All Ayes. Motion carried. White Bear Lake Seniors Age Wave Focus Group Meeting on September 22, 2009 Weidt made motion, Klein seconded, to approve the minutes for the White Bear Lake Seniors Age Wave Focus Group meeting held on September 22, 2009 in the Oneka Room as presented. All Ayes. Motion carried. Approval of the Agenda Miron made motion, Petryk seconded, to approved the agenda as amended. Add L.1 - Discussion on CSAH 14/8 and I-35 Interchange All Ayes. Motion carried. Award Sale of Bonds for Parkland - Paul Steinman, Sprinuted, Inc. At its September 8, 2009, meeting the Hugo City Council authorized the Finance Department and the City's financial advisors, Springsted, Inc., to arrange for the sale of $1,605,000 General Obligation Tax Abatement Bonds. The bonds proceeds will be used to acquire parkland and make improvements to Rice Lake Park. Bids were opened and tabulated at 10:30 a.m., Monday, October 5th. Paul Steinman of Springsted presented the bid tabulation to the City Council. There were four bids with the lowest bidder being Robert W. Baird & Company, Inc. with an interest rate of 2.3429 percent on General Obligation Bonds, Series 2009B. Paul explained this was a premium bid meaning the City received more than asked for. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Annual Performance Review for Public Works Worker Adam Greeder In 2007, Adam Greeder was hired by the City of Hugo as one of its summer seasonal maintenance workers in the Hugo Public Works Department. Adam worked hard and demonstrated an excellent work ethic in completion of the summer seasonal maintenance duties which included lawn mowing, weed whipping, trash removal, and a wide variety of maintenance duties. The City of Hugo created the Public Works Apprenticeship Program in 2006, and an opportunity was extended on October 6, 2008 for Adam to be part of the department as a full- time employee. Adam has now worked for the City for one year as a full-time apprentice for the Hugo City Council Minutes for October 5, 2009 Page 3 of 6 Public Works Maintenance Worker and has done an excellent job in learning all the duties and responsibilities of a Public Works Maintenance Worker. Adoption of the Consent Agenda approved the annual performance review for Public Works Worker Adam Greeder. Approve Resignation of Hugo Firefighter Tim Lorinser The City of Hugo has received a letter of resignation from Hugo Firefighter Tim Lorinser who is unable to continue his employment with the City of Hugo due to changes in his family life. Tim has been a part of the Hugo Fire Department since October 2003. Adoption of the Consent Agenda approved the resignation of Firefighter Tim Lorinser from the Hugo Fire Department and publicly thanked him for his six years of dedicated service to the citizens of Hugo. Approve Resignation of Hugo Firefighter Bryan Lund The City of Hugo has received a letter of resignation from Hugo Firefighter Bryan Lund who is unable to continue his employment with the City of Hugo due to changes in his family life. Bryan has been a part of the Hugo Fire Department since September 2001. Adoption of the Consent Agenda approved the resignation of Firefighter Bryan Lund from the Hugo Fire Department and publicly thanked him for his eight years of dedicated service to the citizens of Hugo. Approve Water Service Rates Schedule At is February 2, 2009 meeting, the Hugo City Council, in response to a new state statute requiring the use of water conservation rates, directed staff to review and recommend a residential water rate structure that 1) changes the first 15,000 gallons of residential water usage from a flat fee to a per unit cost, 2) applies the same methodology to the commercial/industrial rate structure, and 3) is revenue neutral. The Finance Department drafted a proposed rate schedule that met these criteria and submitted it to the Minnesota Department of Natural Resources for review and comment. On September 22, 2009, the city received confirmation from the DNR that this proposed rate schedule meets the requirement of a true conservation rate as established by state statutes. Adoption of the Consent Agenda approved the new water rate schedule. This rate structure will go into effect on January 1, 2010. Approve Resignation of Hugo Parks Commissioner Russ Schmidt The City of Hugo has received a letter of resignation from Hugo Parks Commissioner Russ Schmitt who will soon move out of the City of Hugo. Russ has been a dedicated and committed Commissioner on the Park and Recreation. Adoption of the Consent Agenda approved the resignation of Parks Commissioner Russ Schmidt and publicly thanked him for his two years of dedicated service. Approve Controlled Burn of the Hansen House by the Fire Department on October 24, 2009 At its August 3, 2009 meeting, the City Council unanimously voted to approve the purchase of the Hansen property including 125 acres, a house, and several outbuildings. Staff was directed to work with the Hugo Fire Department to inquire as to whether the house could be used by the Hugo City Council Minutes for October 5, 2009 Page 4 of 6 Hugo Fire Department for a fire training drill. Fire Chief Jim Compton and the officers from the department have reviewed the structure and determined that it is a usable structure for the fire training exercise which the department would like to hold at the end of October. Adoption of the Consent Agenda approved the controlled burn of the Hansen house located at 14420 Irish Avenue North on Saturday, October 24, 2009. Approve Gambling Permit for the White Bear Lake Hockey Association at American Legion on October 23, 2009 The City has received an application from the White Bear Lake Hockey Association to conduct lawful off-site gambling in the form of a raffle at the Hugo American Legion on Friday, October 23, 2009. City staff has reviewed this application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the application to conduct lawful off-site gambling at the Hugo American Legion on Friday, October 23, 2009 Approve Pay Request No. 6 from Arcon Construction for 2009 Street Improvement Project The City of Hugo has received Pay Request No. 6 from Arcon Construction for work completed to date on the 2009 street improvement project, which included City streets in and around the Hugo Elementary School neighborhood. Senior Engineering Technician Steve Duff has reviewed the pay request and found it to be satisfactory for work completed on the project. Adoption of the Consent Agenda approved Pay Request No. 6 in the amount of $125,330.45 for work completed to date on the 2009 street improvement project. Approve Revised City Floodplain Ordinance Over the last several years the City Council has been discussing the Floodplain ordinance revisions. The Council directed staff to submit the latest revised ordinance to the MN DNR for their comments. Since then staff has been working with the DNR to work through the discrepancies. On May 8, 2009 staff sent the revisions to the DNR for their review and approval. Staff received a letter on August 25, 2009 that the revisions were approved by the DNR and that they are consistent with the FEMA regulations for floodplain management. At its September 24, 2009, meeting the Planning Commission held a public hearing on the floodplain district ordinance amendments. At the meeting, staff made a presentation outlining the amendments to the City Code. There was no one that spoke at the public hearing on the amendments. The Planning Commission unanimously made a recommendation to the City Council to adopt the ordinance for the code amendments to be consistent with the DNR's floodplain regulations. ENVIRONMENTAL PROTECTION, SECTION 90-171, ARTICLE VI. PERFORMANCE STANDARDS, SECTIONS 90-211, 90- 227, 90-242, 90-243, AND ARTICLE VII. LAND DIVISION AND PLATTING, SECTION 90- 336. Hugo City Council Minutes for October 5, 2009 Page 5 of 6 Approve Variances for Dan and Ranell Tennyson at 12582 Ingersoll Avenue North Dan and Ranell Tennyson are requesting variances to allow the construction of a 1,152 square foot addition to their existing home located at 12582 Ingersoll Avenue North. The first variance request is to allow the addition to be built 36 feet from the front property line where 40 feet is required by ordinance. The second variance request is to allow the addition to be built 31 feet from the rear property line where 50 feet is required by ordinance. The final variance request is from the shoreland setback requirements to allow the addition to be 21 feet from the ordinary high water (OHW) mark of Sunset Lake where 100 feet is required. At its September 24, 2009, meeting the Board of Zoning held a public hearing on the variance requests. There was no one who spoke at the public hearing except the applicant. The Board asked questions about what the addition would include and the applicant stated that a portion of it would be an attached garage. The Board unanimously recommended to the City Council approval of the variance requests. Adoption of the Consent Agenda approved RESOLUTION 2009-34 APPROVING VARIANCES FOR DANIEL AND RANELL TENNYSON IN THE RURAL RESIDENTIAL ZONING DISTRICT ON PROPERTY LOCATED AT 12582 INGERSOLL AVENUE NORTH. Approve Revisions to Development Agreement for Inclusion of Safe Room Option At its September 24, 2009 meeting, the Hugo City Council listened to a presentation from Community Development Director Bryan Bear who shared with Council issues related to a request for the option for construction of safe rooms in homes. This request was from residents living in the Water's Edge neighborhood who experienced the May 25, 2008 tornado disaster. Council agreed that it should not mandate the construction of safe rooms but should include them as an option to be presented to new home owners. Council directed staff to prepare revisions to the City's standard development agreement for the inclusion of a safe room option. KSTP Channel 5 News Crew was in attendance along with Betty Zuettlel, 5164 1581 Street North, who initially brought this issue to Council. The Mayor and Community Development Director Bryan Bear provided a recap of previous discussions on safe rooms, and the Mayor thanked Betty for raising this issue to the Council. Adoption of the Consent Agenda approved revisions to the City of Hugo's standard development agreement for the inclusion of a safe room option with the construction of new homes in new developments. Approve Authorization to Hold Public Hearing on Ordinance for Interim Use Permits, Special Event Permits, Transient Merchants and Peddlers The City of Hugo has formed an Ordinance Review Committee (ORC) to update several areas of the Municipal Code. There are members of the Planning Commission and City Council on the ORC. On August 3, 2009, the City Council authorized staff to have the ORC review the interim use permits, special event permits, transient merchants, and peddlers ordinance. Over the past two months the ORC has been working on creating and updating the ordinances. Staff is looking for authorization from the Council to schedule a public hearing at the Planning Commission on the ordinances. Hugo City Council Minutes for October 5, 2009 Page 6 of 6 Schedule Date for Parks and Recreation Open House The Parks and Recreation Sub -Committee would like to hold an Open House to help inform the community of existing park and recreation opportunities that are available in Hugo. Also, the Open House will serve as a kick-off to the Community Growth Options project to gather citizen input on additional parks and recreation amenities the citizens of Hugo would like to see in the near future or long-term. The Sub -Committee recommended that a Parks and Recreation Open House be held on Tuesday, October 27th from 6 pm to Bpm in the Oneka Room. The Council talked about the Yellow Ribbon Task Force meeting that was scheduled for that night at 7:00 p.m. Weidt made motion, Klein seconded, to request the Parks and Recreation Commission schedule the Open House for a date in November. October 6, 2009 Emergency Preparedness Exhibit at the MN State Capitol Farmers Insurance will hold an Emergency Preparedness Exhibit on Tuesday, October 6, 2009 from 10 a.m. to 2 p.m. at the Minnesota State Capital. Mayor Fran Miron has agreed to speak at the press conference to be held at 10: 00 a.m. Following the press conference, there will be tours of the state-of-the-art mobile catastrophe center to learn about the latest in storm recovery technology for Minnesotans. A special invitation has been extended to the Mayor, Hugo City Council, City staff and Hugo residents to attend this event. This has been posted as a Council meeting to allow Council to attend this event. Discussion on CSAH14/8 and I-35 Interchange Mayor Fran Miron added this item to the agenda. Earlier this evening, the City of Lino Lakes City Council voted 5-0 to approve a Joint Powers Agreement with Anoka County for improvements at the CSAH14 and I -35E interchange. Mayor Miron stated this was a much needed transportation improvement. Adiournment Weidt made motion, Klein seconded, to adjourn at 7:29 p.m. All Ayes. Motion carried.
