HomeMy WebLinkAbout2007.06.04 RESO 2007-0025RESOLUTION 2007-25 APPROVING A PUD AMENDMENT FOR UNITED PROPERTIES INVESTMENT LLC FOR "VICTOR GARDENS NORTH VILLAGE 4TH ADDITION" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF VICTOR HUGO BOULEVARD WHEREAS, United Properties Investment LLC has requested approval of a PUD amendment to allow construction of a restaurant and bank on the property legally described as follows: Lot 1, Block 1 and Outlot B, Victor Gardens North Village, according to the plat thereof on record in the County of Washington, State of Minnesota. WHEREAS, the Planning Commission has reviewed the PUD amendment at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by United Properties Investment LLC for a PUD amendment, subject to the following conditions: 1. A PUD amendment is approved to allow the construction of a 4,910 -square foot bank and a 8,100 -square foot restaurant on lots to be created in accordance with the preliminary plat/PUD submittal received by the City on February 23, 2007, and revisions received on April 11, April 23 and May 1, 2007, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested preliminary plat. 3. The development shall be consistent with the Victor Gardens PUD concept plan approvals (Resolution # 2000-47), except as otherwise noted herein. 4. Development standards for the PUD shall be as indicated on the plans dated April 11, 2007 and revisions dated April 23, 2007 and May 1, 2007, except as amended by this resolution. 5. The bank and restaurant buildings shall comply with the setbacks shown on the plans. 6. All commercial buildings must be sprinklered. 7. PUD flexibility is permitted for a 9.5 -foot encroachment upon the 30 -foot rear yard (north lot line) setback requirement for the restaurant. 8. PUD flexibility is granted to allow shared parking and a reduction in the total number of stalls required on site from 475 to 339 (4.11 stalls per 1,000 square feet). a. Prior to building permit approval, the developer must comply with the following conditions: a. The developer must submit a PUD final plan application for review and approval by City staff. Architecture b. Building materials and architectural details shall be as shown on the plans received on April 11, 2007, except as otherwise noted. c. The developer's architectural control committee (ARC) shall review and approve all building designs for compliance with this resolution, prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application for each building. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. d. Rooftop equipment shall be screened by parapet or roof forms. Wood and metal enclosures are prohibited. Ground mounted equipment must be screened by walls designed and located to be aesthetically harmonious and compatible with the building. Material for screening shall be the same materials as the primary structure. e. All block within the development shall be integral colored. No painted CMU will be permitted. f. All building elevations shall receive equal treatment and visual qualities. g. The developer shall work with the City and Victor Gardens ARC on the final design of the wrought iron fence shown around the patio and on the roof. h. The developer shall wrap the stone base around all building elevations, including the cooler. L The developer should extend the stone base to the top of the window to reduce the amount of stucco or EFIS on the building. j. The developer should revise the plans to replace the hardiboard with brick or another material acceptable to the City. k. A final color/material palette shall be submitted for review and approval by the City. This sample board shall include all exterior building materials and colors. Trash and Recycling � Resolution 2007-25 Page 3 1. Trash and recycling areas must be designed internal to the building or as an integral part of the building. Signage m. Wall signs must comply with the Victor Gardens sign criteria approved by the City on November 6, 2006. n. No additional freestanding signage shall be allowed. o. A sign plan for each building must be submitted with the final development plans for each building. p. Sign details, including materials, lighting and colors must be submitted for review and approval by the City. The details shall include details about lighting colors, including any LED lighting proposed. Parks and Trails q. Sidewalk connections must be provided between the proposed buildings and the existing trail on CSAH S. The developer shall work with the City and County to ensure these connections are made. Crosswalk details shall be submitted for review and approval by City staff. r. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. Streets, Access and Parking s. The developer must submit a plan with details for paving, sidewalks and cross walks for review and approval by the City. t. No parking is permitted on the shared drives. u. Cross access and maintenance agreements shall be recorded with the final plat for the shared private drives and parking. v. Parking and drive aisles must be a minimum of 5 -feet from public right-of-way. The plans shall be revised to dimension this setback to ensure compliance. w. Staff will monitor the tenants within the development to ensure that adequate parking is provided as tenants are finalized. Landscaping and Open Space x. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. Resolution 2007-25 Page 4 y. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. z. The plans must be revised to show the CSAH 8 landscape plan on the landscape plan. Miscellaneous aa. The developer must comply with all conditions outlined in the City Engineer's memo dated May 2, 2007. i) The Lot 2 property owner will need to enter into a License Agreement or Encroachment Agreement with the City to allow the deck within the drainage and utility easement. ii) The developer must submit additional details for the deck footings that will be located within the pond itself for review and approval by the City Engineer. The footing construction must be completed in a manner that will not result in any filling of the pond. iii) The developer shall submit final plans that include storm sewer design details for the design of the storm sewer structure adjacent to existing retaining wall. Several portions of the existing storm sewer system will be removed and relocated as part of the project. Final plans must be submitted for review and approval by the City Engineer. iv) The plans shall be revised to update the existing grades along the trail located along the southern edge of the proposed development to confirm the planned emergency overflow to the south. City policy requires a minimum of 1.0 feet of separation between the emergency overflow and the low floor elevation. Final plans must be submitted for review and approval by the City Engineer. bb. The developer shall obtain all necessary local, state, and federal permits. cc. The Developer should provide documentation of RCWD permit for proposed grading and storm water plan.
