APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE
HOMES FOR WATERS EDGE FOURTH ADDITION
WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge Fourth
Addition" on property legally described as follows:
Outlot A, Waters Edge Fourth Addition, Washington County, Minnesota
according to the recorded plat thereof
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
-NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Pulte Homes for Waters Edge Fourth Addition; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of 120 Village townhome units,
in accordance with the plans received by the City on February 9, 2006 and
revisions received on March 3, 2006, except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior
to release of the final plat.
3. Development standards shall be according to the preliminary approvals granted by
the City Council on December 16, 2002 (Resolution 2002-65, 2002-66 and 2002-67)
and as amended on December 15, 2003 (Resolution 2003-65).
4. The townhomes shall be subject to the architectural controls that were created for
the development and previously approved by the City. Materials and colors of the
townhomes shall be consistent with the architectural plans and design palette
required as part of the PUD approval.
5. HOA documents or written confirmation that the townhomes will be covered
under the HOA established for the previous phases of this development must be
submitted to the City Attorney for review and approval.
6. Cross access and maintenance agreements as well as drainage and utility
easements shall be recorded with the final plat for all private drives.
7. Park dedication requirements were fulfilled with the first phase of this
development when the park land was dedicated to the City. No additional
dedication is due with this phase.

FURTHER, that the following conditions be met prior to issuance of building permits:
1. The final plat, development agreement and associated documents must be
recorded at the County.
2. No changes shall be made to the HOA documents unless approved by the City of
Hugo in writing. Any amendments to the HOA documents must be filed at
Washington County.
3. The lighting fixtures type shall be the same style as was provided with the first
phase of this development.
4. The minimum floor elevations shall comply with Section 1175-060.1 of the Hugo
Zoning Ordinance.
5. The development shall comply with the Fite Chief's requirement regarding fire
flow calculations, the location of fire hydrants, fire department connections and
fire land signage.
6. The developer shall submit building elevations and, a design palette including
colors for siding, shake, shutters, shingles, brick, and stone for each of the
townhome buildings. No adjacent townhome buildings shall have the same front
elevation colors or architectural styles.
7. The applicant shall comply with the conditions in the City Engineer's memo
dated March 15, 2006.
