RESOLUTION 2006-9 <br />APPROVING A CONDITIONAL USE PERMIT TO ALLOW FOR A <br />DRIVEWAY TO BE SHARED BY TWO PARCELS LOCATED IN THE <br />AGRICULTURAL ZONING DISTRICT. <br />WHEREAS, Malcolm and Elizabeth Cammack and Gregory and Elizabeth Closmore <br />have requested approval of a conditional use permit to allow shared driveway access for <br />properties located at 9420140' Street and the adjacent parcel to the north. <br />See Exhibit A <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Cammacks and Closmores for a conditional use permit for a shared driveway <br />subject to the following conditions: <br />1. An easement deed for access to the northern parcel must be recorded with this <br />Conditional Use Permit. <br />2. Driveway shall be used to access one single family home on the northern parcel. <br />3. The northern parcel may not be subdivided unless adequate public road access is <br />provided to the property. <br />4. Driveway must be maintained as a 14 foot wide driveway and kept in a condition <br />which would allow access by emergency vehicles. <br />5. Driveway must be maintained by the property owner to the north. <br />6. Driveway must comply with the conditions of approval from the Brown's Creek <br />Watershed District. <br />7. Driveway must comply with conditions of approval of the Driveway Encroachment <br />Agreement with Xcel Energy. <br />ADOPTED by the City Council this 6th day of March, 2006. <br />ATTEST: <br />Mary reager, City Clerk 61 <br />
