A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF HUGO,
WASHINGTON COUNTY, MINNESOTA, CONCERNING THE PAUL HUGO
FARMS WMA MANAGEMENT PLAN
WHEREAS, The City has entered into a Memorandum of Agreement (MOA) with the
Minnesota Department of Natural Resources (DNR) and the Rice Creek Watershed
District (RCWD) dated November 3, 2006;
WHEREAS, the MOA includes eight items concerning the management and maintenance
of Judicial Ditch No. 2, Rice Lake, and the Paul Hugo Farms Wildlife Management Area
(WMA) and invites all parties to work cooperatively as decisions are made regarding the
management of these areas;
WHEREAS, the MOA requires the DNR to prepare a management plan for land within
the boundaries of the existing WMA, which has now been completed with input from the
RCWD and the City;
WHEREAS, the management plan details a proposal about how property will be
managed within the WMA, and also allows for acquisition of certain land or easements
outside of the WMA from willing sellers of land or easements.
WHEREAS, the management plan proposes a "project boundary" which extends beyond
the limits of the existing WMA or any other DNR owned land;
WHERAS, the "project boundary" includes the area where the DNR proposes to offer
non-binding comment into land use decisions that are made by the City.
WHEREAS, the proposed "project boundary" gives the DNR no additional zoning,
regulatory or review authority or other rights related to land use decisions that are made
solely by the City.
WHEREAS, the City will adopt its comprehensive plan in the spring of 2008 that will
guide land use in the entire City, including land surrounding the WMA and the proposed
project boundary.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does express support
the Draft of the Paul Hugo Farms WMA Management Plan Document dated December 7,
2007, subject to the following conditions:
1. The management plan in no way provides or assumes the DNR any additional
authority to regulate land use, development, zoning or subdivision of land within
any of the areas included in the management plan, other than what has been
granted to DNR by the state legislature through state statute.

2. The City will adopt its comprehensive plan in the spring of 2008, as required by
state statute. The comprehensive plan will guide future land use decisions within
the City including the area surrounding the WMA, and the City will welcome
comment from the DNR during that process.
3. The City's expression of support of the management plan assumes that prompt,
fair and reasonable efforts by the DNR are made to purchase land or easements
from affected property owners, that DNR work cooperatively on all matters
affecting Paul Hugo Farms, Rice Lake and Judicial Ditch #2 maintenance. DNR
and the City shall confer frequently to review the status of all of these matters.
