a summary ordinance
for publication of the Underground Utilities Ordinance. Adoption of the Consent Agenda
approved the Summary Ordinance for publication in The Citizen for the new Underground
Utilities Ordinance.
Approve Summary Ordinance for Publication of the Right -of -Way Ordinance
At its April 5, 2010 meeting, the Council held a public hearing on the Right -of -Way Ordinance,
which was unanimously approve by Council. Staff prepared a summary ordinance for
publication of the Right -of Way Ordinance. Adoption of the Consent Agenda approved the
Summary Ordinance for publication in The Citizen for the new Right -of -Way Ordinance.

Approve 3.2 Temporary Beer License for Hugo Lions Club for Good Neighbor Days June
10-13,2010
The City has received an application from the Hugo Lions Club for a Temporary 3.2 Liquor
License in order for the Lions to sell 3.2 beer at Hugo Good Neighbor Days scheduled for June
10-13, 2010. City staff has reviewed the application and found it to be satisfactorily complete
with the submittal of the necessary liquor liability insurance coverage which names the City of
Hugo as an additional insured. Adoption of the Consent Agenda approved the Temporary 3.2
Liquor License for the Hugo Lions so they can sell 3.2 beer at Hugo Good Neighbor Days on
June 10-13, 2010.
Approve Resolution Approving Demolition of the Old Antique Store
Staff has recently met with Mike and Catherine Anderson and their attorney to discuss the future
of the property at 14583 Forest Blvd. N. City staff has been encouraging the Andersons to
demolish the Antique Store building because of its blighted and unsafe condition. At its April 5,
2010 meeting, the Council discussed an assessment agreement whereby the building would be
demolished, and the cost of the demolition would be incurred by the City and spread against the
property to be paid back over ten years with interest. Council directed staff to draft a resolution
formally approving the demolition of the old antique store. Adoption of the Consent Agenda
approved RESOLUTION NO. 2010-13 RESOLUTION OF THE CITY OF HUGO,
WASHINGTON COUNTY, MINNESOTA, ADOPTING ASSESSMENT.
Approve Resolution to Apply for Grants for Monitoring Wells
At its September 17, 2009 meeting, Council discussed permitting requirements associated
with future Well No. 6 to be located off 125th Street North. As part of the permit requirements
of the MN DNR, the City is required to install monitoring wells for which there is a grant
program available through the Legislative — Citizen Commission on Minnesota Resources
Appropriations (LCCMR). Adoption of the Consent Agenda approved RESOLUTION NO.
2010 -14 SUPPORTING REQUEST FOR THE LEGISLATIVE — CITIZEN COMMISSION
ON MINNESOTA RESOURCES APPROPRIATIONS (LCCMR) FROM THE
ENVIRONMENT AND NATURAL RESOURCES TRUST FUND FOR GROUNDWATER
MONITORING.
Approve Award of Bid for 2010 Gravel Proiect
At its March 1, 2010 meeting, the Hugo City Council authorized City staff to advertise for the
award of bid for the 2010 graveling project. Bids were received and opened on Friday, April 16,
2010 for this contract. The City received three bids, and Dresel Contracting was the low bidder
at $7.87 per ton of Class 5 aggregate. The total project cost was estimated to be $86,042.00.
Haas made motion, Petryk seconded, to approve the award of bid for the 2010 graveling project
to Dresel Contracting at $7.87 per ton.

Approve Award of Bid for 2010 Dust Control Proiect
At its March 1, 2010 meeting, the Hugo City Council authorized City staff to advertise for the
award of bid for the 2010 dust control project. Bids were received and opened on Friday, April
16, 2010 for this contract. One bid was received from Dustcoating, Inc for magnesium chloride
at $.71 per gallon.
Haas made motion, Klein seconded, to award the bid for the 2010 dust control project to
Dustcoating, Inc to apply magnesium chloride at $.71 per gallon for all 25 miles of gravel road.
All Ayes. Motion carried.
Approve Award of Bid for 2010 Seal Coating Proiect
At its March 1, 2010 meeting, the Hugo City Council authorized City staff to advertise for the
award of bid for the 2010 seal coating project. Bids were received and opened on Friday, April
16, 2010 for this contract. The City received three bids, and Allied Blacktop, Inc. was the low
bidder at $80,327.50.
Haas made motion, Petryk seconded, to award the bid for the 2010 seal coating project to Allied
Blacktop, Inc at $80,327.50.

Discussion on Storm Water CIP and Stormwater Management Plan- Water Resource
Engineer Pete Willenbring
City staff has been coordinating with staff from the Rice Creek Watershed District as they update
their stormwater model for the Hardwood Creek and Clearwater Creek drainage basins. This
work is being done in preparation for a joint planning effort between the City and RCWD to
prepare a stormwater CIP intended to provide for regional infiltration requirements and water
recycling projects. Pete Willenbring explained the reasons the City was obligated to update the
City's Comprehensive Stormwater Management Plan (CSMP) and tasks involved which include
gathering and analyzing data, public input, and development of ordinances and implementation
plan. Work on the CSMP would begin in May 2010 and be completed in April 2011 at an
estimated cost of $54,726.
Weidt made motion, Petryk seconded, to approve the Scope of Services for task involved in
updating the City's Comprehensive Stormwater Management Plan at an estimated cost of
$54,726, which would be funded by the City's Stormwater Sewer Fund.

Discussion on CSAH 8 East Project - Washington County Project Engineer Jake Gave
On April 13, 2010, City staff met with Washington County Officials to discuss the CSAH 8 east
county road reconstruction project. Washington County Project Engineer Jake Gave and
Engineering Construction Manager Cory Slagle provided the Council an update on work

completed on preparation of the project which is scheduled for Summer 2010. Cory explained
there would be 3.9 miles of pavement reclamation, subcuts, turn lanes at Hanifl Fields, and
replacement of 14 metal culverts with concrete ones. There would also be an infiltration area as
required by Rice Creek Watershed District. Included in the plans are improvements to the signs
and replacing of mailboxes. The County would be using State Aid dollars for the project with
the total cost being $2,341,180.45. The cost to the City would be $126,908.77. Plans will be
finalized in May, bids opened in June, and work done in mid to late summer. No formal action
was taken.
Council Action on Bids for Hanifl Park Shelter
On Wednesday April 14, 2010, bids were opened for construction of the new Hanifl Park
Shelter. Twelve bids were received. The apparent bid amounts ranged from $499,000.00
to $870,504.00. City Attorney Dave Snyder explained to the Council there were two apparent
low bidders, and there appeared to be calculation difficulties. Dave recommended all bids for
the project be rejected and the project be re -bid. Re -bidding the project would not affect the
project completion date.
Haas made motion, Petryk seconded, to approve RESOLUTION 2010-15 REJECTING ALLS
BIDS AND ORDERING RE -ADVERTISEMENT FOR BIDS FOR THE CONSTRUCTION OF
THE HANIFL FIELDS ATHLETIC PARK SHELTER.

Discussion on Gravel Tax
At its December 7, 2009 meeting, the City Council directed staff to discuss and review with
Washington County how the County administers collection of the gravel tax and how proceeds
are spent within the County. City staff has learned that the state statute concerning the gravel tax
was changed in 2008 reallocating how gravel tax proceeds may be used by the County. One
significant change to the law includes a requirement that 15% of the gravel tax proceeds be set
aside into a special reserve fund specifically for expenditures related to the restoration of
abandoned pits, quarries, or deposits located within the County. Staff has specifically inquired
whether the County would consider allocating funds from this special reserve fund toward
further restoration activities and repair of the haul roads surrounding the Hansen gravel pit site.
Currently, the special reserve fund has accumulated at least $300,000 in gravel tax proceeds.
Community Development Director Bryan Bear explained the funds could get spread throughout
the County and municipalities, and further restoration on the old gravel pit property would be a
good use. He encouraged the Council to participate in County workshops on the matter. Parks
Commission Member Roger Clarke stated there has been preliminary discussion on locating a
mountain bike trail in the northwest corner of the site. Council directed staff to keep them
apprised of workshops dates and times. No formal action was taken.
Discussion on Adding Cats to the Animal Ordinance
For the past several years, City staff has received inquires from residents as to why the City of
Hugo does not include cats in the City's Animal Ordinance. Most recently, issues arose when

residents had run ins with a number of cats, both domestic and feral, where the Washington
County Sheriff's Deputy and animal control officer had no jurisdiction to require the resident to
control the cats. At its April 5, 2010 meeting, the Council discussed whether cats should be
added to the City's Animal Ordinance. Council tabled this item and directed staff to determine
what the cost would be to include cats in the City's Animal Ordinance. City Clerk Michele
Lindau explained the cost of impounding stray cats would be the same as for dogs, and according
to Animal Control, cats were less likely to be reclaimed. Council discusses alternative solutions.
Petryk made motion, Klein seconded, to direct staff and EDA to contact local vets and business
owners and invite them to participate in a low cost/no cost vaccinating and rabies clinic day, and
to solicit ideas on how to best handle cats in the City of Hugo.

Recommendation from Parks and Recreation Commission to Approve Parks Planner
Position
At its April 14, 2010 meeting, the Parks and Recreation Commission discussed the addition of a
permanent full time staff member to carry out parks programming related duties. The Parks
Commission discussed the success the City has had in implementing its Parks Master Plan and
using the parkland dedication ordinance to acquire parkland and construct a network of high
quality neighborhood parks. The City has also completed the construction of regional amenities
including the Oneka Elementary Gymnasium and the Hanifl Fields Athletic Complex. Many of
these new facilities have been getting used recently by residents during special events and
activities sponsored by the Parks and Recreation Commission. The success of these events along
with the results from the recently completed University of Minnesota Community Growth Options
Survey on parks facilities and recreation programming, has led the Parks Commission to shift its
focus from construction of additional facilities to a concentration on Parks Programming. The
Commission voted 6 to 1 to recommend approval of a full time, entry level Parks Planner position,
with funding provided by the parks levy. Community Development Director Bryan Bear provided
Council with a detailed PowerPoint presentation of all the issues related to the position. Public
Works Director Scott Anderson discussed with Council how the new staff position was necessary
to continue and expand the parks activities.
Parks and Recreation Chairman Jim Taylor, 4673 Empress Way North, talked about the how Parks
Commissioners were volunteers who dedicated a lot of their time. The Commissioners had no
time to put into programming.
Parks Commissioner and former chair Roger Clarke, 14068 Fondant Avenue North, said there had
been a lot of changes in the parks in the past seven years he has been on the Commission, and it
was time for a new focus.
Miron made motion, Weidt seconded, to direct staff to continue to work with the Parks
Commission to finalize the Parks Planner job description, and bring it back to the City Council for
final approval.

Review State Law Changes to Absentee Voting and Staff Recommendation
On April 13, 2010, City Clerk Michele Lindau and Community Development Assistant Dennis
Fields met with Carol Peterson from Washington County Elections to discuss State Law changes
which affect the absentee voting in municipalities throughout the State of Minnesota. As
Council is aware, the 2009 State Legislature made a number of changes to eliminate errors in the
absentee voting system which include using the statewide Voter Registration System (VRS)
which will be used for registering voters and tracking absentee voter applications and ballots.
The mandate from the State of Minnesota dramatically affects how the City of Hugo will provide
absentee voting for its residents. City Clerk Michele Lindau and Washington County Election
Supervisor Carol Peterson explained the changes in absentee voting and the options available to
the Council.
Haas made motion, Klein seconded, to have absentee voting done by Washington County with
absentee voting done at the Washington County Forest Lake Service Center.
All Ayes. Motion carried.
Prepare Draft Notification Policy for Elected Officials
Councilmember Chuck Haas has requested the City of Hugo include in its personal policy a
formal notification police whereby the Hugo City Council would be formally notified in the
event of natural disasters, public emergencies, and tragedies like the car in the pond which
occurred on Saturday, April 10, 2010. The information received from Commander Cheri Dexter
was that the Washington County Sheriffs Department treated it as a vehicular accident, and the
victim was alive when she was transported to Regions Hospital. Commander Cheri Dexter made
the decision not to notify the City because it was not a DOA. Haas state the importance of
notifying the City Council; to be unaware of such events has an adverse effect on the Council's
credibility.
Miron made motion, Haas seconded, to direct staff to prepare a draft notification policy, to
include the police and fire department, for Council review.

Citizen Recognition and Rewards
Councilmember Haas added this to the agenda. Recently, there has been several individuals who
have shown outstanding heroism and bravery. Haas stated that Hugo is a good neighbor
community with several outstanding citizens who should be recognized such as Brian Peltier and
Caesar and Ricky Romero along with four firefighters who assisted the woman who drove in the
pond on April 10, 2010 as well as Russ Semo who woke homeowners to alert them of a fire.
Staff was directed to explore recognition policies in other communities.

Schedule Annual Performance Review for City Administrator Mike Ericson
Mike Ericson was hired by the City of Hugo as its new City Administrator on April 17, 2000.
Over the past ten years, the City of Hugo has conducted an annual performance review of the
City Administrator with himself, Council, and City Attorney David Snyder.
Miron made motion, Weidt seconded, to direct staff to schedule a date and time on which to hold
the City Administrators annual performance review along with the completion of the
performance review form.

Carnelian Marine -St. Croix Watershed District Accepting Applications for Advisory Board
City staff has received notification from Washington County that a term for a board member on
the Carnelian -Marine -St. Croix Watershed District will be expiring in June. City Administrator
Mike Ericson announced that any resident interested in the board position should make
application to the City of Hugo and/or Washington County.
Sixth Annual Hugo Kid `n Biz Fest at Oneka Elementary on April 17, 2010
The 6th Annual Kidz `n Biz was held on Saturday, April 17, 2010 from 11 a.m. to 2 p.m. at
Oneka Elementary School. The event is presented by The Citizen and co-sponsored by the Hugo
Economic Development Authority and the Hugo Business Association. Over 2,200 people
attended this totally free event. The City of Hugo thanked the businesses in the community who
were there marketing their businesses as well as the dozens of volunteers including White Bear
Lake High School students who worked the event along with City staff and other volunteers.
Parks and Trails Legacy Plan Public Meeting on Wednesday, May 12, 2010
In 2008, Minnesotans passed the Clean Water Land and Legacy Act which increased sales tax to
provide funding for regional and state parks and trails. The MN DNR is working to plan how
these funds should be spent and they are seeking public input. A meeting has been scheduled for
Anoka and Washington County residents at the Washington County Headwaters Service Center
in Forest Lake on Wednesday, May 12, 2010 from 7-9 pm.
Haas made motion, Weidt seconded, to schedule May 12, 2010 as a meeting to allow Council
attendance at the Parks and Trail Legacy Plan Public Meeting held at the Washington County
Headwaters Service Center in Forest Lake from 7-9 p.m.

National Wild Turkey Federation Youth Mentoring Program
On Saturday, April 17, 2010, Councilmember Chuck Haas attended a luncheon that was held by
the Schwieters Companies for the youth, families, and mentors who are involved in the National
Wild Turkey Federation Youth Mentoring Program. For the past several years, Joel and John
Schwieter, have opened their doors for the National Wild Turkey Federation Youth Mentor
Hunt, which helps get many area youth involved in the outdoors.

Haas made motion, Klein seconded, to send Schwieters and Schwieters employee Keith Carlson,
who runs the metro program, a thank you note for their contribution to the National Wild Turkey
Federation Youth Mentoring Program.
