HomeMy WebLinkAbout2008.05.19 RESO 2008-0019RESOLUTION 2008-19 APPROVING A PUD GENERAL PLAN FOR LAKES AREA BANK ON LOT 11, BLOCK 4 OF VICTOR GARDENS 4H ADDITION LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF EVERTON AVENUE WHEREAS, Lakes Area Bank has requested approval of a PUD general plan to allow construction of a bank on the property legally described as follows: Lot 1, Block 4, Victor Gardens 4`6 Addition WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Lakes Area Bank for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved to allow the construction of a 4,984 -square foot bank with drive-through on Lot 1, Block 4, Victor Gardens 4a' Addition in accordance with the architectural, civil and lighting plans received on May 1, 2008, except as amended by this resolution. 2. The development shall be consistent with the Victor Gardens PUD concept plan approvals and the Victor Gardens 0 Addition approvals, except as otherwise noted herein. 3. PUD flexibility is granted from the following requirements: a. An exemption to the Victor Gardens PUD requirement for buildings to be designed with a French Village/European architectural theme to allow the building design to be prairie style architecture with a craftsman influence. b. A 5 -foot parking setback where 10 -feet setback is required by ordinance from Everton Avenue. c. A second wall sign where only one wall sign is allowed by ordinance, provided that one sign is located on the north elevation facing CSAH 8 and the other sign is located on the east elevation facing Everton Avenue. d. An exemption to the PUD requirement that all ground -mounted mechanical equipment be screened by walls, provided that the Applicant submits an elevation proving that the proposed evergreen plantings will effectively screen the mechanical equipment. Approval is subject to city staff approval, which will be granted if the applicant can show that the landscaping will screen the mechanical equipment as well as the required wall. Resolution 2008-19 Page 2 4. Prior to building permit approval, the developer must comply with the following conditions: a. The developer must submit a PUD final plan for review and approval by City staff. Architecture b. Final building elevations shall be submitted for review and approval by the City that address the changes requested by the ARC and the City. c. If used, gutters and downspouts shall be shown on the plans and designed to match the architecture of the building. d. A final color/material palette shall be submitted for review and approval by the ARC and the City. This sample board shall include all exterior building materials and colors. Trash and Recycling e. Trash and recycling areas must be designed internal to the building or as an integral part of the building. The plans comply with this requirement. Signage f. Plan details for the Victor Gardens entry monument sign at the northeast corner of the site shall be submitted with this site plan, if the Victor Gardens 0 Addition developer intends to install this sign. The design and materials of this sign will need to be consistent with the other entry monument signs for Victor Gardens. g. The bank monument sign is approved subject to the submitted plans, except that the building materials must be revised to use the materials used on the bank building. h. The electronic message board portion of the sign shall maintain constant illumination and only alternate to display time and temperature. i. Wall signage must be generally consistent with the other commercial developments in Victor Gardens and the Victor Gardens sign criteria approved by the City on January 23, 2008. Specifically: a. The wall sign locations shown on the plan are approved. b. Signage must be externally illuminated letters and logos. The plans indicate that the wall signs will be internally illuminated. The plans will need to be revised to include an acceptable external illumination method. Resolution 2008-19 Page 3 c. Wall signage must be mounted on a common architectural background. The letters appear to be individually mounted directly on the surface but no details have been provided. The plans will need to be revised to include a common architectural background for the wall signs. j. Sign details, including materials, lighting and colors must be submitted for review and approval by the City. The details shall include the lighting types, methods and intensity. Parks and Trails k. Crosswalk details for the portion of sidewalks the cross the parking and drive lane areas shall be submitted for review and approval by City staff. a. The sidewalk connection to the CSAH 8 must be constructed at the applicant's expense when the CSAH 8 trail is constructed. b. All other sidewalks and crosswalks must be constructed with the bank building. 1. The developer will be required to repair or replace any sidewalk areas disturbed during construction. m. Park dedication is due for Lot 1, Block 4 at this time. The current park dedication fee for commercial property is $2,400 per net acre (0.803 net acres) for a total due of $1,927. Streets, Access and Parking n. The Applicant will need to work with the City Engineer to determine appropriate locations for directional signage to facilitate proper traffic flow within the site. Landscaping and Open Space o. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. p. The boulevard plantings along Everton Avenue, Victor Path and Leopold Lane have already been installed, except that the applicant will plant the remaining 3 street trees along Everton Avenue (between CSAH 8 and the bank entrance) to continue the Victor Gardens streetscape. The Applicant will be required to provide protection measures for these trees during construction and replace any trees if damaged during construction. q. The applicant shall work with Rottlund Homes to address the concerns raised in their May 1, 2008 letter requesting additional landscaping to screen this commercial use from the adjacent residential homes. Resolution 2008-19 Page 4 Miscellaneous r. The developer must comply with all conditions outlined in the City Engineer's memo dated April 15, 2008. s. The developer shall obtain all necessary local, state, and federal permits. t. The Developer should provide documentation of RCWD permit for proposed grading and storm water plan.
