HomeMy WebLinkAbout2007.06.04 RESO 2007-0026RESOLUTION 2007-26 APPROVING PRELIMINARY PLAT FOR UNITED PROPERTIES INVESTMENT LLC FOR "VICTOR GARDENS NORTH VILLAGE 4M ADDITION" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF VICTOR HUGO BOULEVARD WHEREAS, United Properties Investment LLC has requested approval of a preliminary plat to allow the creation of 3 lots on the 10.54 -acre property legally described as follows: Lot 1, Block I and Outlot B, Victor Gardens North Village, according to the plat thereof on record in the County of Washington, State of Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by United Properties Investment LLC for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 3 lots, in accordance with the preliminary plat submittal received by the City on February 23, 2007, and revisions received on April 11, April 23 and May 1, 2007, except as amended by this resolution. 2. Approval is contingent upon the City Council approval of the requested PUD amendment. 3. Development standards shall be as approved as part of the PUD. 4. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 5. The developer must obtain all necessary permits from the City. 6. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. 7. The developer must comply with all conditions outlined in the City Engineer's memo dated May 2, 2007: a. The owner of Lot 2 will need to enter into a License Agreement with the City to allow the deck within the drainage and utility easement. Resolution 2007-26 Page 2 b. The developer must submit additional details for the deck footings that will be located within the pond itself for review and approval by the City Engineer. The footing construction must be completed in a manner that will not result in any filling of the pond. c. The developer shall submit final plans that include storm sewer design details for the design of the storm sewer structure adjacent to existing retaining wall. Several portions of the existing storm sewer system will be removed and relocated as part of the project. Final plans must be submitted for review and approval by the City Engineer. d. The plans shall be revised to update the existing grades along the trail located along the southern edge of the proposed development to confirm the planned emergency overflow to the south. City policy requires a minimum of 1.0 feet of separation between the emergency overflow and the low floor elevation. Final plans must be submitted for review and approval by the City Engineer. 8. The developer must obtain preliminary plat approval from Washington County and comply will all conditions of plat approval. ADOPTED by the City Council this 4m day of June 2007.
