HomeMy WebLinkAbout2007.08.06 RESO 2007-0040RESOLUTION 2007 - 40 APPROVING A VARIANCE FOR MULTIFEEDER TECHNOLOGY IN THE GENERAL INDUSTRIAL ZONING DISTRICT ON PROPERTY LOCATED AT LOT 3, BLOCK 19, BALD EAGLE INDUSTRIAL PARK 4TH ADDITION WHEREAS, Neal Nordling has requested approval of a variance for two future buildings to be 10 feet from the side yard setback where the ordinance requires the buildings to be set back at a distance that is at least equal to the height of the building, and in no case less than 10 feet. Lot 3, Block 1, Bald Eagle Industrial Park 4th Addition WHEREAS, the Planning Commission has reviewed said variance at a duly called public hearing on July 26, 2007. WHEREAS, Neal Nordling agreed with the City Council recommendation. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance request to Neal Nordling to permit constriction of two future buildings to be 15 feet from the north side yard setback and 10 feet from the south side yard setback where the ordinance requires the buildings to be set back at a distance that is at least equal to the height of the building, and in no case less than 10 feet with the condition that the buildings shall not exceed 30 feet in height based on the following findings: 1. The requested variance is permissible by law. 2. The strict enforcement of the ordinance would cause undue hardship because of circumstances unique to the individual property not caused by the land owner. 3. The granting of the variance would be in keeping with the spirit and intent of the ordinance. 4. The property can not be put to reasonable use without the granting of the variance. 5. The variance would not alter the essential character of the locality in which it would be located. 6. The use is permitted in the zoning district. 7. The subject property is not within a floodplain. 8. Sewage and water systems will be installed in compliance with state code.
