RESOLUTION 2008-17
APPROVING PRELIMINARY PLAT FOR FRENCHMAN PLACE 1ST
ADDITION ON PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF
EVERTON AVENUE NORTH AND FRENCHMAN ROAD (COUNTY ROAD 8)
WHEREAS, Pratt Development Inc. has requested approval of a preliminary plat to allow
construction on the 54.1 -acre property legally described as follows:
That part of the East Half of the Northwest Quarter of Section 19,
Township 31, Range 21, Washington County, Minnesota lying northerly
of the center line of the Highway.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Pratt Development Inc. for a preliminary plat, subject to the following
conditions:
1. A preliminary plat is approved in accordance with the preliminary phasing plan dated
February 22, 2008 and preliminary plat dated March 31, 2008, except as amended by
this resolution.
2. Approval is contingent upon City Council approval of a rezoning to R-5 for the
northern 25.3 -acre portion of the site.
3. Approval is contingent upon Everton Avenue being upgraded according to City
standards. The street improvement project should include a trail on one side of
Everton Avenue and a sidewalk on the other side. Prior to final plat approval, the
City and the developer must reach agreement on how the street improvements will be
financed and constructed.
4. The preliminary phasing plan is generally approved. The entire length of Rosemary
Way will be constructed with the first layer of bituminous prior to issuance of a
Certificate of Occupancy for the 2nd building in phase 3 or any building in phase 4.
5. The private drive extending from the adjacent Victor Gardens development shall be
extended through the site to connect back to Rosemary Way and a cross -access
agreement between the two developments must be established for these access points.
6. Sidewalks shall be constructed on both sides of Rosemary Way.
7. Prior to approval of a site plan for development of the 1st building in phase 3 or phase
4, the developer shall submit design guidelines and a material palette for phases 3 and
4 to ensure that those buildings are designed to be compatible with each other.

8. The developer shall submit final site plans, building elevations, street improvement
plans, utility plans, grading and drainage plans, landscaping and tree preservation
plans, lighting and signage plans along with the required land use applications for
each phase of the development.
9. Prior to final plat approval, the developer must comply with the following conditions:
a. The developer must obtain preliminary plat approval from Washington County
and comply with all conditions of plat approval.
b. The 3 proposed outlots must be either combined with the adjacent lots with
drainage and utility easements placed over the pond and wetland areas or they
shall be deeded to the City.
c. The existing conditions survey will need to be revised to show all encumbrances
on the site.
d. The developer must comply with all conditions outlined in the City Engineer's
memos dated April 17, 2008.
e. The developer must obtain all necessary stormwater management and WCA
permits from the City.
f. The developer shall obtain all necessary local, state, and federal permits.
g. The Applicant will need to obtain written approval from Xcel Energy for any
proposed encroachments in the easement area.
10. Prior to the release of the final plat for recording, the developer must comply with the
following conditions.
a. Park dedication will be due for Lot 1, Block 1 and Lots 1 and 2, Block 2 for the
first phase of the development. The Applicant shall pay a park dedication fee in
lieu of dedicating land (9.3 net acres X $2,400 = $22,320). Park dedication for
the remaining lots and outlots will be due with the final plat for the subsequent
phases. Park dedication shall be subject to the fees in place at the time of release
of the final plat.
b. The applicant shall pay their portion of the Everton Avenue Study AUAR costs,
based on the net area of the project site (est. $17,695.99).
c. A development agreement will need to be signed and executed in a form
satisfactory to the City.

d. The City's Storm Water Fees will apply to this project. The fee amounts will be
calculated and included as part of the Development Agreement.
