HomeMy WebLinkAbout2009.07.20 RESO 2009-25RESOLUTION 2009-25 APPROVING A PUD GENERAL PLAN FOR PAWS PET HOSPITAL ON LOT 1, BLOCK 1, OF VICTOR GARDENS COMMONS LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF LEOPOLD LANE WHEREAS, POAC-Crain, LLC has requested approval of a PUD general plan to allow construction of a pet hospital on the property legally described as follows: Lot 1, Block 1, Victor Gardens Commons WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POAC-Crain, LLC for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved to allow the construction of a 3,595 -square foot pet hospital on Lot 1, Block 1, Victor Gardens Commons in accordance with the plans received on June 3, 2009 and June 16, 2009, except as amended by this resolution. 2. The development shall be consistent with the Victor Gardens PUD concept plan approvals and the Victor Garden Commons approvals, except as otherwise noted herein. 3. The developer must comply with all conditions outlined in the City Engineer's memo dated July 1, 2009. 4. The developer shall obtain all necessary local, state, and federal permits. 5. All signs shall be approved and issued a sign permit prior to installation. 6. PUD flexibility is granted from the following requirements: a. An exemption from the lot depth requirements to allow a 150 foot lot depth, where 250 feet is required by ordinance. b. An exemption to the PUD requirement that all ground -mounted mechanical equipment be screened by walls designed as part of the building. The applicant is requesting to screen the ground -mounted mechanical equipment with landscaping. 7. Prior to building permit approval, the developer must comply with the following conditions: Resolution 2009 - Page 2 a. A parking and cross access agreement shall be reviewed and approved by the City and recorded against the property. b. Development Sign Criteria shall be reviewed and approved by City staff.
