APPROVING A VARIANCE TO CONSTRUCT AN ACCESSORY BUILDING TO BE IN
FRONT OF THE PRINCIPAL STRUCTURE FOR THE PROPERTY LOCATED AT
12150 UPPER HEATHER AVENUE NORTH.
WHEREAS, Thomas Windisch has requested approval of a variance from the accessory building
ordinance to allow an accessory building to protrude in front of a principle building for property
located on 12150 Upper Heather Avenue North, legally described as:
LOT 1, BLOCK 3, Dellwood Ridge
WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly
called public meeting and recommended approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to
construct an accessory building to be in front of the principal structure for the property located at
12150 Upper Heather Avenue North where the ordinance states that accessory buildings shall not
protrude in front of the principal building, with the following findings:
1. The requested variance is permissible by law.
2. There are practical difficulties in compliance with the ordinances due to the uniqueness
of the property. The property is unique because it is a comer lot, the location of the
existing house, and the topography of the property.
3. The granting of the variance would be in keeping with the spirit and intent of the
ordinance.
4. The applicant is requesting to use the property in a reasonable manner.
5. The proposed variance would not noticeably alter the character to the average person.
Due to the location of the property and the placement of the addition, the proposed
variance would have minimal visual impact. Surrounding parcels also have accessory
buildings.
6. Accessory structures are a permitted use in the Rural Residential Zoning District.
7. The subject property is not within a floodplain.
8. The subject property is served by individual well and septic systems.
