APPROVING VARIANCES FOR JAKE AND PATTY GIBBS IN THE RURAL
RESIDENTIAL ZONING DISTRICT ON PROPERTY LOCATED AT 12465
HEATHER AVENUE NORTH
WHEREAS, Jake and Patty Gibbs have requested approval of a variance from the
accessory building ordinance to allow an accessory building to protrude in front of a
principal building and a variance to allow a 2,498 square foot accessory building, where
2,000 square feet is allowed by ordinance.

WHEREAS, the Board of Zoning has reviewed said variance at a duly called public
hearing on May 27, 2010, and recommends approval with the following conditions:
Prior to the issuance of a building permit:
1. The lowest floor of the addition shall be 4 feet above any known water table.
2. Accessory buildings shall not have indoor plumbing such that it would allow the
structure to be used as living space, which would constitute a dwelling.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
variance request for Jake and Patty Gibbs from the accessory building ordinance to allow
an accessory building to protrude in front of a principal building and a variance to allow a
2,498 square foot accessory building, where 2,000 square feet is allowed by ordinance.
