HomeMy WebLinkAbout2010.11.01 CC MinutesMINUTES FOR THE CITY COUNCIL MEETING ON MONDAY, NOVEMBER 1, 2010 Mayor Fran Miron called the meeting to order at 7:05 p.m. PRESENT: Haas, Klein, Petryk, Weidt, Miron ABSENT: None ALSO PRESENT: Community Development Director Bryan Bear, Finance Director Ron Otkin, City Engineer Jay Kennedy, City Attorney Dave Snyder, Parks Planner Shayla Syverson, Community Development Assistant Dennis Fields, and City Clerk Michele Lindau Moment of Silence for Ery Atkinson Mayor Fran Miron called for a moment of silence for the father-in-law of City Administrator Mike Ericson, Ery Atkinson, who passed away on October 28, 2010 after battling brain cancer. Ervin lived in Waverly, MN with his wife Marilyn and is survived by four children and twelve grandchildren. Ervin was 72 years old. Approval of Minutes for the Glamos Ribbon Cutting on October 15, 2010 Weidt made motion, Petryk seconded, to approve the minutes for the Ribbon Cutting Ceremony for Glamos Wire held at 5564 152nd Street North for their new office/warehouse addition on October 15, 2010 as presented. All Ayes. Motion carried. Approval of Minutes for City Council Meeting on October 18, 2010 Weidt made motion, Klein seconded, to approve the minutes for the October 18, 2010 meeting as presented. Approval of Minutes for the City Hall/Lions Park Neighborhood Meeting October 25, 2010 Weidt made motion, Petryk seconded, to approve the minutes for the October 25, 2010 City Hall/Lions Park Neighborhood meeting held at Hugo City Hall to discuss a potential road improvement project as presented. All Ayes. Motion carried. Approval of the Agenda Miron made motion, Haas seconded, to approve the agenda as amended: Add to Administrative Presentations -Announcement of RCWD Public Hearing on November 8, 2010 Add to Council Presentations - Report from Metropolitan Council Water Supply Review Board Report on Installation Ceremony of MN's 30th Adjutant General All Ayes. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 2 of 8 Wall Street Journal Article on Washington County Library Kiosk at Hugo City Hall At its February 1, 2010 meeting, the City Council approved a Joint Powers Agreement with Washington County for an Electronic Branch Library at Hugo City Hall, which was made possible with a Library Services and Technology Act Federal Grant. A Ribbon Cutting Ceremony was held on July 29, 2010 to celebrate the opening of the Kiosk, which allows anybody with a library card to access the library's collections and databases. Requested books are delivered and held for pickup in lockers outside the building. Recently, an article was published in the Wall Street Journal acknowledging the Library Express Kiosk at Hugo City Hall, and staff presented Council with a clip that had appeared on KARE 11 News explaining how the Library Express has made the library more convenient. Approval of the Consent Agenda Weidt made motion, Klein seconded, to approve the following Consent Agenda: Approval of Claims Approve Auto Dismantling License for Hugo Auto & Truck Parts Approve Exempt Permit for Lawful Gambling for Jason Haraldson Benefit on January 15, 2011 at Hugo American Legion All Ayes. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Auto Dismantling License for Hugo Auto & Truck Parts The City of Hugo has received an application for the bi-annual Auto Dismantling License from Mike Brandt, dba Hugo Auto and Truck Parts. As a requirement of the license, City staff makes an annual inspection of the auto dismantling company for compliance with city, county, and state code. On October 14, 2010, Hugo City staff completed an inspection of Hugo Auto and Truck Parts and found it to be in compliance with City Code as well as County regulations. Adoption of the Consent Agenda approved the bi-annual Auto Dismantling License for Hugo Auto Parts and owner Mike Brandt, which will expire in 2012. Approve Exempt Permit for Lawful Gambling for Jason Haraldson Benefit on January 15, 2011 at Hugo American Legion The City has received an application from Hugo American Legion Auxiliary for a MN Lawful Gambling Exempt Permit for a benefit to be held for Jason Haraldson, who was struck head on by a drunk driver driving the wrong way on 1-3 5E on August 19, 2010. The benefit will be held on January 15, 2011 at the Hugo American Legion and will include a raffle as well as food and music. Adoption of the Consent Agenda approved the Lawful Gambling Exempt Permit for Hugo American Legion Auxiliary to conduct a raffle at the Jason Haraldson Benefit on January 15, 2011 at the Hugo American Legion. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 3 of 8 South Ethan Avenue Neighborhood Street and Utility Improvement Project At its October 4, 2010 meeting, the City Council approved a resolution to schedule a public hearing on November 1, 2010 to consider the South Ethan Avenue Street and Utility Improvement Project. These improvements include complete roadway reconstruction, storm water drainage, sanitary sewer and water installation, and appurtenant work at a total estimated cost of $1,163,186. City Engineer Jay Kennedy provided a brief overview of the project, and Mayor Miron opened the public hearing. Much of the discussion focused on traffic calming options and whether the road should be 24 feet or 26 feet wide.. Edward Barrett, 12071 Everton Avenue North, talked about the sharp curve at the intersection of 120th Street and Everton Avenue. Rick Gwynn, 12277 Ethan Avenue North, who chaired the neighborhood committee, stated it was time for these improvements to be done, and reducing speed in the area was an important part of this project. Pat Higgins, 12145 Everton Avenue North, supported widening the road and said she did not know about right-of-way on the 120th Street curve. Sharon Schoeller, 12329 Ethan Avenue North, said she felt a wider road would encourage speeding. Denise Davis, 12049 Everton Avenue North, has property adjacent to 120th Street and requested she be kept informed on any plans for the area. Donna Engel, 12497 Ethan Avenue North, supported a 24 foot wide road. She questioned whether a deferment would stay in place in the case of a death if the surviving spouse was under the deferment age of 65. Finance Director Ron Otkin stated it would become due and payable; however, the spouse could ask for Council to recalculate the assessment. Howard Spizman, 12301 Ethan Avenue North, said he felt vehicles would travel faster on a wider road, and speeding occurred early in the morning and late afternoons. Dennis Dahlin, 12165 Everton Avenue North, was in favor of a wider road to give walkers and bikers more room. Rick Gwynn was not in favor of a 26 foot road because he would lose two feet of his front yard. Rick also talked about the cost of water installation and said he was told by a contractor that there was little difference in the cost of directional boring and open cut trenching. Dwight Harvey, 12471 Ethan Avenue North, was not in favor of a 26 foot road width, and he pointed out that the road to the north was 24 feet wide. Greg Steiner, 12255 Ethan Avenue North, was not in favor of the wider road. He stated that the Council should put high priority in reducing speed on the road, and he supported the electronic driver feedback signage. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 4 of 8 Doug Youel, 4749 122nd Avenue North, preferred a wider road and installation of a median to reduce speed; the need for a safer road was very important. David Hurry, 12357 Ethan Avenue North, was not in favor of more road width than was already there, and said the project shouldn't be done if it did not include measures to reduce speed. John Waller, 14010 Homestead Avenue North, stated that if the City was applying for funding from the Rice Creek Watershed District, it should be done early. Jeff Olson, 4693 Europa Trail North, said there should be walkway standards throughout all developments. There were no more comments, and Mayor Miron closed the public hearing. Petryk made motion, Weidt seconded, to approve RESOLUTION 2010 — 54 ORDERING IMPROVEMENT, AND ORDERING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE SOUTH ETHAN AVENUE ROADWAY, DRAINAGE, AND UTILITY IMPROVEMENTS, to include a 24 foot wide roadway, three-way stop at the intersection of 122nd and Everton Avenue, electronic driver feedback speed signs, and review of the 120th Street intersection. Ayes: Klein, Petryk, Haas, Weidt, Miron Nays: None Motion carried. Mayor Miron called for a short break. Discussion on Addition of New Washington County Sheriffs Deputy At its August 11, 2010 Mid -year Budget Review Meeting, Council discussed the application from the Washington County Sheriff's Department for a federal COPS grant as well as the police protection services. At its September 7, 2010 meeting, Council directed staff to send a letter to Washington County Sheriff Bill Hutton informing him the City has budgeted for additional public safety, and is open to discussions on the COPS grant and additional patrol officer staffing. Mayor Fran Miron, Councilmember Tom Weidt, and City Administrator Mike Ericson had met with Sheriff Bill Hutton and Commander Cheri Dexter on September 30, 2010 to discuss the grant and addition of a new deputy. Mayor Miron stated that, though they did not receive the COPS grant, the City appreciated the Sheriff's Department's support. Sheriff Hutton and Commander Dexter were present at the Council meeting and discussed with the Council the addition of a sergeant, which would provide a level of decision making that a deputy would not have. Haas made motion, Weidt seconded, to direct staff to notify the Washington County Sheriff's Department of their decision to add a sergeant/deputy as of January 1, 2011. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 5 of 8 Update on Dog Ordinance and Ordinance Review Committee The Hugo City Council discussed possible changes to the Animal Ordinance at their August 16, 2010 meeting. During the meeting, staff explained the need for changes regarding dog bites and dangerous dog designations. Council recommended that staff work with the Ordinance Review Committee and bring back recommended changes to the Council at a future meeting. Since that time, staff has held two meetings with the Ordinance Review Committee, and they have drafted a proposed ordinance for Council consideration. Community Development Assistant Dennis Fields presented the revised ordinance to the Council. Washington County Sheriff's Department Commander Dexter recommended changes be made to allow more time for the Department to make a dangerous dog or potentially dangerous dog determination, and Councilmember Haas requested changes be made to clearly identify penalties and procedures. Mayor Miron also asked staff to look at potential fees and the cost to the City. Miron made motion, Petryk seconded, to schedule a public hearing on the proposed Animal Ordinance and directed staff to work with Council on any concerns Council members have with the ordinance. Update on October 25, 2010 Lions Park/City Hall Neighborhood Meeting On October 25, 2010, a neighborhood meeting was held with residents located in the City Hall/Lions Park neighborhood to discuss the possibility of a street reconstruction project. Mayor Miron along with Council Members Petryk, Weidt, and Klein were in attendance along with city staff. City Engineer Jay Kennedy and Mayor Miron provided an update/summary of the meeting stating there was not a lot of interest from the neighbors on a street project, however there was interest in reconstruction of the sidewalk along 145th Street North. Miron made motion, Petryk seconded, to direct staff to provide a recommendation on reconstruction of the sidewalk along 145th Street North. All Ayes. Motion carried. Resolution Providing for Early Redemption of TIF Bonds In 2000, the City of Hugo issued $1,885,000 Taxable General Obligation Tax Increment Bonds. The proceeds were used to refinance temporary bonds issued three years earlier. These bonds were deemed taxable due to their private -activity nature and carried interest rates ranging from 6.8% to 7.6%. Finance Director Ron Otkin provided a brief overview of this item explaining the proceeds from the bond was used for development of the Bald Eagle Industrial Park. Although the bond maturity extends to 2018 the Finance Department reported that sufficient tax increments have been collected to allow for their prepayment on December 15, 2010. Paying off the TIF Bond would save $377,281 in future interest payments. This will assist the City in maintaining a flat tax rate and also benefit Washington County and the White Bear Lake Independent School District 624. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 6 of 8 Haas made motion, Petryk seconded, to approve RESOLUTION NO. 2010- 55 AUTHORIZING THE CALL OF THE OUTSTANDING TAXABLE GENERAL OBLIGATION TAX INCREMENT BONDS,SERIES 2000A and directed staff to send notice of this information to Washington County and the White Bear Lake School District. Ayes: Haas, Weidt, Klein, Petryk, Miron Nays: None Motion carried. Discussion on Auto Dismantling License for ARK The City of Hugo has received an application for the bi-annual Auto Dismantling License from Dan Stewart, dba Auto Recycling Kompany (ARK), which staff had found to be incomplete. As a requirement of the license, the City requires a complete application as well as compliance with City, County, and State code. The current Auto Dismantling License for ARK expires on November 3, 2010. On Friday, October 29, 2010 staff met with owner of ARK, Daniel Stewart and received the additional information required, which made the application complete. Miron made motion, Petryk seconded, to approve the bi-annual Auto Dismantling License for Auto Recycling Kompany, which will expire in 2012. All Ayes. Motion carried. Discussion on Dog Bite Appeal — Thomas Schwartz The City of Hugo received notice from the Washington County Sheriff's Department stating that they had labeled Thomas Schwartz' dog Mac as a potentially dangerous dog. The dog is a three year old male yellow lab that, according to the Police report on September 12, 2010, lunged at and punctured the leg of a resident who was walking by Mr. Schwartz's home located at 5980 Oneka Lake Boulevard. Staff had been in contact with the Deputy as well as the victim. Dog owner Tom Schwartz has appealed the potentially dangerous dog designation, and attended this meeting along with his brother and his father Marty Schwartz. Petryk made motion, Klein seconded, to treat Mac as a potentially dangerous dog until the appeal could again be considered after the revisions to the Animal Ordinance have been completed. Petryk withdrew the motion, and Klein withdrew the second. Petryk made motion, Weidt seconded, to remove the designation of Mac as a potentially dangerous dog. Ayes: Petryk, Weidt Nays: Klein, Haas, Miron Motion failed. Minutes for the Hugo City Council Meeting on November 1, 2010 Page 7 of 8 Petryk made motion, Klein seconded, to treat Mac as a potentially dangerous dog, requiring the dog be dept in a proper enclosure or on a three foot non -retractable leash, until the appeal could again be considered after the revisions to the Animal Ordinance have been completed. Discussion on Proposed Parks Ordinance Regulating Public Conduct Discussion on Proposed Tobacco Use/Smoking Policy Miron made motion, Haas seconded, to table the above two items due to the lack of time. Rice Creek Watershed District (RCWD) Public Hearing on November 8, 2010 Staff added this item to the agenda to inform Council that the RCWD will be holding a public hearing on Monday, November 8, 2010 at 6:00 p.m. at Hugo City Hall to consider removing or modifying the Judicial Ditch 2 sheetpile weir near Rice Lake. Mayor Fran Miron, on whose property the weir is located, removed himself from the discussion and turned the gavel over to Acting Mayor Becky Petryk. Petryk made motion, Weidt seconded, to direct City Attorney Dave Snyder and WSB Water Resource Engineer Pete Willenbring to attend the public hearing on Monday, November 8, 2010 to discuss the removal of the weir on Judicial Ditch #2, north of Rice Lake.
