RESOLUTION 2008-13
APPROVING PRELIMINARY PLAT FOR THE ROTTLUND COMPANY, INC. FOR
"VICTOR GARDENS NORTH VILLAGE 5TH ADDITION" ON PROPERTY
LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE

WHEREAS, The Rottlund Company, Inc. has requested approval of a preliminary plat to
allow construction of 72 townhome units on the 12.74 -acre property legally described as
follows:
Outlot A, Victor Gardens North Village 2"d Addition, according to the
recorded plat thereof, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by The Rotdund Company, Inc. for a preliminary plat, subject to the following
conditions:
1. A preliminary plat is approved to allow the creation of 72 townhomes in accordance
with the plans received by the City on March 7, 2008, except as amended by this
resolution.
2. Approval is contingent upon the City Council approval of the requested PUD
amendment.
3. Development standards shall be as approved in Victor Gardens PUD concept plan
approvals (Resolution # 2000-47) and Victor Gardens North PUD approvals (2005-05
and 2005-06), except as otherwise noted herein.
4. Park dedication requirements for this site have been met with previous additions. No
additional park dedication is required for this phase.
5. The developer must obtain all necessary permits from the City.
6. The development shall comply with the Fire Chief s requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.

7. Drainage and utility easements will be provided over the wetlands and ponds up to
the 100 year high water level and over the proposed sanitary sewer, storm sewer and
water main lines as shown on the preliminary plat.
8. Sanitary sewer and water main service is available to the proposed development from
Rosemary Way. The applicant must work with the City Engineer to finalize these
connection details prior to approval of the final plat.
9. The developer must comply with all conditions outlined in the City Engineer's memo
dated March 31, 2008.
WHEREUPON, said Resolution was declared duly passed and adopted by the City
Council for the City of Hugo this 21" day of April, 2008
