FOR "POSITIVE" DEVELOPMENT ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (CSAH 8) AND EAST OF ELMCREST AVENUE NORTH WHEREAS, Positive Companies, Inc. has requested approval of a PUD General Plan to allow construction of approximately 11,933 square feet of commercial on 1.07 -acres of the property legally described as follows: Outlot A, Victor Gardens North Village 3rd Addition, Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Positive Companies, Inc. for a PUD general plan, subject to the following conditions: 1. A PUD general plan/site plan is approved to allow development of 1 commercial lot for a retail shopping center and 3 oudots, in accordance with the application received by the City on May 21, 2009, and revised on January 28, 2010 and January 29, 2010, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested final plat. 3. The development shall be consistent with the Victor Gardens North P Addition approvals (Resolution # 2006-19), except as otherwise noted herein. 4. Development standards for the PUD shall be as indicated on the plans and graphics dated January 28, 2010 and January 29, 2010, except as amended by this resolution. 5. The retail building and parking shall comply with the setbacks as shown on the plans. 6. The commercial building must be sprinklered. 7. PUD flexibility is permitted to allow: a. Signage on all 4 elevations where the PUD allows signage on only 2 elevations b. Parking flexibility to provide 57 parking stalls where 68 stalls are required. 8. Prior to issuance of building permits, the applicant must comply with the following conditions: . Resolution 2010-5 Page 2 of 5 Architecture a. Rooftop equipment shall be screened by parapet or roof forms. Wood and metal enclosures are prohibited. Ground mounted equipment must be screened by walls designed and located to be aesthetically harmonious and compatible with the building. Material for screening shall be the same materials as the primary structure. b. Commercial building materials and architectural details shall be as shown on the plans received on January 29, 2010. c. All building elevations shall receive nearly equal treatment and visual qualities. d. All building materials shall be of high quality and constructed of durable materials. 1) All block within the development shall be integral colored. No painted CMU will be permitted. 2) All stone on the building shall be Owens Corning Southern Ledgestone Chardonnay, which is consistent with the building materials elsewhere in the Victor Gardens North Village. 3) A revised material sample board that reflects the approved building materials and colors shall be submitted for City review and approval. e. Building and parking lot lighting shall be consistent with the fixtures used in the Victor Gardens North Village. Details and cut sheets shall be submitted for city review and approval. f. Lights standards in parking lots shall be a consistent 30 -foot maximum height as specified in the Victor Gardens North Village Architectural Design Criteria. The plans shall be revised accordingly. g. No downspouts or gutters are shown on the building. The plans shall be revised to clearly show how rooftop drainage will be managed. Trash and Recycling h. Trash and recycling areas have been designed internal to the building. No exterior storage of trash or recycling shall be permitted except that trash receptacles may be provided at convenient locations on site to facilitate litter control. Signage i. The applicant must prepare revised sign criteria to regulate tenant signage according to the City's requirements and consistent with the sign criteria approved for Victor Gardens North Village, except as amended by this approval. The plan be submitted to the City for review and approval and must address the following: Resolution 2010-5 Page 3 of 5 1) Signage must comply with the Victor Gardens North Sign Criteria except as specifically noted in this approval. i. PUD flexibility is permitted allow signage on all 4 building elevations where such signage is normally permitted on only 2 elevations. 2) The Victor Gardens North Village includes one monument on the shared property line between this site and Kwik Trip. One sign panel has been reserved for this property. The property owner shall provide the City will a written summary of how that sign panel will be used. No other freestanding signage is allowed. 3) Tenant signage shall only be allowed on that tenant's space. 4) Only one tenant wall sign per tenant per fagade is allowed. 5) The developer must provide a copy of the sign criteria to building tenants. 6) A sign permit is required for all signs. Tenants must submit a sign permit application to the city for review and approval prior to installing any signage. Parks and Trails j. The applicant has satisfied all park dedication requirements with previous phases of this development. No additional dedication is required. k. The applicant shall dedicate a 10 -foot public trail easement over Outlot B (the private road) for a future trail. 1. The applicant shall dedicate an easement over the private sidewalk that connects Rosemary Way to CSAH 8. The maintenance of this private drive is the responsibility of the association. m. The private sidewalk shall be constructed with this phase. Construction details shall be submitted for city review and approval. n. The site plan shall be updated to show the sidewalk connection between the proposed sidewalk from Rosemary Way and the existing sidewalk on the north side of the private road. Streets, Access and Parking o. The parking calculation shown on sheet C4 do not comply with city ordinance requirements and should be revised to reflect the required number of parking spaces based on the ordinance requirements (11,933 s.f./200 + 8 = 68 stalls required). p. The existing median on the private road is proposed to be removed. The work must be completed according to City standards. q. No parking is permitted on the Private Road. • Resolution 2010-5 Page 4 of 5 r. Cross access and maintenance agreements shall be recorded with the final plat for the shared private road. s. PUD flexibility is granted to allow 57 parking stalls where 68 stalls are required. 7) No sit-down restaurants shall be allowed in the site due to the related parking demands; however, takeout restaurants would be permitted. Landscaping and Open Space t. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. u. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. v. The retaining wall shall be boulder retaining walls to match the Victor Gardens North Village retaining wall materials. w. The ornamental fence detail shall match the other ornamental fencing in Victor Gardens North Village. x. The plans must be revised to show the relocation of the three trees on Kwik Trip property proposed to be removed to accommodate the retaining wall. y. The applicant shall be responsible for obtaining a temporary easement agreement from Kwik Trip for the tree removal, tree replacement and installation of the retaining wall. A copy of the signed agreement must be submitted to the City. z. The landscape plan should be prepared by a registered landscape architect to ensure survivability and suitability of the materials as shown. Miscellaneous aa. The existing conditions survey should be revised to show the entire area proposed to be platted. bb. The site areas and calculations shown on sheet C4 shall be updated to reflect the 45,470 - square foot lot. cc. The applicant shall comply with all conditions from the City Engineer's memo dated February 3, 2010. dd. The applicant shall be responsible for all trunk infrastructure fees. ee. A complete set of revised plans addressing the conditions of approval shall be submitted for city approval. f • ' ^ Resolution 2010-5 Page 5 of 5 Outstanding Victor Gardens North Kilage rAddition Issues ff. The applicant must provide proof that the final plat and all associated documents have been filed at Washington County. gg. The following documents must be submitted reviewed and approved by the City Attorney. Upon City approval, the applicant shall file these documents at Washington County: 1) Articles of Incorporation of Victor Gardens Third Association 2) Declaration of Covenants, Conditions and Restrictions of Victor Gardens Third Association. 3) Amendment to the Declaration of Easements (Signage, Roadway, Access—North Village) 4) Private Road, Easement And Maintenance Declaration 5) Trail Easement Documents. 6) Sidewalk Easement Documents. 7) Deed from the landowner to the City of Hugo for Outlot A and Outlot C, Positive. hh. The applicant shall obtain all necessary local, state, and federal permits. ii. One development identification sign (with no tenant signage) was approved for the east side of the Kwik Trip site as shown on the Master Sign Plans. The Association has the right to install this sign upon receipt of a sign permit. 9. Prior to issuance of a certificate of occupancy, the applicant must comply with the following conditions: a. The City provided the landowners with a punch list (dated July 14, 2009) of outstanding development issues. 1) The property owners shall provide a summary of how the required improvements will be made, by whom and schedule for the improvements. 2) These issues must be addressed prior to issuance of CO for this site and release of financial guarantees.
