APPROVING A VARIANCE TO CONSTRUCT A 1,600 SQUARE FOOT ADDITION ON
AN EXISTING ACCESSORY BUILDING FOR PROPERTY LOCATED 9824140TH
STREET NORTH
WHEREAS, Pat Shimota has requested a variance to construct a 1,600 square foot addition on an
existing accessory building for property located on 9824 1401 Street North where a maximum of
four accessory buildings totaling 6,420 square feet is allowed on the property legally described as:

WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly
called public meeting and recommended approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to construct
a 1,600 square foot addition on an existing accessory building for property located on 9824 140*
Street North where a maximum of four accessory buildings totaling 6,420 square feet is allowed
on the property.
1. The requested variance is from the dimensional requirement of the ordinance and is
permissible by law.
2. The strict enforcement of the ordinance would cause undue hardship because of
circumstances unique to the individual property not caused by the land owner. The
property is unique because of the remoteness of the property and surrounding land. The
surrounding properties, as well as the applicant's property, have ponds, wetlands, and
large groups of trees. These features seclude the property and the proposed accessory
building.
3. The granting of the variance would be in keeping with the spirit and intent of the
ordinance.
4. The property cannot be put to reasonable use without the granting of the variance.
5. The proposed variance would not noticeably alter the character to the average person.
Due to the remote location of the property and the placement of the addition, the
proposed variance would have minimal visual impact. Surrounding parcels also have
accessory buildings.
6. Accessory structures are a permitted use in the Agricultural Zoning District.
7. The subject property is not within a floodplain.
8. The subject property is served by individual well and septic systems.
