APPROVING AN ENCROACHMENT AGREEMENT FOR RICK MARK OF
NATIONAL RECYCLING INC TO ALLOW CONSTRUCTION OF SITE
IMPROVEMENTS WITHIN A ROADWAY AND UTILITY EASEMENT ON
THE PROPERTY LOCATED AT 15717 FOREST BOULEVARD NORTH
WHEREAS, Rick Mark, requested approval of an encroachment agreement to allow
construction of site improvements within a roadway and utility easement on the property
located at 15717 Forest Boulevard North, legally described as follows;

WHEREAS, the Planning Commission has fully considered the request for the
encroachment agreement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
encroachment agreement to Rick Mark to allow construction of site improvements within
a roadway and utility easement on the property located at 15717 Forest Boulevard North.
ADOPTED by the City Council this 16th day of May 2011.

Minnesota State Trunk Highway No. 61, and the East and West Quarter line of
said Section Seventeen (17); thence Northerly along said Easterly right of way

described; thence continuing along said right -of way line One Hundred Ninety-
