APPROVING AN INTERIM USE PERMIT TO ALLOW FOR THE OPERATION
OF A HOME OCCUPATION AS AN ACCESSORY USE, PROPERTY LOCATED
AT 7180177TH STREET NORTH
WHEREAS, Joseph Modrow has requested approval of an interim use permit to allow for
the operation of a home occupation as an accessory use on the property legally described
as follows:
SECTION 4 T31N R21W PT NE1/4-NE1/4 SEC04T31R21 BEING THE E 330FT
OF W 660FT OF SD 1/4 OF SEC 4 HUGO
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Joseph Modrow for a interim use permit to allow for the operation of a home
occupation as an accessory use with the following findings, subject to the conditions
included therein:
1. The applicant owns the property and resides in the principle residential
address associated with the home occupation.
2. The home occupation is allowed as an accessory use in the Future Urban
Service zoning district.
3. The spirit and intent of the ordinance is to allow a way for a property
owner to have a home occupation with an interim use permit with
conditions to limit the operation of the business. The home occupation
shall meet the general performance standards and procedures by which
home occupations can be conducted without jeopardizing the health,
safety and general welfare of the surrounding properties. Staff feels that
the home occupation meets the spirit and intent of the ordinance.
4. The present character of the surrounding area is large lot residential. The
applicant is requesting approval to allow more business related vehicles on
the property that may alter the character of the area, but are adequately
screened from the adjacent properties. The applicant does drive the large
vehicles down the street, however the number of trips are minimal.
5. The interim use permit shall be reviewed in two years.
6. It does not appear that the home occupation would impose additional
unreasonable cost to the public.

7. To operate the business from the property the applicant will sign the
interim use permit and agree to the conditions outlined in the permit. The
interim use permit will be evaluated with the renewal in two years.
