HomeMy WebLinkAbout2009.01.05 RESO 2009-02RESOLUTION 2009-2 APPROVING A VARIANCE TO ALLOW A TOTAL OF 51688 SQUARE FEET OF ACCESSORY BUILDINGS FOR THE PROPERTY LOCATED AT 15220 EVERTON AVENUE NORTH WHEREAS, Arnie Triemert has requested a variance to construct a 480 square foot addition and the applicant has constructed a 768 square foot addition that brings the total square footage of accessory buildings to 5,688 where 4,500 is allowed by ordinance with a conditional use permit, on property described as follows: Sect -18 Twp -031 Range -021 NI/2-SEI/4-SWI/4 S 18T31 R21 EXCEPT:THE SOUTH 330.72 FEET OF THE N1/2-SEI/4 SWI/4 OF SECTION 18 TOWNSHIP 31 RANGE 21 -SUBJECT TO TOWN ROAD ON THE EAST HUGO WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly called public meeting and recommended approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to construct a lean-to that bring the total square footage of accessory buildings to 5,688, where 4,500 is allowed by ordinance with a conditional use permit 1. The requested variance is from the dimensional requirement of the ordinance and is permissible by law. 2. The strict enforcement of the ordinance would cause undue hardship because of circumstances unique to the individual property not caused by the land owner. 3. The granting of the variance would be in keeping with the spirit and intent of the ordinance. 4. The property can not be put to reasonable use without the granting of the variance. 5. The proposed variance would not noticeably alter the character to the average person. 6. Accessory structures are a permitted use in the AG District. 7. The subject property is not within a floodplain. 8. The subject property is served by individual well and septic systems. N ADOPTED by the City Council this 5h day of January, 2009.
