APPROVING A CONDITIONAL USE PERMIT FOR ROGER CAPAUL TO ALLOW
FOR ACCESSORY BUILDING SQUARE FOOTAGE TO BE UP TO 125% OF THE
PERMITTED SIZE ON THE PROPERTY LOCATED AT 12173 JANERO AVE N.
WHEREAS, Roger Capaul has requested approval of a conditional use permit to allow two
accessory buildings totaling 4,360 square feet for the property legally described as follows:

WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit
request by Roger Capaul to allow for two accessory buildings totaling 4,360 square feet, subject
to the following conditions:
1. The accessory building shall be used for only personal storage and not for business
related activities.
2. The accessory building shall comply with the setback requirements in the Rural
Residential zoning district.
3. The 400 square foot storage shed shall be demolished prior to the issuance of a building
final for the proposed 2,560 square foot building.
4. The proposed building shall meet all requirements under section 90-204 of the City Code.
5. The property owner shall maintain the existing screening between the accessory building
and the property line.
ADOPTED by the City Council on July 2, 2012.
