HomeMy WebLinkAbout2008.06.16 RESO 2008-0030CITY OF HUGO RESOLUTION 2008-30 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR VICTOR GARDENS NORTH VILLAGE 5TH ADDITION ON PROPERTY LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH. WHEREAS, the Rottlund Company, Inc. has requested approval of a final plat for "Victor Gardens North Village 5" Addition" to allow the construction of 8 courtyard townhome units and 2 outlots on the 12.74 -acre property legally described as follows: Outlot A, Victor Gardens North Village 2id Addition. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by the Rottlund Company, Inc. for a final plat, and; FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; subject to the following conditions: 1. A Final Plat is approved to allow construction of 8 multi -family units, in accordance with the overall grading, utility and paving plans dated April 21, 2008 and the final plat graphics dated May 7, 2008, except as amended by this resolution. 2. The Final Plat shall be subject to the PUD Amendment and Preliminary Plat approvals (Resolutions # 2008-12 and #2008-13) granted by the City Council on May 5, 2008, except as amended by this resolution. 3. Development standards shall be as approved in the Victor Gardens PUD concept approvals (Resolution #200047) and Victor Gardens North PUD approvals (Resolutions #2005-05 and #2005-06). 4. Approval is contingent upon City Council approval of the vacation of the existing drainage and utility easement over the subject property. 5. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. t Resolution 2008-30 • Page 2 6. The developer must comply with all of the conditions outlined in the City Engineer's memo dated June 10, 2008. 7. Prior to the release of the final plat for recording, the developer must comply with the following conditions: a. The developer must obtain all necessary stormwater management and WCA permits from the City. b. The developer shall obtain all necessary local, state, and federal permits. 8. Prior to the issuance of any building permits, the developer must comply with the following conditions: a. The developer shall file the Final Plat, Development Agreement and associated documents at Washington County. Proof of recording must be provided to the City. b. The trail easement document shall be signed by the developer and recorded at Washington County. c. The developer shall submit a PUD final plan for review and final approval by City staff in compliance with the following conditions: L The plans must clearly identify how the mechanical equipment for the townhomes will be screened. ii. Building materials and architectural details shall be as shown on the plans and according to the design palette submitted to the City. Building colors and materials shall be harmonious throughout the development. iii. All building elevations shall receive nearly equal treatment and visual qualities. iv. No adjacent home shall have the same front elevation colors. Materials shall be consistent with the architectural plans and design palette previously approved. v. Private driveways in front of the townhome garages shall be a minimum of 22 feet long to accommodate parking. d. The developer's architectural control committee (ARC) must review and approve all building designs for compliance with this resolution and the development standards for Victor Gardens. A written copy of the ARC approval shall be submitted with the building permit application for each building. /♦ Resolution 2008-30 Page 3 e.
