CITY OF HUGO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION DECLARING ADEQUACY OF PETITION AND DENYING THE
ORDERING OF REPORT
WHEREAS, on June 7, 2010 at the regularly scheduled City of Hugo City Council Meeting, the
City Council heard a presentation given by a resident regarding the need for street reconstruction
and utility improvements on certain parts of Ethan Avenue and Everton Avenue in the City of
Hugo, and
WHEREAS, said resident submitted to the council that certain petition, which requested the
improvement of Ethan Avenue adjacent to Bald Eagle Lake, and
WHEREAS, the City Council directed city staff and the city attorney to review said petition and
determine the validity thereof.
WHEREAS, on June 7, 2010, pursuant to the authority granted under Minn. Stat. Ch. 429, the
City Council, by its own initiative, proposed to make certain improvements on Ethan Avenue
adjacent to Bald Eagle Lake and to assess the benefited properties for all or a portion of the cost
of said improvements, and ordered a Feasibility Study to assess the need and cost of said
improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hugo,
Minnesota, as follows:
1. A certain petition requesting the improvement of Ethan Avenue adjacent to Bald
Eagle Lake, filed with the City Council on June 7, 2010, is hereby declared to be
signed by the required percentage of owners of property affected thereby. The
declaration is made in conformity to Minn. Stat. § 429.035.
2. The petition proposes improvements that are duplicative of the improvements
initiated by the City Council at its June 7, 2010 meeting. Therefore, initiating
improvements pursuant to the petition are unnecessary.
3. Ordering a Feasibility Study to investigate the need for the improvement proposed by
the petition would be superfluous and would result in an unnecessary use of the City's
resources, as the City Council at its June 7, 2010 meeting ordered a Feasibility Study
for substantially similar improvements.

4. Based on the foregoing, the improvements proposed by the petition shall be denied
and no further action shall be taken with respect to the petition.
This resolution was adopted by the City Council of the City of Hugo on the 6th day of July,
2010, by a vote of five Ayes and no Nays.
