APPROVING A MODIFICATION TO A SPECIAL USE PERMIT FOR THE
OPERATION OF A SHOOTING RANGE AT 6557125 ST NORTH AND
ENCOURAGING CONTINUED RESPONSIBLE OPERATION OF THE
SHOOTING RANGE
WHEREAS, the Governor signed into law on May 25, 2005, the Shooting Range
Protection Act, limiting the City's authority to regulate certain activities at the club, and;
WHEREAS, the law includes provisions requiring the Minnesota DNR to promulgate
regulations for the proper operation of shooting ranges, but the law includes no
specifically stated provisions regarding enforcement of the regulations
WHEREAS, The City has received an application from the Bald Eagle Sportsman's
Association (BESA) to amend the existing Special Use Permit concerning the operation
of the shooting range and;
WHEREAS, the application is for the purpose of reconciling the Special Use Permit with
the recently revised state statute and;
WHEREAS, the Planning Commission reviewed the application at a public hearing on
June 14, 2007 and recommended approval, and
WHEREAS, the City is desirous of bringing the Conditional Use Permit into conformity
with the statute, while encouraging it to make improvements that will reduce the noise
impacts from the shooting range and will allow it to operate in greater harmony with the
neighborhood.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA;
1. That it should and hereby does approve the amended special use permit subject to
the conditions included therein and subject to the provision that the conditional
use permit may be modified to incorporate any restriction permissible under any
later amendment to the statute.
2. That the City will contact the League of Minnesota Cities and will lobby the State
Legislature to establish enforcement procedures for the proper operation of
shooting ranges with enforcement occurring by the DNR.
3. That the City will continue to assist and encourage BESA with its efforts to install
additional sound mitigation measures on the property such as the construction of
enclosures around the shooting ranges.
4. That the City will cooperate with and support BESA to identify sources of grants
and other funding measures resulting in the construction of any sound mitigation
measures.

5. That the City will encourage BESA to continue its practice of lead remediation on
the property. Lead has been reclaimed on the property four times over the club's
history with the most recent remediation occurring in 1997.
6. That the City will evaluate the road conditions on 125' Street, including signage
and the possibility of adding a paved shoulder to the south side of 125' Street
between Heather and Upper Heather Avenues to encourage the reduction of the
speed of traffic using the roadway and to increase safety for pedestrians.
7. That BESA shall comply at all times with the BESA Range Rules received by the
City on August 2, 2007
