All Ayes. Motion carried. Approve Minutes for the Hanifl Fields Groundbreaking Ceremony on June 9, 2010 Weidt made motion, Klein seconded, to approve the minutes for the Hanifl Fields Groundbreaking Ceremony held on June 9, 2010 as presented. All Ayes. Motion carried. Approve Minutes for the Business Networking Breakfast on June 15, 2010 Weidt made motion, Klein seconded, to approve the minutes for the Business Networking Breakfast held on June 15, 2010 in the Oneka Room at Hugo City Hall as presented. All Ayes. Motion carried. Approval of the Agenda Miron made motion, Haas seconded, to approve the agenda as amended: Add F.1— Update on Hugo Good Neighbor Days from the Lion Club Add K.1 — James Trudeau Law Enforcement Award All Ayes. Motion carried. Update on Hugo Good Neighbor Days from the Lion Club Lions Member and Good Neighbor Days Treasurer Steve Markeson provide the Council a brief update on the 2010 Hugo Good Neighbor Day Festival. Steve reported that this year brought in the least amount of revenue in the past 12 years. He cited bad weather on Thursday, Friday, and Minutes for the Hugo City Council Meeting June 21, 2010 Page 2 of 7 most of Saturday as the reason attendance was down. He said the Lions really appreciated the City's participation and the presence of the Washington County Sheriff's Department. Katie Riopel, otherwise known as the "Parade Lady", reported there were 69 units in the parade, and the rain held off for most of the parade. Next year's Good Neighbor Days Festival will be June 7-12, and it was explained it is always two weeks after the Memorial Day weekend. The Mayor said he appreciated all the work the Lions do in putting on this event for the City, and he commented that the road construction around the Lions Park may have contributed to the decline in attendance. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claim Roster as presented. Approve Annual Performance Review for Public Works Lead Worker Tom Smith Tom Smith was hired by the City of Hugo on June 26, 2000. Tom has worked hard over the past ten years as a valued member and leader of the public works department team. As lead worker, Tom provides direction to full time and summer seasonal staff on an as -needed basis in the absence of the Public Works Director. Tom is a dedicated, loyal, and conscientious member of the Public Works Department Team. Tom is respected for getting the job done. Adoption of the Consent Agenda approved the annual performance review for Public Works Lead Worker Tom Smith. Approve Extension for Oneka Square for Preliminary Plat, Rezoning and PUD General Plan Staff has received a letter from Terry Thompson, a partner of the property owners FJT Properties, requesting an extension for rezoning, PUD general plan, and preliminary plat for Oneka Square. The retail building has not been constructed to date. The project was originally approved by the City Council on June 18, 2007. The City Council previously approved Minutes for the Hugo City Council Meeting June 21, 2010 Page 3 of 7 extensions for the project which expired June 15, 2010. The applicants requested another year extension for the project. Adoption of the Consent Agenda approved an extension for one year, to expire June 21, 2011, for Oneka Square rezoning, PUD general plan, and preliminary plat. Approve Pay Request No. 2 from Arnt Construction for South Egg Lake Street Reconstruction Proiect City staff has received Pay Request No. 2 from Arnt Construction for work completed to date on the South Egg Lake Street Reconstruction Project. Senior Engineering Technician Steve Duff has reviewed the pay request and found it to be satisfactory for work completed to date on the project. Adoption of the Consent Agenda approved Pay Request No. 2 from Arnt Construction for work completed to date on the South Egg Lake Reconstruction Project in the amount of $90,851.15. Approve Pay Request No. 2 from Renner Construction for Construction of Well No. 6 City staff has received Pay Request No. 2 from Renner Construction for work completed to date on the construction of Well No. 6 located near the intersection of TH61 and 125th Street. Senior Engineering Technician Steve Duff and City Engineer Jay Kennedy have reviewed the pay request and found it to be satisfactory for work completed to date on the project. Adoption of the Consent Agenda approved Pay Request No. 2 from Renner Construction for work completed to date on the construction of Well No. 6 in the amount of $19,648.09. Approve Lawful Gambling Permit for Sergeant Joe Bergeron Fundraiser on Friday, June 25, 2010 at the Hugo American Legion The City of Hugo has received a lawful gambling permit from the Hugo American Legion and a number of local volunteers who are preparing for the Sergeant Joe Bergeron Fundraiser, which will be held on Friday, June 25, 2010 at the Hugo American Legion. As Council is aware, Sergeant Joe Bergeron, Hugo resident and Maplewood Police Officer, was killed in the line of duty on Saturday, May 1, 2010. The volunteers would like to hold a silent auction along with a number of raffles to raise money for the family of Sergeant Joe Bergeron. Adoption of the Consent Agenda approved the Lawful Gambling Permit for the Sergeant Joe Bergeron Fundraiser to be held at the Hugo American Legion on Friday, June 25, 2010. The public is invited to attend this event. Approve Rezoning and Preliminary Plat for Prairie Village — Pratt Councilmember Haas removed this item from the Consent Agenda. Community Development Director Bryan Bear presented to Council an application from Pratt Development to rezone 40 acres from Future Urban Service (FUS) to Single Family Detached Residential (R-3) and two existing outlots in Heritage Ponds from Planned Unit Development (PUD) to Single Family Detached Residential (R-3). Both rezoning requests are consistent with the land use plan. The applicant also requested preliminary plat approval for 79 lots and 5 outlots on 40.59 acres to be known as "Prairie Village". At its June 10, 2010 meeting the Planning Commission held a public hearing and considered the requests. There was no one that spoke on the application besides the applicant. The Planning Commission unanimously recommended approval of the rezoning and Minutes for the Hugo City Council Meeting June 21, 2010 Page 4 of 7 preliminary plat to the City Council. Developers Len Pratt and Dave Hempel were present, and Councilmember Chuck Haas asked them about the changing pattern in development from a few years ago. Pratt addressed the Council saying they are not putting in more lots than what will be used, and these are larger conventional lots. Len described it as "the new beginning of normal" and said the homes in the first phase of the development would be built by Ben Minke, a single- family home builder, who built over 100 homes last year, mostly in Blaine. The Council asked Len Pratt to encourage Ben Minke to attend an Economic Development Authority meeting and Business Networking International meeting so he could be welcomed into the community. Haas made motin, Weidt seconded, to approve RESOLUTION 2010-23 APPROVING A PRELIMINARY PLAT AND REZONING FOR PRATT DEVLEOPMENT FOR "PRAIRIE VILLAGE" LOCATED NORTH OF 158TH STREET AND WEST OF ONEKA PARKWAY and. ORDINANCE 2010- 447 AMENDING CHAPTER 90 (ZONING AND LAND USE) OF THE CITY CODE TO CLASSIFY CERTAIN LAND LOCATED NORTH OF 158TH STREET AND WEST OF ONEKA PARKWAY All Ayes. Motion carried. Approve Purchase Agreement with FBF, LLC for City -Owned Property on TH61 Next to Egg Lake Councilmember Haas removed this item from the Consent Agenda. Over the past couple month's staff has been working with Mark Finnemann, Richard Fischer, and Mike Brass on a purchase agreement for the city -owned property in the downtown area. The EDA and City Council have been presented with the concept plans in the past and generally liked their ideas for the property. The purchase agreement is for 2.52 acres for a total of $770,200. Councilmember Haas said he was pleased to see something happening with the property. Community Development Director Bryan Bear explained that the purchase price may be reduced at the discretion of the City Council for building architecture, building plans, site plan, and use of the property. Alternatively, at the City Councils discretion, TIF may be offered to defray the development costs. The purchase agreement allows the buyer to market the property for one year and is contingent upon the City and buyer entering into a development agreement. The purchase agreement requires the City to complete an ALTA survey and provide title evidence. The EDA considered the purchase agreement at its meeting on Monday, June 14, 2010 and recommended approval of the agreement to the City Council. Haas made motion, Klein seconded, to approve the purchase agreement with FBF, LLC for City - owned property on TH61 next to Egg Lake. Ayes: Haas, Weidt, Klein, Miron Nays: None Motion carried. Minutes for the Hugo City Council Meeting June 21, 2010 Page 5 of 7 Approve Atkinson Mining Permit Councilmember Haas removed this item from the Consent Agenda. The City received an application from the Atkinson family for renewal of their mining permit. The Atkinsons have maintained a gravel pit in the City of Hugo for more than 40 years, where it mines gravel for use on its various excavating projects. Part of the requirement of the mining permit is for the Atkinsons to biannually make a formal request to the City for approval of its mining permit. Community Development Director Bryan Bear has reviewed the mining operation and found little use the Atkinson Gravel Pit over the past two years. Councilmember Haas had concerns that the permit being renewed was initially issued in 1991 and it did not clearly spell out standards. He stated that the permit required the City to be notified biannually as to what has been removed from the site, and there should be conditions added to the permit specifying activities that were allowed on the site. Mayor Fran Miron said that those mining the property were also owners of the property and had a vested interest in it. The stockpiles on the property were used for the owner's construction projects and there has been no deep mining in the area. Haas made motion, Miron seconded, to approve the Atkinson Mining Permit for a two year period, which would expire on July 1, 2012, and to notify the Atkinsons that they would have to comply with all condition of the permit, including a reclamation plan, at the public hearing to be held at the time of their next renewal. Approve Resolution Accepting Donation from Hugo Lions Club and Discussion on Improvements in Lions Park At is May 17, 2010 meeting, the City Council listened to a presentation from Parks Planner Shayla Syverson, and Parks and Recreation Commission Chair Jim Taylor on a recommendation from the Parks, Recreation and Open Space Commission to build a skate park and make improvements to the existing tennis courts in Lions Park. Direction was given to staff to proceed with planning a skate park and improvements and to involve the Hugo Lions Club. Since that time, the Hugo Lions Club has agreed to make a donation of up to $10,000 to the City of Hugo, which would go towards expanding the development plan. With the Lions Club's input, the Parks Commission is recommending a development plan that includes resurfacing all of the existing tennis court area for tennis, half -court basketball and four square. Parks Planner Shayla Syverson presented this plan to the Council, which includes a skate park located to the immediate west of the existing tennis courts on a new concrete slab with a new extension to the existing fence. The proposed budget for the project would be $75,000 plus up to $10,000 from the Lions Club, and would include site work, skate park equipment, and other equipment such as net, hoops and benches. Brady Peterson, youth spokesperson for the skate park, described the features that he liked in the proposed park and said it was nice of the Lions to contribute $10,000 towards the project. Shayla explained the final Lions Park Improvement Plan and Budget will be brought to the City Council after the Parks Commission neighborhood meeting to be held on July 14, 2010. Minutes for the Hugo City Council Meeting June 21, 2010 Page 6 of 7 Haas made motion, Wiedt seconded, to approve RESOLUTION NO 2010-24 ACCEPTING THE DONATION FROM THE HUGO LIONS CLUB. Ayes: Weidt, Klein, Haas, Miron Nays: None Motion carried. Discussion on Approval of Grant Application to the Minnesota DNR for Community Conservation Assistance Grant At the City Council meeting of March 15, 2010 the City of Hugo 2030 Comprehensive Plan was approved. The Metropolitan Council recommended that a study be done of eastern Hugo to determine what areas of the City should ultimately be served by the regional sewer system. The City Engineer prepared a project scope for creating a GIS -based model that identifies the quantity, quality and location of natural resources or areas that should be conserved rather than developed. City staff has asked the Washington Conservation District and the Metropolitan Council to partner with the City in the study. Parks Planner Shayla Syverson explained that the study is eligible for funding through the Minnesota DNR Community Conservation Assistance Program. The cost of the project is $22,500. City staff recommended applying for $16,875 in funding from the Community Conservation Assistance Program, to be matched in the amount of $5,625 by local cash or in-kind services for conducting a study of eastern Hugo. Council discussed the other entities that would benefit from this project and the need to seek funding from other sources like the Metropolitan Council and Minnesota DNR. Haas made motion, Weidt seconded, to approve RESOLUTION NO 2010-25 SUPPORTING APPLICATION FOR FUNDING FROM THE COMMUNITY CONSERVATION ASSISTANCE PROGRAM. Schedule Date in August for Mid -Year Budget Review Meeting Annually, the City Council schedules a mid -year budget review in order to allow the Council to accept information from the Finance Department regarding the City's year-to-date finances as well as to review some target objections for the next year's budget. Finance Director Ron Otkin recommended Council schedule a date in early August on which to hear information from the Finance Department on year-to-date finance projections as well as target objections for preparation of the City's 2011 City budget. Weidt made motion, Haas seconded, to schedule the Mid -Year Budget Review meeting for August 11, 2010 at 8:00 a.m. at Hugo City Hall. All Ayes. Motion carried. Minutes for the Hugo City Council Meeting June 21, 2010 Page 7 of 7 James Trudeau Law Enforcement Award Councilmember Chuck Haas added this item to the agenda. Haas informed the Council and the audience that the Lakes Area Youth Service Bureau is pleased to announce that Deputy Chris Majeski has been chosen to receive the James Trudeau Law Enforcement Award for 2009. Majeaski is a former Hugo Deputy and currently serves the Scandia area. This award is given annually to a law enforcement officer for exemplary service to local youth, and this is the second year in a row a Washington County Sheriff Deputy has won the award.
