HomeMy WebLinkAbout2009.07.20 RESO 2009-24RESOLUTION 2009-24 APPROVING PRELIMINARY PLAT AND FINAL PLAT FOR POAC-CRAIN, LLC. FOR "VICTOR GARDENS COMMONS" ON PROPERTY LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF LEOPOLD LANE WHEREAS, POAC-Crain, LLC, has requested approval of a preliminary plat and final plat to allow construction of two commercial lots on the 2.23 -acre property legally described as follows: Lot 1, Block 5, Victor Gardens 4th Addition WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POAC-Crain, LLC for a preliminary plat and final plat, subject to the following conditions: 1. A preliminary plat and final plat are approved to allow the creation of two commercial lots in accordance with the application and plans received by the City on June 03, 2009 and revisions received on July 16, 2009, except as amended by this resolution. 2. The approval of the PUD General Plan is contingent on approval of the Preliminary and Final Plat for Victor Gardens Commons. 3. The development shall be consistent with the Victor Gardens PUD concept plan approvals and the Victor Garden Commons approvals. 4. Building architecture in the Victor Gardens Commons shall be consistent with the overall Victor Gardens PUD architecture. 5. The developer shall obtain all necessary permits from the City. 6. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. 7. The developer shall comply with all conditions outlined in the City Engineer's memo dated July 1, 2009. 8. Development Sign Criteria shall be reviewed and approved by City staff. 9. The monument sign shown on the plan shall be reviewed and approved by City Staff at the time that Lot 2 develops. 10. There are no approvals for the site concept shown on Lot 2. Resolution 2009 - Page 2 11. At the time that Lot 2 is developed a trail connection to CSAH 8 shall installed. 12. At the time that Lot 2 is developed a row of shrubs along the north side of the parking lot shall be installed. 13. At the time that Lot 2 is developed a parking and cross access agreement shall be reviewed and approved by the City for the benefit of Lot 1. 14. Prior to the issuance of any building permits, the developer must comply with the following conditions: a. The applicant shall file the Final Plat, and associated documents at Washington County. Proof of recording must be provided to the City. b. The applicant shall submit one full set of approved final plans to the City. c. Park dedication will be due for Lot 1, Block 1 and Lot 2, Block 1 of the development. The developer shall pay a park dedication fee in lieu of dedicating land (2.23 net acres X $2,400 = $5,352).
