APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR RICK
BURR TO ALLOW AN EXPANSION OF A LEGAL NON -CONFORMING
INDUSTRIAL USE ON THE PROPERTY LOCATED AT 15587 FOREST
BOULEVARD NORTH
WHEREAS, Rick Burr, requested approval of a conditional use permit amendment to
allow an expansion of a legal non -conforming industrial use on the property located at
15587 Forest Boulevard North
(See attached Exhibit A)
WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly
called public hearing on August 9, 2012, and recommends approval subject to the
conditions listed in the conditional use permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit amendment for Rick Burr to allow an expansion of a legal non-
conforming industrial use on the property located at 15587 Forest Boulevard North with
the following findings:
1. The request meets spirit and intent of the ordinance which is to allow a
way for legal non -conforming uses to expand and continue their business
by reducing the impact of the use on the surrounding properties.
2. The impacts of the industrial legal non -conforming use to the surrounding
properties will continue to be reduced by limiting exterior storage on the
property and requiring all blasting to be conduct inside a booth.
3. A building permit shall be applied for and approved by the Building
Department for the blasting booth prior to installation.
4. After December 17, 2012, all sandblasting occurring on the property shall
be conducted indoors, or within the approved sandblasting booth.
ADOPTED by the City Council this 20th day of August, 2012.
