APPROVING PRELIMINARY PLAT FOR MERIDIAN LAND COMPANY FOR "FOX
MEADOWS" ON PROPERTY LOCATED EAST OF HIGHWAY 61 AND NORTH OF
125TH STREET
WHEREAS, Meridian Land Company has requested approval of a preliminary plat to allow
construction of 57 homes and on the 21.97 acre property legally described as follows:

WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the request by Meridian Land
Company for a preliminary plat, subject to the following conditions:
1. A preliminary plat is approved to allow the creation of 57 single family homes, in accordance
with the plans and application received by the City on October 31, 2013 and revisions
received February 4, 2014, except as amended by this resolution.
2. The development shall comply with the R-3 district standards.
3. Phase 1 shall include the Fondant Trail and Foxhill Avenue connections to the north, as well
as the connection to 125' Street.
4. No development signage is currently proposed.
a. If future signage is proposed, it must comply with ordinance standards in place at the
time of permit application.
b. The applicant will be required to provide a sign easement and maintenance agreement if
signage is proposed on one of the lots.
5. A minimum of two parking stalls shall be provided for each lot.
6. The developer shall comply with the City standards for street lighting within the public right-
of-way.
7. Exterior lighting shall be consistent throughout the development. All lighting shall be
shielded to prevent glare and light trespass, as required by Section 90-239 of the ordinance.
Lighting details should be submitted for City review and approval.
8. The location and species of all landscaping materials within the public right-of-way and/or
development are subject to further review and approval by the City staff.

9. The landscaping planned for the development shall be installed all at the same time during
each phase. The developers shall take proper precautions to protect the trees as the homes are
being built.
10. The following conditions shall be met prior to approval of a Final Plat:
a. The applicant must submit a wetland replacement plan to the City of Hugo for review and
approval.
b. The applicant must obtain all necessary wetland permits from the City of Hugo.
c. The development shall comply with the Fire Chief s requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
d. The plat shall comply with the City's street naming system, except as otherwise approved
by the City Council.
e. The applicant shall comply with all conditions in the City Engineer's letter dated
February 5, 2014.
11. The following conditions shall be met prior to release of the final plat for filing:
a. Park dedication shall be cash in lieu of dedication and shall be required for the 57 new
lots created by this plat, subject to the park dedication fees in place at the time of filing. If
the development is completed in phases, the park dedication will be for the number of
lots being created at that time.
b. The developer shall enter into a development agreement for each phase of development,
shall agree to complete all improvements, and pay all fees as required by the agreement.
c. The applicant shall pay their portion of the costs for the Beaver Ponds lift station.
12. The following conditions shall be met prior to issuance of building permits:
a. The existing temporary cul-de-sacs on Fondant Avenue and Foxhill Avenue in Beaver
Ponds South shall be removed and the roads should be extended into the development.
The developer shall restore the area of the temporary cul-de-sacs.
b. A 8 -foot bituminous trail shall be provided along the west side of Fondant Avenue as
shown on the plans. The trail shall be constructed by and paid for by the developer with
this plat.

c. The applicant shall be required to construct 1251' Street from its current termination point
west of the site to within the development as shown on the plans. The road improvements
shall be at the developer's expense and in compliance with City street standards.
d. The applicant shall record the final plat, development agreement and all other
documentation at Washington County and provide the City with proof of recording.
