Approve Charitable Gambling Permit for Hugo Business Association: Warm Hearts for Charity Wine Tasting Event on January 31, 2009 at the Hugo American Legion The Hugo Business Association has made application to the City of Hugo for a Charitable Gambling permit in order to conduct a raffle for its Warm Hearts for Charity Wine Tasting Event scheduled for Saturday, January 31, 2009 at the Hugo American Legion. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the Charitable Gambling Permit for the Hugo Business Association for its raffle as part of the Warm Hearts for Charity Wine Tasting Event scheduled for January 31, 2009. G.3 Approve Lot Split and PUD Amendment for Fable Hill — Pratt Homes The applicant is requesting a lot split for Lot 5, Block 5 of Fable Hill First Addition. The lot is currently 1.54 acres in size and is large compared to the other lots in the area. The lot is proposed to be split into two lots that would be .87 acres (parcel A) and .67 acres (parcel B) in size, which would be consistent with the lots in the area. The applicant is also requesting a Planned Unit Development (PUD) Amendment to allow 53 single family homes where 52 were previously approved. At their January 8, 2008 meeting the Planning Commission held a public hearing on the request. There was no one that spoke during the public hearing. The Planning Commission discussed the lot split and PUD amendment and agreed that the request was consistent with the plat for Fable Hill. Staff recommended approval of the request to the Planning Commission. The Planning Commission recommended approval of the lot split and PUD amendment to the City Council by a vote of 6-0. Adoption of the Consent Agenda approved RESOLUTION 2009-3 APPROVING A LOT SPLIT FOR BLOCK 5, LOT 5, FABLE HILL FIRST ADDITION AND A PUD AMENDMENT FOR FABLE HILL FIRST ADDTION Approve Individual Sewage Treatment Systems (ISTS) Agreement with Washington County The City of Hugo received notification from the Washington County Health Department that it would be making revisions to its contract agreement with cities it provides inspection services to for individual sewage treatment systems. The proposed revisions to the ISTS agreement have been reviewed by City staff and found to be satisfactory and recommended for approval. Adoption of the Consent Agenda approved the ISTS Agreement with Washington County to provide inspection services for individual septic systems in the rural area of Hugo. Approve MCMA Grant Application for Internship Prosect The City of Hugo received notification from the Minnesota City/County Management Association for grant applications for an intern opportunity for current and future graduate students to work on a collective number of projects that would provide the student with exposure to all facets of local government administration. Administrative Intern Shelly Clausen has prepared an application along with City staff to allow the City of Hugo to obtain the matching $5,000 grant from MCMA. Adoption of the Consent Agenda approved the grant application and letter of intent to the MCMA for its internship project which would allow the City of Hugo to cost share in getting a new intern. Hugo City Council Minutes for January 20, 2009 Page 3 of 7 Approve Rescheduling of February 16 Meeting to Tuesday, February 17 Due to Presidents Day Federal Holiday Annually, the Hugo City Council needs to reschedule its second meeting of February since it falls on the third Monday of the month, which is the Presidents Day Federal Holiday. Adoption of the Consent Agenda approved the rescheduling of the February 16, 2009 regular meeting to Tuesday, February 17, 2009 due to the Presidents Day Federal Holiday. Approve Rescheduling of January 19, 2009 EDA Meeting to January 26, 2009 As with the regular Hugo City Council meeting scheduled for the third Monday of January, which falls on the Martin Luther King Federal Holiday, the Hugo Economic Development Authority needs to reschedule its meeting to an different date. City staff has contacted the EDA Commission who has expressed their support for a Monday morning meeting on the fourth Monday of the month. Adoption of the Consent Agenda approved the rescheduling of the January 19, 2009 EDA meeting to Monday January 26, 2009 at 8:30 a.m. Approve Lawful Gambling Permit for Centennial Youth Hockey Association at the Blue Heron Grill The City of Hugo has received an application from the Centennial Youth Hockey Association for a Lawful Gambling Permit for its pull tab operation at the Blue Heron Grill. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the Lawful Gambling Permit for the Centennial Youth Hockey Association for its pull tab operation at the Blue Heron Grill. Approve Appointment of Mike Granger to the EDA In November, 2008, former EDA member Phil Klein was elected as Councilmember Ward 2. Councilmember Klein took office on January 5, 2009, and with his election to the Council, a vacancy was created on the Hugo Economic Development Authority (EDA). Former Councilmember Mike Granger has served in the past on the EDA as the Council Representative and has now applied to be appointed as a member of the EDA. Adoption of the Consent Agenda approved the appointment of Michael E. Granger to the EDA Commission to complete the term of Phil Klein to expire on December 31, 2009. Approve Appointment of Derek Larsen to the Parks Commission At its meeting on December 15, 2008 meeting, the Council authorized staff to advertise for the vacancy on the Parks, Recreation, and Open Space Commission which was created by the retirement of Pete Pedersen at the end of his term. Adoption of the Consent Agenda approved the appointment of Derek Larsen to the Parks, Recreation, and Open Space Commission for a three year term to expire on December 31, 2011. Approve Resolution Supporting the 34th Red Bull Infantry The City of Hugo was recently notified by the Washington County Board of Commissioners that the 34th Red Bull Infantry Division of the Minnesota National Guard will soon be deployed to Iraq. The Board requested the City of Hugo acknowledge the 34th Red Bull Infantry Division's call of duty to Iraq and let the soldiers know their service to our country is recognized and Hugo City Council Minutes for January 20, 2009 Page 4 of 7 appreciated. Adoption of the Consent Agenda approved RESOLUTION 2009-4 SUPPORTING THE 34TH RED BULL INFANTRY DIVISION AND STILLWATER-BASED 34TH MILITARY POLICE COMPANY OF THE MINNESOTA NATIONAL GUARD ON ITS DEPLOYMENT TO IRAQ Discussion on Exposed Building Foundations in Creekview Preserve At its December 1, 2008 meeting, the Hugo City Council discussed issues related to the two exposed foundations and a severely damaged home in the Creekview Preserve neighborhood, which was devastated by the May 25, 2008 Tornado disaster. Council had directed the two foundations to be capped by January 15, 2009 and for staff to work with the property owners on the other home that was severely damaged. Community Development Bryan Bear provided Council with an updated on the actions to date on those properties. The properties located at 15830 Farnham and 5051 159th Street were making significant progress. The home on Farnham was in the process of construction, and the home on 159th has only been constructed to the first floor elevation, but a building permit has been pulled to complete the entire home. The builder was communicating with the building department and indicated construction would resume in the spring. Staff has been in contact with the owner of the severely damaged home at 5581 Finley Bay which is foreclosure and every effort was being made to sell the property. The Mayor was pleased the owners were making progress, and he thanked staff for the update. Discussion on Snow Removal from Private and City Sidewalks and Trails On January 13, 2009, Councilmember Phil Klein contacted City Administrator Mike Ericson to inquire as to what the City policy is for the removal of snow on sidewalks and trails around Oneka Elementary School and the surrounding neighborhood. Public Works Director Scott Anderson explained the City did not currently have a policy regarding snow and ice removal on sidewalks and trails. The White Bear Lake School District provides snow removal services for the sidewalks and trail surrounding the Oneka Elementary Schools, and the Waters Edge and Heritage Ponds homeowner associations provide snow removal services for the sidewalks and trails in those neighborhoods. The Council discussed the potential cost to the City for employees and equipment to provide the service and the possibility of requiring future developments to include it as a responsibility of the homeowners' associations. Klein made motion, Petryk seconded, to direct staff to add this discussion to the 2009 Council Goal Setting Session agenda as well as prepare a cost estimate for equipment and man-hours that would be needed if the City provided this service. H.3 Discussion on Water Reuse and Stormwater CIP — WSB Water Resource Engineer Pete Willenbring The City Council has expressed an interest in developing regional projects that can actively use stormwater runoff for irrigation or other beneficial purposes. Projects such as these will help the City achieve it's water conservation goals, meet Rice Creek Watershed stormwater infiltration requirements associated with future development and re -development, and potentially address future Total Maximum Daily Load allocations associated with impairments to Hardwood Creek and Peltier/Centerville Lakes. Mr. Willenbring reviewed an approach that has been developed by City of Hugo and Rice Creek Watershed District (RCWD) staff that would facilitate the Hugo City Council Minutes for January 20, 2009 Page 5 of 7 development and funding of cost-effective regional projects that would be focused on meeting the objectives outlined above. This would include development of a stormwater reuse capital improvement plan as a cooperative project with the RCWD, who agreed to fund up to 75% for a joint study to address the new requirements using regional improvements. The entire cost of the study was estimated at $100,000. Finance Director Ron Otkin informed the Council the money was available in the Stormwater Utility Fund to pay for the City's share of the study, and this would be a worthwhile expenditure. Council discussed how a CIP would put the City of Hugo in a better position to capture some of the funds for improvements to water quality from the Outdoor Heritage Fund, which was created by the recent 3/8 -cent sales tax increase. Miron made motion, Petryk seconded, to direct staff to prepare a cost sharing agreement for this project, and to add it to a future agenda for approval. All Ayes. Motion carried. Approve Resolution for Improvements to 130th Street and Highway 61 Intersection and Schedule Date for Neighborhood Meeting for January 26 or February 9 At its January 5, 2009 meeting, the Hugo City Council listened to a presentation from City Engineer Jay Kennedy regarding the funding the MnDOT has agreed to provide for improvements to the intersection to 130th Street and TH61. Council directed the City Engineer to prepare a resolution of support for the project as well as a request to MnDOT for approval for a traffic control signal for the intersection. City Engineer Jay Kennedy provided Council with an update on work completed to date on the design of the project as well as issues related to the request to MnDOT for approval of a traffic control signal. The City has received a cooperative agreement award of $421,200 of MnDot funding for turn lane improvements, and additional costs beyond that would be $225,000 for a traffic signal and $250,000 for the railroad crossing signal. The Council discussed the need to begin discussions with MN Commercial Railroad and Wilson Tool to determine if they wanted to be a part of the solution. City Finance Director Ron Otkin cautioned against using Tax Increment Financing because of the uncertainty of the economy and of the industrial park. Fran made motion, Petryk seconded, to approve RESOLUTION 2009-5 REQUESTING APPROVAL OF A TRAFFIC SIGNAL BY MnDOT AT THE HIGHWAY 61/130TH STREET INTERSECTION, AND REQUESTING ADDITIONAL MnDOT FUNDING. Ayes: Petryk, Klein, Miron Nay: None Motion carried. Miron made motion, Klein seconded, to direct staff to begin discussions with interested parties, and to schedule February 9, 2009 as a meeting of the Council to allow attendance at the neighborhood meeting for residents around the 130th Street/TH61 intersection as well as that at 147 Street and TH61 All Ayes. Hugo City Council Minutes for January 20, 2009 Page 6 of 7 Discussion on Federal Economic Stimulus Plan President Barack Obama was sworn in as the 44th president on Tuesday, January 20, 2009. As part of his platform, President Obama has agreed to provide a Federal Economic Stimulus Plan for the United States Congress and the Senate to consider to move the United States out of the recession with funding for a large number shovel -ready public improvement projects. City Engineer Jay Kennedy discussed with Council how the intersection improvements to 1301 Street/TH61 and 140' Street/TH61 could be good candidates for the project, and he discussed the need to for a project memorandum which would address environmental type of concerns and cost up to $5,000 to complete. The Council was reluctant to spend the money in anticipation of funds becoming available with the Stimulus Plan, and the Mayor requested the Council be kept apprised on the issue. No formal action was taken. Resident Concerns Regarding New Well near Oneka Ridge Golf Course — John Arcand Resident John Arcand addressed the Council as a representative of the Oneka Ridge Golf Course. He had concerns about the new well and tower planned for property adjacent to the golf course and impacts it could have on the wells at the golf course. He stated he was not well informed and recently found out about the City's purchase of the property. City Engineer Jay Kennedy explained the site had soils and underground geology suitable for a well and tower. Mr. Arcand talked about the effect the White Bear Township tower had on the wells located on the golf course and stated they had to sink their wells deeper when the tower went up. Miron made motion, Petryk seconded, to direct staff to work with the Arcand family to identify the location and depth of the wells on the golf course property, and inquire with White Bear Township on their well and provide information indicating any impact on surrounding wells. Motion carried. 4th Annual Oneka PTA Gold Plate Dinner on February 6, 2009 On behalf of the Oneka PTA Committee, City Administrator Mike Ericson announced that tickets are still available for the 4th Annual Oneka PTA Gold Plate Dinner scheduled for Friday, February 6, 2009 at the Hugo American Legion. Individuals wishing to purchase tickets can contact Oneka Elementary School or the City of Hugo. Annual Warm Hearts for Charity Wine Tasting Event on January 31, 2009 On behalf of the Hugo Business Association, City Administrator Mike Ericson announced the 2"d Annual Warm Hearts for Charity Wine Tasting Event will be held on Saturday, January 31, 2009 at the Hugo American Legion. The event is free to the public with opportunities for wine tasting, silent auction, and raffle prizes. The public is invited to attend. Cancellation of Washington County League of Local Governments Meeting on January 26, 2009 At its January 5, 2009 meeting, the Hugo City Council scheduled a public meeting for Monday, January 26, 2009 for the Washington County League of Local Governments Meeting. Since then, City staff has been contacted by Washington County who announced that the event has been cancelled until further notice. All Ayes. Motion carried. Sledding Party at Oakshore Park on Saturday, February 7, 2009 The Grand Opening of Oakshore Park will be held on Saturday. February 7, 2009. The Hugo Parks and Recreation Commission is hosting a sledding parry from 2-4 p.m. Free hot chocolate and snacks will be provide, and the public is encouraged to attend. Petryk made motion, Klein seconded, to schedule the event as a public meeting to allow for Council attendance at the Oakshore Park Grand Opening on February 7, 2009, from 2-4 p.m. All Ayes.
