APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT FOR
THE ROTTLUND COMPANY, INC. FOR PROPERTY LOCATED NORTH OF
ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH
WHEREAS, the existing drainage and utility easement is no longer required; and
WHEREAS, the Rottlund Company, Inc. has requested approval of a vacation of the
existing drainage and utility easement on property to be platted as "Victor Gardens North
Village 5h Addition" on the 12.74 -acre property legally described as follows:
Outlot A, Victor Gardens North Village 2"d Addition.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
vacation for the Rottlund Company, Inc., subject to the following conditions:
1. A vacation is approved in accordance with the application received by the City on
April 21, 2008, except as amended by this resolution.
2. The vacation must filed at Washington County.
3. New drainage and utility easements must be provided over the remaining
wetlands and ponds, as well as on the lot lines as required by the City.
ADOPTED by the City Council this 16'h day of June 2008.
Whereupon said resolution was moved for adoption by Council Member
Granger and duly seconded by Council Member Puleo
Council members voting AYE: Puleo, Haas, Granger, Petryk, Miron
Council members voting NAY: None
Whereupon said resolution was declared passed and adopted this 16th day of
June, 2008
