APPROVING FINDINGS OF FACT DENYING REQUEST FOR VARIANCES
FOR A DRIVEWAY LOCATED AT 6192 14fH STREET NORTH.
WHEREAS, Todd Christensen has requested variances for a driveway with no edge
clearance where ordinance requires five feet, and a variance to allow a 32 foot driveway
width were a maximum of 24 feet is allowed by ordinance on property described as
follows:
Lot 10, Block 1, Rice Lake Meadows, Washington County.
WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance
request at a duly called public meeting and recommended denial, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variances
as requested by Todd Christensen on property located at 6192 1470' Street North based on
the following findings:
1. The applicant has not identified a unique hardship that would warrant the granting
of the requested variances.
2. The strict enforcement of the ordinance would not cause undue hardship because
the applicant would be able to access the garage and park cars on a driveway
meeting ordinance requirements.
3. The applicant's desire to increase the driveway is a self-created hardship and is
not unique to this individual parcel.
4. The spirit and intent of the ordinance would not be met because the driveway
would increase the impervious surface and reduce the amount of open space
intended by the ordinance.
5. The request will change the character of the neighborhood.
ADOPTED by the City Council this 'l day of January, 2008.
