APPROVING FINDINGS OF FACT DENYING A VARIANCE FOR
CONSTRUCTION OF AN ACCESSORY BUILDING LOCATED AT 12173
JANERO AVENUE NORTH
WHEREAS, Roger Capaul has requested a variance to allow two accessory buildings
totaling 7,000 square feet, where 3,500 square feet is allowed by ordinance:

WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at
a duly called a public hearing on September 23, 2010, and recommended denial, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variance
requested by Roger Capaul to allow two accessory buildings totaling 7,000 square feet,
where 3,500 square feet is allowed by ordinance based on the following findings:
1. The applicant's desire to construct the 5,200 square foot buidling is a self-created
hardship.
2. The request does not meet the spirit and intent of the ordinance.
3. The property could be put into reasonable use with out the granting of the
variance.
