All aye. Motion carried. Approval of Agenda Haas made motion, Puleo seconded, to approve the agenda for April 21, 2008 as presented. All aye. Motion carried. 2008 Hugo Kidz'n Biz Fest — Hugo Business Association/Hugo EDA/The Citizen On Sunday, April 6, 2008 the fourth annual Hugo Kidz'n Biz Fest was held at Oneka Elementary School. This event is co-sponsored by the Hugo Business Association and the Hugo Economic Development Authority and presented by The Citizen Newspaper. Its purpose is to connect the Hugo business community with the parents and children and families in a PTA carnival atmosphere, which allows the businesses to introduce themselves and market themselves directly to families. The 2008 event was a huge success with more than 1500 children, parents and volunteers in attendance as well as 42 businesses from the Hugo Business Association Many thanks went to the Hugo Kidz'n Biz Fest Committee, on which Katie Riopel, Janine Ketchel, Debi Johnson, Louis Melamed, Paula Romero, Shannon Devinny, and Nate Ehalt, Brian Denaway and Mike Ericson from the City of Hugo. With strong support from HBA President Phil Klein as well as the City's own Economic Development Authority, the event was publicized with much fanfare and hoopla with The Citizen Newspaper's Publisher Louis Melamed. Mayor Fran Miron was in attendance again as one of the chocolate chip cookie eating contest judges. He shared with Council, along with Council Member Chuck Hass who was also in attendance, the community spirit that was exhibited by Hugo residents and visitors last Sunday afternoon. Mayor Fran Miron publicly acknowledged the members of the Hugo Business Association, EDA, The Citizen, and the committee members, and thanked them for their volunteer work to make the City of Hugo a great place to live, work, shop, and play. Shannon Devinny, Phil Klein, and Louis Melamed thanked the Council and City staff for their work and support and thanked the many sponsors, especially WSB Engineering, that made the event possible. City Council Meeting of April 21, 2008 Page 2 of 7 Minnesota Severe Weather Awareness Week - April 21-25 and Tornado Drill on April 24th The City of Hugo has been notified by the American Red Cross that the State of Minnesota will observe Severe Weather Awareness Week from April 21 through April 25 with statewide tornado drills held on Thursday, April 24, 2008. The first drill will be at 1:45 p.m. and the second drill at 6:55 p.m. The tornado drills are designed and planned to allow families and business to understand the impact of severe weather and to prepare sheltering plans. Mayor Fran Miron emphasized the importance of being prepared for severe weather and encouraged all residents to participate in observation of Severe Weather Awareness Week April 21-25, 2008. Consent Agenda Haas made motion, Puleo seconded, to approve the following Consent Agenda: Approval of Claims Approve Extension on Filing of Minor Subdivision for Grover Storm at 8047 132nd Street Approve Temporary 3.2 Liquor License for Hugo Lions Club for Hugo Good Neighbor Days on June 5-8, 2008 Approve PUD and Preliminary Plat for Rottlund Homes for Victor Gardens North Village 5th Addition Approve Pay Request No. 6 from EnComm Midwest, Inc., for Work Completed on Well House No. 5 Approve Resignation of Administrative Intern Nate Ehalt Approve Lawful Gambling Permit for Centennial Youth Hockey Association at the Blue Heron Grill Approve Renewal of 2:00 a.m. Closing Time for Sal's Angus Grill at 12010 Keystone Avenue North Approval of Claims Adoption of the Consent Agenda approved the claims roster as presented Approve Extension on Filing of Minor Subdivision for Grover Storm at 8047 132"—d Street The City has received a request for a time extension on Grover A. Storm's Minor Subdivision located at 8047 132nd Street North. The Planning Commission considered Mr. Storm's request at their meeting of May 27, 1998, and recommended approval of the subdivision. The City Council then approved it at their meeting of June 1, 1998. Since Mr. Storm failed to pay the parkland dedication fee, the subdivision was not recorded, and his approval has expired. Mr. Storm claims that he was aware of the fee but he was unaware of the time restriction for recording the subdivision. He would now like to pay the park dedication fee, currently set at $2,400, and record the subdivision. Mr. Storm's request was approved by the Council, and met all zoning requirements in 1998. Adoption of the Consent Agenda approved the time extension and allow the minor subdivision to be recorded once Mr. Storm pays the $2,400 park dedication fee. City Council Meeting of April 21, 2008 Page 3 of 7 Approve Temporary 3.2 Liquor License for Hugo Lions Club for Hugo Good Neighbor Days on June 5-8, 2008 The City has received an application from the Hugo Lions Club for a temporary 3.2 liquor license in order for the Lions to sell 3.2 beer at Hugo Good Neighbor Days scheduled for June 5-8, 2008. City Staff has reviewed the application and found it to be satisfactorily complete with the submittal of the necessary liquor liability insurance coverage. Adoption of the Consent Agenda approved the temporary 3.2 license for the Hugo Lions so they can sell 3.2 beer at Hugo Good Neighbor Days on June 5-8, 2008. Approve PUD and Preliminary Plat for Rottlund Homes for Victor Gardens North Village 5t—" Addition The applicant is seeking approval of a PUD amendment and a preliminary plat for 72 townhome units. The applicant is proposing the modification in order to develop a different style of townhome than was previously approved. The change results in a reduction in the number of homes on this site from 104 units to 72 units. The Planning Commission reviewed the request at a public hearing on April 10th and voted unanimously to recommend approval of the request. Adoption of the Consent Agenda approved RESOLUTION 2008-12 APPROVING A PUD AMENDMENT FOR THE ROTTLUND COMPANY, INC. FOR "VICTOR GARDENS NORTH VILLAGE 5TH ADDITION" ON PROPERTY LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH and RESOUTION 2008-13 APPROVING PRELIMINARY PLAT FOR THE ROTTLUND COMPANY, INC. FOR "VICTOR GARDENS NORTH VILLAGE 5TH ADDITION" ON PROPERTY LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH. Approve Pay Request No. 6 from EnComm Midwest, Inc., for Work Completed on Well House No. 5 The City has received pay request No. 6 from EnComm Midwest, Inc., for work completed to date on the construction of Well House No. 5 . Public Works Director Chris Petree and City Engineer Jay Kennedy have reviewed the pay request and found it to be satisfactory for work completed to date on the new well house. Adoption of the Consent Agenda approved pay request No. 6 from EnComm Midwest, Inc., in the amount of $101,541.17 for work competed to date on construction of Well House No. 5. Approve Resignation of Administrative Intern Nate Ehalt Nate Ehalt was hired by the City of Hugo in March 2007 as the City's new administrative intern. For more than a year now, Nate has worked on a wide variety of City projects including back-to- back Hugo Kidz'n Biz Fest event as well as the City's recodification of the City's ordinances, and numerous special projects. The City of Hugo has benefited greatly because of Nate's willingness to contribute to the City's day-to-day operations as well as to gain valuable real life experiences in City administration work. Nate is scheduled to graduate in May, and he will be working hard to get his first real job. On behalf of the City staff and Commissions Nate has worked with, City Administrator Mike Ericson and Mayor Fran Miron thanked Nate for his dedicated service and contributions to the City of Hugo. Adoption of the Consent Agenda approved the resignation of Administrative Intern Nate Ehalt. City Council Meeting of April 21, 2008 Page 4 of 7 Approve Lawful Gambling Permit for Centennial Youth Hockey Association at the Blue Heron Grill The City received a charitable gambling license application from the Centennial Youth Hockey Association to be the charitable gambling provider for the Blue Heron Grill at 14725 Victor Hugo Boulevard North, which is scheduled to open in May, 2008. Gambling activities will include pull - tabs as well as bar bingo. City staff reviewed the license application and found it to be satisfactory complete. Adoption of the Consent Agenda approved the Lawful Gambling Permit for the Centennial Youth Hockey Association for charitable gambling at Blue Heron Grill, 14725 Victor Hugo Boulevard North. Approve Renewal of 2:00 a.m. Closing Time for Sails Angus Grill at 12010 Keystone Avenue North Sal's Angus Grill, 12010 Keystone Avenue North, has applied to the City for renewal of its 2:00 am closing time. City staff has reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the application for a 2:00 a.m. closing time for Sal's Angus Grill. Update on April 14th Neighborhood Meeting for Street Improvement Project On Monday, April 14, 2008, City staff held a neighborhood meeting with residents in the Hugo Elementary School neighborhood to discuss their street improvement project. Mayor Fran Miron and Council Member Frank Puleo were in attendance along with City Engineer Jay Kennedy, Public Works Director Chris Petree, and Senior Engineer Technician Scott Anderson. City Engineer Jay Kennedy provided Council with an overview of the neighborhood meeting where the neighbors had shown support for the road project. Jay explained he would be presenting the feasibility study to the Council at their May 19, 2008 meeting, and a public hearing would be held on June 17, 2008. Discussion on Joint Powers Agreement for Maintenance of Goodview Avenue South Into City of Grant Over the past several months, City staff along with Mayor Miron and Council Member Haas have worked with White Bear Township, the City of Grant, and Washington County to develop a joint powers agreement (JPA) for the maintenance and ultimate paving of Goodview Avenue North. City Engineer Jay Kennedy provided background to the Council on the meetings held between the City of Hugo, Grant, White Bear Township, and Washington County. He explained the JPA was drafted by the City of Hugo and staff was seeking Council approval before presenting it to the other parties. Jay discussed with the Council the JPA and the obligations of the participating communities. The JPA would provide for the maintenance of Goodview Avenue with assistance from White Bear Township until the time the road is paved. The City of Grant would provide maintenance on 120th Street and July Avenue. Goodview Avenue would be paved and Washington County would pay up to $10,000 with the remainder being shared by Hugo, Grant, and White Bear Township equally. Puleo stated he was not comfortable with approving the JPA at this time. City Council Meeting of April 21, 2008 Page 5 of 7 Haas made motion, Miron seconded, to direct staff to present the Joint Powers Agreement, with minor changes, to the other parties for their review, and bring it back to the Council for final approval. Schedule Interview for Vacancy on Planning Commission At its March 3, 2008 meeting, the Hugo City Council accepted the resignation of long-time Planning Commissioner Kelly Bailly who has moved out of the state. Council directed staff to advertise for the vacancy on the Planning Commission. Staff is pleased to report there is one applicant for the vacancy on the Commission. City staff requested Council select a date on which to interview the applicants for the vacancy on the Planning Commission which would complete the term of Planning Commissioner Kelly Bailly to expire on December 31, 2009. City Administrator Mike Ericson informed the Council applications were being accepted until Friday, April 25, 2008. Haas made motion, Puleo seconded, to table the item until the next meeting when all Council members are present. All aye. Motion carried. Approve Rescheduling of the Hugo Fire Department Training Exercise to April 26, 2008 At its March 17, 2008 meeting, the Hugo City Council was informed by the Hugo Fire Department that it had scheduled its training exercise for the Rice Lake Park Building on Saturday, April 12, 2008. Due to scheduling conflicts, the fire training exercise has been rescheduled for Saturday, April 26, 2008 at the Rice Lake Park Building. Haas made motion, Puleo seconded, to approve the rescheduling of the Hugo Fire Department Training Exercise to Saturday, April 26, 2008. All aye. Motion carried. Discussion on Everton Avenue Petition for Public Improvements The City has received a petition for public improvements from Len Pratt who is requesting improvements to Everton Avenue, north of County Road 8. Mr. Pratt has requested the City to build the road and assess the costs for the road back to the property owners. This request comes at a time when Mr. Pratt is proposing the development of an office building and church on property he owns on the west side of Everton Avenue. The petition was signed by one of the two property owners abutting Everton Avenue. City Engineer Jay Kennedy presented this issue to the Council and explained the proposal was consistent with the transportation plan. The Council discussed future development and road connections in the area, and how the future Rosemary Way would effect the Wagner property on the east side of Everton. Len Pratt asked that the feasibility study be done at a reasonable cost. Scott Wagner, who did not sign the petition, talked about being able to participate City Council Meeting of April 21, 2008 Page 6 of 7 in road improvement cost depending on what they were. Scott said he has no interest in developing his property at this time and he has applied for Green Acres Classification. Haas made motion, Puleo seconded, to direct staff to review financing options, road policies, the City's current CIP, Green Acres classification and abatement impacts. All aye. Motion carried. Discussion on Amendment to City's Nuisance Ordinance to Address Loud Noise On March 28, 2008 the Code Enforcement Subcommittee met and discusses revisions to the nuisance ordinance regarding loud noise from vehicle stereos. The current ordinance regarding noise states that all unnecessary noise which tends to disturb the peace and repose of neighboring residents shall be considered a nuisance. The code enforcement subcommittee has decided to concentrate on the nuisance of car stereo systems and add a portion to the ordinance for enforcement specifically for the nuisance of car stereo systems. Staff requested direction from the Council on the process to amend the ordinance Puleo made motion, Haas seconded, to table the item to allow the subcommittee to review the revised ordinance and direct the Planning Commission to hold a public hearing on it once it was approved by the subcommittee. All aye. Motion carried. Discussion on Junk Car Ordinance On March 28, 2008 the Code Enforcement Subcommittee met and discusses revisions to the nuisance ordinance regarding junk vehicles. The current ordinance regarding junk vehicles states that it is a nuisance for any property to have more than two junk vehicles on it at a time. The ordinance simply states that each property in the City is allowed to store no more than two junk vehicles. A junk vehicle is defined as a vehicle that is required to be licensed to operate on public roads, but is not. The proposed ordinance will not allow junk vehicles on properties in the urban area of the City that are developed. Properties that meet certain criteria will be allowed to store no more than two junk vehicles and the vehicles shall be adequately screened from adjacent properties. Staff requested direction from the Council on the process to amend the ordinance Puleo made motion, Haas seconded, to table the item to allow the subcommittee to review the revised ordinance, and direct the Planning Commission to hold a public hearing on it once it was approved by the subcommittee. City Council Meeting of April 21, 2008 Page 7 of 7 District Managers Terms to Expire on Carnelian Marine — St. Croix Watershed District City staff has been informed by Washington County that the terms of two of the managers on the Carnelian Marine — St. Croix Watershed District are set to expire on June 21, 2008. City Administrator Mike Ericson asked that residents interested in serving on the Carnelian Marine — St. Croix Watershed District contact the City of Hugo or Washington County for more information.
