HomeMy WebLinkAbout2010.05.03 RESO 2010-0016RESOLUTION 2010-16 APPROVING A VARIANCE FOR SHORELAND SETBACK FOR SCOTT AND MELISSA MARSTON IN THE RURAL RESIDENTIAL ZONING DISTRICT ON PROPERTY LOCATED AT 8895126TH STREET NORTH WHEREAS, Scott and Melissa Marston have requested approval of a variance from the shoreland setback requirements to construct a building addition to be 150 feet from the ordinary high water mark of Long Lake, where 200 feet is required by ordinance on property described as follows: LOT 7, BLOCK 2, COUNTRY VIEW ACRES WHEREAS, the Board of Zoning has reviewed said variance at a duly called public hearing on April 22, 2010 and recommends approval with the following conditions: Prior to the issuance of a building permit: 1. The lowest floor of the addition shall be 4 feet above any known water table or the ordinary high water mark of Long Lake, whichever is greater. 2. The applicant shall have approval from Washington County on the placement of a new septic tank and show an area on the survey for a secondary site in case there is a failure of the septic system. 3. The application shall have approval for the relocation of the existing well on the property. The existing well shall be capped when replacement occurs. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance request for Scott and Melissa Marston from the shoreland setback requirements to construct a building addition on the property located at 8895 126�n Street North.
