RESOLUTION 2008-12
APPROVING A PUD AMENDMENT FOR THE ROTTLUND COMPANY, INC. FOR
"VICTOR GARDENS NORTH VILLAGE 5TH ADDITION" ON PROPERTY
LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE
NORTH
WHEREAS, The Rottlund Company, Inc. has requested approval of a PUD Amendment
to allow construction of 72 townhome units on 12.74 -acre property legally described as
follows:
Outlot A, Victor Gardens North Village 2"d Addition, according to the
recorded plat thereof, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the PUD Amendment at a duly
called Public Meeting and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by The Rottlund Company, Inc. for a PUD Amendment, subject to the following
conditions:
1. A PUD Amendment is approved to allow the creation of 72 townhomes in accordance
with the plans received by the City on March 7, 2008, except as amended by this
resolution.
2. Approval is contingent upon City Council approval of the requested preliminary plat.
3. The development shall be consistent with the Victor Gardens PUD concept plan
approvals (Resolution # 200047), and Victor Gardens North PUD approvals (2005-
05 and 2005-06), except as otherwise noted herein.
4. Development standards for the PUD shall be as indicated on the plans dated March 7,
2008, except as amended by this resolution.
5. Private driveways in front of the townhome garages shall be a minimum of 22 feet
long to accommodate parking.
6. No parking is permitted on the shared drives.

7. All platted townhome lots shall comply with the following setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
8. All townhome buildings must be sprinklered. Twinhome buildings and Courtyard
units are not required to be sprinklered.
9. Prior to final plat approval, the applicant must comply with the following conditions:
Architecture
a. The plans must be revised to clearly identify how the mechanical equipment for
the townhomes will be screened.
b. Building materials and architectural details shall be as shown on the plans and
according to the design palette submitted to the City. Building colors and
materials shall be harmonious throughout the development.
c. All building elevations shall receive nearly equal treatment and visual qualities.
d. No adjacent home shall have the same front elevation colors. Materials shall be
consistent with the architectural plans and design palette approved as part of this
PUD amendment.
Signage
e. No development signage is proposed or approved.
Parks and Trails
f. Trails and sidewalks shall be as shown on the plans received on March 7, 2008.
g. The planned future trail on Elmcrest Avenue shall connect to the planned trail
south of CSAH 8. The developer shall work with the City and County to ensure
these connections are made.
h. A 10 -foot trail easement is required along Elmcrest Avenue for the future trail.
This easement shall be shown on the plans and all improvements, including the
proposed driveways and landscaping, must be removed from this trail easement.
i. Park dedication requirements for this site have been met with previous additions.
No additional park dedication is required for this phase.

Miscellaneous
j. Emergency vehicle turnarounds must comply with city dimensional requirements.
k. The applicant shall comply with all conditions from the City Engineer's memo
dated March 31, 2008.
10. Prior to issuance of building permits, the applicant must comply with the following
conditions:
a. The applicant shall provide copies of the development covenants/HOA documents
for City review. A copy of the covenants/HOA documents shall be filed with the
final plat.
b. The applicant shall provide copies of the cross access and maintenance
agreements for City review. These documents shall be recorded with the final
plat for the shared private drives and parking.
c. The homeowner's association documents shall include language to ensure that the
enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
discouraged. The covenants should be drafted to prohibit the storage of anything
in the garage or driveway that would prevent the storage and parking of vehicles.
Such language shall also be included in the Developers Agreement.
d. The homeowner's association documents and sales information shall note that the
property to the north is zoned Agricultural (AG) and that the intent of this district
is to provide an area for the production of livestock, dairy animals, dairy products,
poultry or poultry products, fur -bearing animals, horticultural or nursery stock,
fiuit, vegetables, forages, grains, timber, trees, or bees and apiary products, and
other uses dependent on the inherent productivity of the land.
e. The developer's architectural control committee (ARC) shall review and approve
all building designs for compliance with this resolution, prior to building permit
submittal. A written copy of the ARC approval shall be submitted with the
building permit application for each building. The City shall review the building
architecture for compliance with the approved plans prior to issuance of building
permits.
f. At the time of final plat approval for each phase of the development, the applicant
shall submit PUD Final Plans for the review and approval of the City staff, prior
to issuance of building permits.
g. The applicant shall obtain all necessary local, state, and federal permits.

WHEREUPON, said Resolution was declared duly passed and adopted by the City
Council for the City of Hugo this 21s' day of April, 2008.
