A RESOLUTION APPROVING DNR DAM SAFETY PROGRAM GRANT
AGREEMENT
WHEREAS, the City of Hugo, hereinafter referred to as the "Applicant", act as
legal sponsor for the project described in the Department of Natural Resources Dam
Safety Program grant application; and,
WHEREAS, the Applicant has the legal authority to apply for financial
assistance, and the institutional, managerial and financial capability to carry out the
project; and,
WHEREAS , the Applicant has not violated any federal, state, or local laws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other
unlawful or corrupt practice; and,
WHEREAS, upon approval of its application by the State, the Applicant may
enter into an agreement with the State for the above -referenced project, and that the
Applicant certifies that it will comply with all applicable laws and regulations as stated in
the grant agreement; and,
WHEREAS, the Applicant has the committed funds for its share of the project
costs from the following sources: City stormwater funds, Rice Creek Watershed District,
Minnesota Department of Transportation Bridge funds; and,
WHEREAS, the Applicant has sufficient funds to complete the project if the
actual costs exceed the estimated costs; and,
NOW, THEREFORE, IT IS RESOLVED that Bryan Bear, City Administrator,
is hereby authorized to execute the Dam Safety Program grant agreement and act as the
Applicant's authorized agent for the purpose of administration of the grant.
