HomeMy WebLinkAbout2014.07.14 RESO 2014-20RESOLUTION 2014-20 APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR NEW LIFE CHURCH TO ALLOW A BUILDING ADDITION ON THE PROPERTY LOCATED AT 6000148TH STREET NORTH WHEREAS, New Life Church has requested approval of a conditional use permit amendment to allow a building addition on the property located at 6000 148' Street North and is legally described as follows: (See Attached) WHEREAS, a special use permit was approved on December 6, 1976, for a preschool/daycare. WHEREAS, a special use permit was approved on September 16, 1985, and amended on June 7, 2004, for an off-site directional sign. WHEREAS, a special use permit was approved on May 1, 1995, for a bell tower to constructed on the property. WHEREAS, the above uses were not constructed and have been abandoned. WHEREAS, a special use permit was approved on May 6, 1976, for the church use to be allowed on the property. WHEREAS, it is the desire of the applicant to amend the special use permit approved on May 6, 1976, to allow the building addition and to supersede all other prior special use permit approvals. WHEREAS, the Planning Commission has reviewed said conditional use permit amendment at a duly called public hearing on June 26, 2014, and recommends approval subject to the conditions listed in the conditional use permit. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit for New Life Church on the property located at 6000 148th Street North with the following findings: 1. The proposed use is allowed by conditional use permit. 2. The proposed use is allowed in the CR -3 zoning district and will keep with the spirit and intent of the ordinance, which is intended to allow a place of worship by a CUP as long as they comply with the regulations. The proposed use is compatible with the surrounding development and will not alter the character of the area. Resolution 2014-20 Page 2 3. The proposed use as adequate drainage, water supply, and utilized to the site. 4. The proposed use has adequate access off of 148' Street. 5. The applicant is not proposing to impact any floodplain. 6. The proposed use would not obstruct the floodplain or increase the potential for flooding. 7. The proposed use would not damage or reduce the benefits from any public waters. 8. The proposed use would not involve the use of watercraft on public waters. 9. The proposed use would not be visible from public waters. 10. The proposed use does not impact any wetlands 11. The applicant would be responsible for obtaining all state and local permits. 12. The proposed use is compatible with the adjacent developments. 13. This conditional use permit amendment shall supersede all prior conditional use permits and they shall no longer be on force or effect.
