RESOLUTION 2009-10
APPROVING A SITE PLAN AND VARIANCES FOR MIKE ANDERSON IN
THE CENTRAL BUSINESS ZONING DISTRICT ON PROPERTY LOCATED
AT 14559 FOREST BOULEVARD NORTH
WHEREAS, Mike Anderson has requested approval of a site plan and variance from the
parking and shoreland setback requirements and is legally described as follows:

WHEREAS, the Planning Commission has reviewed said site plan and variances on
March 12, 2009 and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve site plan
and variances from the parking and shoreland setback requirements for Mike Anderson,
under the following conditions:
1. A demolition permit shall be issued prior to the demolition of Carpenters
Restaurant and the antique shop.
2. Prior to the installation of any signs, the applicant shall obtain a sign permit.
Prior to issuance of a Certificate of Occupancy:
3. Landscaping shall be fully installed per plans submitted February 24, 2009.
4. All roof top mechanical equipment shall be screened.
Prior to the issuance of a building permit:
5. An agreement allowing for construction of the parking lot on City owned property
shall be approved.
6. An easement shall be dedicated for right of way for the future expansion of TH
61.
7. A parking and cross access agreement shall be reviewed and approved by the
City.
8. A driveway permit shall be reviewed and approved by MNDOT.
9. All items on the Engineer's memo dated March 5, 2009 shall be addressed.

10. Existing drainage and utility easements shall be vacated.
11. New drainage and utility easements shall be recorded at Washington County for
the sewer lines, water lines, and stormwater ponds.
12. A trail easement shall be granted to the City for future trail construction.
13. The spandrel glass proposed for the building shall be reviewed and approved by
staff.
14. Staff shall review and approve the design of the deck prior to installation.
15. The payment for the cost sharing for construction of the side walk and turn lanes
on Highway 61 shall be paid in full.
