RESOLUTION 2007-29 <br />APPROVING FINDINGS OF FACT FOR REZONING FOR FJT PROPERTIES <br />LLC FOR A RETAIL DEVELOPMENT ON 13.14 ACRES LOCATED EAST OF <br />HIGHWAY 61 AND NORTH OF 120M STREET <br />WHEREAS, FJT Properties, LLC has requested reclassification of the zoning from <br />Residential Service to PUD (planned unit development) for a 13.14 -acre parcel to be <br />known at Lot 1, Block 1, Oneka Square. The property is the western portion of the <br />property legally described as follows: <br />All that part of the Southeast Quarter of the Southeast Quarter of Section 31, <br />Township 31, Range 21, Washington County, Minnesota lying east of State Trunk <br />Highway 61 as described in Book 292 of Deeds, Page 513 of record in the office <br />of the Washington County Recorder. <br />Subject to 120th Street right-of-way <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing and recommends approval, and; <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />Residential Service to PUD; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br />by FJT Properties LLC for the reclassification of the zoning from Residential Service to <br />PUD for the 13.14 -acre property (to be known as Lot 1, Block 1, Oneka Square), based <br />on the following findings: <br />1. The proposed rezoning would be consistent with the Comprehensive Plan, which <br />shows this area as 2020 Urban Development. <br />2. The PUD will allow a more creative and efficient approach to land use within the <br />City, while at the same time protecting and promoting the health, safety, comfort, <br />aesthetics, economic viability and general welfare of the City. <br />3. The proposed development meets the intent of the PUD zoning district by <br />providing appropriate transitions between differing land uses within the site and <br />adjacent land uses, provides a community gateway sign, protects natural resources <br />and provides needed street right-of-way. <br />4. The development would incorporate common design elements. The buildings <br />would have common design elements and similar landscape materials would be <br />used throughout the development. <br />
