APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE
HOMES FOR WATERS EDGE SOUTH THIRD ADDITION
WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge South
Third Addition" on property legally described as follows:
Lot 37, Block 3, Waters Edge South, Washington County, Minnesota according to
the recorded plat thereof, and Outlot A and Oudot B, Waters Edge South Second
Addition, Washington County, Minnesota according to the recorded plat thereof
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Pulte Homes for Waters Edge South Third Addition; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City, and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of 115 townhome units, in
accordance with the plans received by the City on February 9, 2006 except as
amended by this resolution.
2. Inset D of the final plat graphics shall be revised to Inset C.
3. The development agreement must be executed by the developer and the City prior
to release of the final plat.
4. Development standards shall be according to the PUD general plan and
preliminary plat approvals granted by the City Council on May 17, 2004 and as
may be amended. (Resolution 2004-33, Resolution 200434 and Ordinance 2004-
391).
5. The town homes shall be subject to the architectural controls that were created for
the development and previously approved by the City. Materials and colors of the
town homes shall be consistent with the architectural plans and design palette
required as part of the PUD approval.
6. Proof that the townhomes will be covered under the HOA established for the
previous phases of this development. A copy of the revised HOA documents
shall be submitted for review and approval by the City Attorney.
7. Cross access and maintenance agreements as well as drainage and utility
easements shall be recorded with the final plat for all private drives.

8. Park dedication shall be cash in lieu of land dedication for the 115 units in this
phase. Park dedication shall be due based on the park dedication ordinance at the
time the final plat is released for filing at Washington County.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. No changes shall be made to the HOA documents unless approved by the City of
Hugo in writing. Any amendments to the HOA documents must be filed at
Washington County.
2. The lighting fixtures type shall be the same style as was provided with the first
phase of this development.
3. The minimum floor elevations shall comply with Section 1175-060.1 of the Hugo
Zoning Ordinance.
4. The development shall comply With the Fire Chief s requirement regarding fire
flow calculations, the location of fire hydrants, fire department connections and
fire lane signage.
5. The overall landscape plan shall be shaded, except for the project area, to best
reflect the development location such as was done on the sanitary sewer,
watermain, storm sewer and street improvement plans.
6. The overall grading, drainage and erosion control plan shall be shaded, except for
the project area, to best reflect the development location such as was done on the
sanitary sewer, watermain, storm sewer and street improvement plans.
7. A site plan shall be submitted for review and verification of setback requirements
and approval by City staff.
