APPROVING A SITE PLAN AND TAX INCREMENT FINANCING
AGREEMENT FOR HUGO DEVELOPMENT PARTNERS LLC IN THE
RESIDENTIAL SERVICE ZONING DISTRICT ON*PROPERTY LOCATED AT
13891 FOREST BOULEVARD NORTH
WHEREAS, Hugo Development Partners Inc. has requested approval of a site plan to
construct a retail building and a Tax Increment Financing on property located at 13891
Forest Boulevard North, legally described as:

WHEREAS, the Planning Commission has reviewed said site plan at a duly called public
hearing on May 8, 2008 and recommends approval.
WHEREAS, the Economic Development Authority has reviewed said Tax Increment
Financing Agreement on September 15, 2008 and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the site
plan and Tax Increment Financing Agreement to Development Partners Hugo LLC to
construct a retail building on property located at 13891 Forest Boulevard North subject to
the following conditions:
1. All trash enclosures shall be located within the building.
2. A fence shall be installed on the east side of the property if so deemed by
the City Council at a future date if a public safety issue occurs.
Prior to the issuance of a building permit:
3. An access easement shall be dedicated across the property for the benefit
of adjoining properties to the north and south. The easement language is
subject to review and approval of staff.
4. The Tax Increment Financing Agreement is subject to further review by
the City Attorney.
5. Building material and architecture on the north elevation of the building
shall be the same as the west elevation.
6. A driveway access permit shall be submitted and approved by Minnesota
Department of Transportation.
7. An easement shall be dedicated for right of way for the future expansion
of TH 61.
8. A building material board shall be submitted for review and approval by
the City.

9. A demolition permit for the existing building on site shall be issued by the
City.
10. A TIF Development Agreement shall be reviewed and approved by the
City.
11. The applicant shall submit cut sheets of all exterior building light fixtures.
Only cut-off fixtures are allowed
12. All items in the engineer's memo dated May 1, 2008 shall be completed.
13. Prior to the installation of any signs, the applicant shall obtain sign
permits. Sign criteria for the development shall be reviewed and approved
by the City.
14. The applicant shall pay the park dedication fee of $2,400 per net acre

15. All roof top mechanical equipment must be screened from view of
adjacent properties. The parapet wall shall be raised four feet above the
roofline.
16. All landscaping shall be fully installed
