All Ayes. Motion carried. Approve Minutes for City Council meeting of April 20, 2009 Haas made motion, Petryk seconded, to approve the minutes for the April 20, 2009 meeting as presented. All Ayes. Motion carried Approve Minutes for Board of Equalization Meeting on April 23, 2009 Weidt made motion, Klein seconded, to approve the minutes for the April 23, 2009 Board of Equalization meeting as presented. Hugo City Council Meeting May 4, 2009 Page 2 of 9 Presentation of White Bear Area Chamber of Commerce 2009 Company of Excellence Award to City of Hugo for Emergency Response to the May 25, 2008 Tornado Disaster At its April 27, 2009 business awards annual meeting, the White Bear Area Chamber of Commerce recognized a number of local businesses and business leaders for service to the Chamber and service to the community. The City of Hugo was recognized as the Chamber's 2009 Company of Excellence Award for the City of Hugo's response to the May 25, 2008 tornado disaster. City officials from the City of Hugo were in attendance and Mayor Fran Miron accepted the award on behalf of the citizens of the City of Hugo and offered his thanks and appreciation to the Chamber and its members for all of their help. Mayor Fran Miron said it was an honor to receive the recognition but there were many who played a role in the emergency response, and he thanked all those involved. Presentation of APWA 2009 Exceptional Performance Award to Hugo Public Works Department for Emergency Response to the May 25, 2008 Tornado Disaster The City of Hugo has received notification from the American Public Works Association that the Hugo Public Works Department will receive the 2009 APWA Exceptional Performance Award at the National APWA Conference in September in Columbus, Ohio. Public Works Director Scott Anderson and former Public Works Director Chris Petree were unable to attend this Council meeting. Haas made motion, Petryk seconded, to table this item until the May 18, 2009 meeting in hopes that Public Works Director Scott Anderson and former director Chris Petree will be able to attend. Presentation of 2008 City of Hugo Annual Report - Washington County Sheriff Bill Hutton Sheriff Bill Hutton from the Washington County Sheriff's Office presented the 2008 City of Hugo Annual Report to the Council. He recognized his 911 Dispatch Department, who recently received a national recognition award, and Commander Mary Stutz and four other deputies who were in attendance at the meeting. Sheriff Hutton shared a PowerPoint presentation with an overview of the organization, accomplishments of the department, significant events of 2008, and current projects the department was working on including the 800 MHz system. The Sheriffs Department, as well as Council, is pleased with the successful attainment of the COPS Grant, which will provide funding for an additional deputy for the City of Hugo for the next three years. Mayor Fran Miron said he appreciated the continued service and the excellent group of deputies Washington County Sheriffs Department provides the City of Hugo. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Hire of Shayla Severson as the Economic Development/Parks Department Intern At its March 16, 2009 meeting, the Hugo City Council authorized staff to advertise for the new intern position which would work with the Economic Development Authority on its Business Retention and Expansion Program as well as the Parks and Recreation Commission and its parks/recreation programming subcommittee. The City of Hugo received a total of 12 applicants, and interviews were conducted of ten applicants for first-round interview and four second round interviews which were completed on Thursday, April 23, 2009. Adoption of the Consent Agenda appointed Shayla Syverson as the new Economic Development/Parks Department Intern for a six-month internship beginning Monday, May 11, 2009 at an hourly rate of $10.00 per hour. Hugo City Council Meeting May 4, 2009 Page 4 of 9 Approve Sale of Hugo Fire Department's Portable Radios to St. Joseph, WI At it's April 20, 2009 meeting, the Hugo City Council authorized the Hugo Fire Department to advertise for the sale of the 14 portable radios from the Hugo Fire Department which have been replaced by the 800 MHz communication system. Deputy Fire Chief Jadon 011ila is pleased to report that the City of Hugo has found a municipality in the state of Wisconsin which will purchase the radios. Adoption of the Consent Agenda approved the sale of the Hugo Fire Department's 14 portable radios to the St. Joseph, WI Fire Department in the amount of $1,500. Approve Temporary On -Sale Liquor License for Hugo Lions Club for the Wilson Tool Picnic on August 8, 2009 City staff has received an application from the Hugo Lions Club for a temporary On -Sale Liquor License to dispense beer at the Wilson Tool Annual Employee Picnic on Saturday, August 8, 2009. City staff has reviewed the application and found it to be satisfactory complete with the City of Hugo named as an additional insured on the liquor liability insurance. Adoption of the Consent Agenda approved the issuance of a temporary On -Sale Liquor License for the Hugo Lions Club for the Wilson Tool Annual Employee Picnic on August 8, 2009. Approve Hiring of Marc Smith and Ryan Thompson as Public Works Seasonal Workers At its April 20, 2009 meeting, the Hugo City Council authorized Public Works Director Scott Anderson to advertise for the hiring of five Seasonal Public Works Maintenance Workers. As Council is aware, Public Works Director Scott Anderson announced that three summer seasonal employees would be returning from 2008 and that two new employees would be hired. The interviews were conducted of applicants for the two positions. Adoption of the Consent Agenda approved the hiring of Marc Smith and Ryan Thompson as new Public Works Seasonal Maintenance Workers at an hourly rate of $11.00 an hour. Approve Annual Performance Review for Building Official John Benson John Benson was hired by the City of Hugo on May 9, 1988 as the City's Building Inspector. For the past 21 years, John has worked as the City Building Inspector, Building Official, and Code Enforcement Official. John's loyalty and dedication to the City of Hugo is recognized and respected. John demonstrates an excellent work ethic and leadership skills in managing the City's Building Department which saw some significant challenges in 2008 due to the May 25 , 2008 tornado disaster. John leads by example whether or not its completing inspections in the field, code enforcement activities in the field, or front counter receptionist duties as needed. He has excellent communication skills and a good sense of humor in dealing with both contractors and residents. Hugo City Council Meeting May 4, 2009 Page 5 of 9 Approve Annual Performance Review for Community Development Director Bryan Bear Bryan Bear was hired by the City of Hugo on May 3, 2004 as the City's new Community Development Director. Bryan demonstrates an excellent work ethic and outstanding level of professionalism as the City's Community Development Director responsible for all economic development and community development activities in the City of Hugo. Bryan's dedication and commitment to ensuring quality development is well known and respected by the developers in the City of Hugo. Bryan's communication skills are excellent, and his honesty and integrity has earned him the respect of the many residents he has dealt with over the past year with the City's 2008 Comprehensive Plan. Bryan has a calm demeanor which allows him to communicate with residents and developers in a clear and concise manner. Adoption of the Consent Agenda approved the annual performance review for Community Development Director Bryan Bear. Approve Renewal of 2:00 a.m. Closing Time for Blue Heron Grill, Inc. Blue Heron Grill, Inc. 14725 Victor Hugo Boulevard North, has applied to the City for renewal of its 2:00 a.m. closing time. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the application for a 2:00 a.m. closing time for Blue Heron Grill. Approve Probationary Period for Accounting Clerk Anna Wobse and Appointment as a Regular Employee Anna Wobse was hired by the City of Hugo on October 28, 2008 as the City's new Accounting Clerk. Anna demonstrates an excellent work ethic and is a quick study with the City's fund accounting software and chart of accounts. Anna is a dedicated employee who is always on time, works hard, and has a pleasant demeanor. Under Finance Director Ron Otkin's tutelage, Anna has quickly become a valued member of the Finance Department completing all accounts payable duties and the City's payroll. The City is fortunate to have a conscientious and dedicated finance employee like Anna. Adoption of the Consent Agenda approved the appointment of Anna Wobse as a regular employee of the City of Hugo. Approve Water Surface Use Permit for Round Lake - Mike Ball On behalf of residents living on Round Lake, resident Mike Ball has made application to the City of Hugo for a water surface use permit to allow residents to water ski on the slalom course on the Lake. Washington County Sheriff's Department has provided the City with a new application form that has been completed by Mike Ball on behalf of the residents on Round Lake. Adoption of the Consent Agenda approved the application for a water surface use permit for water skiing on the slalom course on Round Lake. Approve Lease Agreement with Hugo Good Neighbors Food Shelf At its April 6, 2009 meeting, the Hugo City Council directed City staff to prepare a lease agreement with the new Hugo Food Shelf for the reuse of the former youth garage in which the new food shelf will conduct its operations. City staff has prepared a standard lease agreement at Hugo City Council Meeting May 4, 2009 Page 6 of 9 the direction of City Attorney David K. Snyder and presented it for review and consideration by the Hugo City Council. Adoption of the Consent Agenda approved the lease agreement with the Hugo Good Neighbors Food Shelf for the reuse of the former youth garage located at 5524 Upper 146th Street North. Approve Recommendation from Parks and Recreation Commission for New Parks Memorial Policy Recently, the City of Hugo Parks Commission received an informal request by a resident who is interested in donating a park bench memorial to the City in memory of a deceased relative. At this time, there is no formal process in place to handle this type of request. The Parks Commission and City staff have developed a "Parks Memorial Policy" for Council consideration. Adoption of the Consent Agenda approved the "Parks Memorial Policy". Approve Pay Request No. 1 from Arcon Construction for Work Completed to Date on the 2009 Street Reconstruction Proiect The City of Hugo has received Pay Request No. 1 from Arcon Construction for work completed to date on the 2009 Street Reconstruction Project. Senior Engineering Technician Steve Duff has reviewed the pay request and found it to be satisfactory for work completed on the project. Adoption of the Consent Agenda approved Pay Request No. 1 in an amount of $120,082.84 for work completed to date on the 2009 Street Reconstruction Project. Approve 3.2 Beer and Wine On -Sale License for Sertinos Cafe The City of Hugo has received an application from Sertinos Cafe and owner Mickey Michlitsch for approval of a 3.2 Beer and Wine On -Sale License in order to better market with other restaurants in the City of Hugo which sell liquor. City staff has reviewed the application and found it to be satisfactory complete along with the necessary liquor liability insurance required by the State of Minnesota. Adoption of the Consent Agenda approved the 3.2 Beer and Wine On -Sale licenses for Sertinos Cafe and owner Mickey Mischlitsch. Update on TH61 and 1301h Street Intersection Improvements City Engineer Jay Kennedy has been meeting with MnDot officials to discuss the installation of a traffic signal at the intersection of TH61 and 130th Street. City Engineer Jay Kennedy provided Council with an update on the progress. MnDot will approve the installation of the signal contingent on exclusive right turn lanes on 130th Street in both directions. Traffic signal improvements could be constructed without adding additional permanent right-of-way. This would add $75,000 - $100,000 to the project cost for the intersection but would still be less than the fully funded project that included improvements to the railroad crossing, which would not be necessary. City Engineer Jay Kennedy explained the next steps would be to respond to MnDot on the City's intent and to revise the construction plans to include the traffic control signal.. The Council appreciated WSB's persistence on this matter and thanked City Engineer Jay Kennedy for his work.. Hugo City Council Meeting May 4, 2009 Page 7 of 9 Weidt made motion, Klein seconded, to direct staff to contact MnDot and advise them the City wants to move forward with the project, and to revise the plans to install a traffic signal. All Ayes. Motion carried. John Arcand John Arcand, 5510 130th Street North, requested to be added to this agenda. John stated that he was not happy with the fire department and the way he was recently treated by them and City staff regarding a request to burn on the golf course property. Discussion on Good Times Flea Market City Administrator Mike Ericson added this item to the agenda. Jared Culp and Jonathan P. Glassel appeared before the EDA on April 20, 2009 with a plan for the Good Times Flea Market to be held on weekends at the old Interstate Lumber site on the southwest corner of TH61 and 145th Street North owned by Pete Sampair. The members of the EDA said that if it was done properly, it could be well received by the community; however, the flea market use is not allowed by the zoning ordinance on that property. They directed Mr. Culp and Mr. Glassel to work with staff on issues including traffic and health and safety concerns prior to requesting approval of the flea market. Since then, an advertisement flyer was mailed by Jonathan Glassel indicating they would be opening the flea market on May 8, 2009. The Council was not pleased since no issues have been resolved as directed by the EDA and City Staff. Jonathan Glassel said he would address the issues in a separate letter, which Council indicated would not be necessary. Councilmember Klein was in support of eliminating the flea market altogether. Councilmember Petryk was concerned people would be showing up for it, and the suggestion was made to contact the Sheriff's Department if necessary. Councilmember Haas commented that they had made a bad first impression, and he and Councilmember Weidt agreed that staff should not spend unnecessary time trying to make the event happen. Haas made motion, Weidt seconded, to contact the property owner Pete Sampair and share with him the literature that had been sent out and the sentiments of the Council that the flea market not open as scheduled. Discussion on Water Usage and Rate Study Resident Joe Johnson, 5430 134th Street North, requested to be added to the agenda to discus public water conservation and Hugo's rate structure. Council directed staff to place this item on the May 18, 2009 agenda. Update on Rice Creek Watershed District Meeting on April 16, 2009 The Rice Creek Watershed District (RCWD) held a public hearing on April 16 2009 at 7 p.m. in the Hugo City Hall Council Chambers to discuss a proposed plan amendment to the Bald Eagle Lake Water Management District. The plan amendment offers an equitable and effective Hugo City Council Meeting May 4, 2009 Page 8 of 9 mechanism to collect revenues to implement the lake's management plan and other measures directed toward protecting and improving water quality in Bald Eagle Lake. This item was tabled at the City Council's April 20, 2009 meeting. Councilmember Becky Petryk attended the public hearing and provided Council with an update saying property owners had voluntarily petitioned and agreed to a special assessment for a plan that would improve water quality on Bald Eagle Lake. The meeting was well attended by residents. Report on Results of the Recent Budget Meeting Councilmember Chuck Haas requested this item be added to the agenda. On Tuesday, March 17, 2009, the Council held a special workshop where Council reviewed the state aids received by the City, how it impacted the budget, and what could be done if the City faced more cuts. City Administrator Mike Ericson stated it was not yet know what the City will or will not get in state aid due to the state legislature, which is scheduled to adjourn May 18, 2009. Councilmember Haas cautioned against making unnecessary expenditures. Staff will keep Council apprised on any decisions made by the state. Signup for Community Emergency Response Team (CERT) Training in Fall, 2009 Administrative Intern Shelly Clausen has been reviewing options of CERT training for emergency response with the City of Centerville's former Councilmember Michelle Laksow in the fall of 2009. This item was tabled at the April 20, 2009 meeting due to the lack of time. Dennis Walter, Volunteer Resource Coordinator from Homeland Security Emergency Management, attended this meeting and presented Council with a large framed collage of photos of activities during the cleanup after the May 25, 2008 tornado compiled by the Citizen Corps. Dennis thanked Hugo for letting CERT help Hugo recover after the storm. He explained that professional responders make up only one percent of the nations population, and CERT is a system to train and organize citizens to help others in the event of an emergency. Miron made motion, Weidt seconded, to direct staff to continue to work on developing a CERT program for Council consideration. All Ayes. Motion carried. Schedule Annual Performance Review for City Administrator Mike Ericson Mike Ericson was hired by the City of Hugo as its new City Administrator on April 17, 2000. Over the past nine years, the City of Hugo has conducted an annual performance review of the City Administrator with himself, Council, and City Attorney David Snyder. This item was tabled at the April 20, 2009 meeting due to the lack of time. Haas made motion, Petryk seconded, to schedule a special Council meeting for June 8, 2009 at 9:00 a.m. to hold the City Administrators annual performance review. All Ayes. Motion carried. Hugo City Council Meeting May 4, 2009 Page 9 of 9 Carnelian Marine -St. Croix Watershed District Accepting Applications for Advisory Board This item was tabled at the April 20, 2009 meeting due to the lack of time. City staff has received notification from Washington County that a term for a board member on the Carnelian - Marine -St. Croix Watershed District will be expiring in June. City Administrator Mike Ericson announced that if any residents are interested in the board position they should make application to the City of Hugo and/or Washington County. Vacancy on the Metropolitan Council Transportation Advisory Board (TAB) Metro Cities has notified the City of Hugo there is a vacancy on the TAB due to the recent appointment of TAB member Lakeville City Councilmember Wendy Wulff to the Metropolitan Council. Council discussed the need to have representation of the northeast suburbs. Councilmember Petryk was interested in serving on the TAB but was unsure if the TAB meeting schedule would permit her to do so. Miron made motion, Haas seconded, to accept Councilmember Petryk's offer to serve on the TAB if her schedule permitted it. All Ayes. Motion carried.
