APPROVING FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR
LAVALLE FIELDS FIRST ADDITION ON PROPERTY LOCATED WEST OF
FINALE AVENUE NORTH OF FRENCHMAN ROAD (CSAH 8)
WHEREAS, Lavalle Fields, LLC, has requested approval of a final plat to allow the
creation of I lot and 4 outlots on the 39.56 acre property legally described as follows:

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Lavalle Fields, LLC, for a final plat, subject to the following conditions:
1. The final plat is approved to allow the creation of 1 lot for construction of a senior
housing facility and 4 outlots, in accordance the approved preliminary plat and
phasing plan stamp dated December 2, 2013, and the final plat plans received by the
City and dated May 30, 2014, except as amended by this resolution.
2. The final plat shall be subject to the preliminary plat approval granted by the City
Council on February 3, 2014. (Resolution # 2014-5).
3. The final plat shall be subject to the PUD approval granted on February 3, 2014.
(Resolution # 2014-3).
4. A final plat is approved in accordance with the preliminary plat and the PUD phasing
plan and stamp dated December 2, 2013, except as amended by this resolution.
5. The applicant must comply with all conditions outlined in the City Engineer's memos
dated December 12, 2013 and July 9, 2014.
6. The developer shall obtain all necessary local, state, and federal permits.
7. Outlot A shall be to be dedicated to the City to satisfy the park dedication
requirement for the plat.
8. Outlot B is intended for a future phase of the PUD, contains wetlands, and will
remain in its existing ownership.
9. Outlot C is intended for a future development and will remain in its existing
ownership.
10. Outlot D is intended for a stormwater management facility that will be constructed
with Phase 2 of the PUD and will remain in its existing ownership.

11. Prior to the release of the final plat for recording, the developer shall comply
with the following conditions:
a. All assessments shall be paid in full.
b. Outlot A shall be dedicated to the City to satisfy 77 % of the park dedication
requirement in Phase 1. The remaining 23% shall be paid in fee at Phase 2.
c. A segment of Finale Avenue right of way shall be dedicated to the City beginning
approximately 385 feet south of 145' Street right of way and extending to CSAH
8, with legal description subject to review and approval by staff.
d. A development agreement shall be signed and submitted in a form satisfactory to
the City.
e. The City's development fees shall be paid. The fee amounts will be calculated
and included as part of the Development Agreement.
12. Prior to the issuance of a building permit on Lot 1, Block 1, the developer shall
comply with the following conditions:
a. All items in the approval conditions for the site plan approved by the City on May
5, 2014, shall be met. (Resolution # 2014-13)
b. The applicant shall file the final plat, development agreement and associated
documents with Washington County. Proof of recording shall be provided to the
City.
c. The applicant shall submit one full set of approved final plans to the City.
d. The sewer and water trunk fees and the City's SAC and WAC fees shall be paid
with the building permit.
e. The developer must obtain all necessary stormwater management and WCA
permits from the City.
13. Prior to the issuance of the certificate of occupancy for the building on Lot 1,
Block 1, the developer shall comply with the following conditions:
a. Finale Avenue between 145a' Street and 146th Street shall be reconstructed as an
urban section roadway to a width of 26 feet with the first layer of bituminous.
b. A 10 foot wide trail easement shall be dedicated for the public trail. The exact
trail location shall be reviewed and approved by staff. The trail location shall be
setback 10 feet from the neighboring property to the west.
