HomeMy WebLinkAbout2006.03.20 RESO 2006-0015P Af RESOLUTION 2006-15 APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR "VICTOR GARDENS 6m ADDITION" WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow construction of 60 single-family units on property legally described as follows: i. Outlot E, Victor Gardens East. WHEREAS, the Planning Commission has reviewed the PUD amendment for the community activity center at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it shQuld and hereby does approve the request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the following conditions: 1. A PUD amendment is approved to allow the creation of 60 single-family lots and 6 outlots in accordance with the plans received on January 12, 2006 and on February 13 2006, except as amended by this resolution. 2. The approval is contingent upon City Council approval of the Preliminary Plat. 3. The PUD amendment is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan and the approved Victor Gardens PUD. 4. Private driveways in front of the homes shall be a minimum of 22 feet long to accommodate parking. 5. All cul-de-sac streets shall be at least 26 feet wide, face to face, with parking permitted on one side, as shown on the plans. 6. Sidewalks are required along both sides of all public streets, except the cul-de-sacs. 7. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. 8. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. 9. The homeowner's association documents shall include language to ensure that the enclosed garage spaces are maintained for vehicle parking and that parking of snowmobiles, boats, RVs and other recreational vehicles in the driveway is discouraged. The covenants shall be drafted to prohibit the storage.of anything in the Resolution 2006-15 Page 2 garage or driveway that would prevent the storage and parking of vehicles. Such language shall also be included in the Developers Agreement. 10. The developer's architectural control committee (ARC) shall review and approve all building designs for compliance with this resolution, prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application for each building. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. 11. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 1195.400 of the City Code. r2. Prior to final plat approval, the applicant shall provide copies of the HOA documents/covenants for City review. A copy of the covenants shall be filed with the final plat. It ft Resolution 2006-15 Page 3 14. At the time of final plat submittal, the developer must submit final development plans with the PUD final plan application. 15. The developer must obtain all necessary permits from Rice Creek Watershed District and all other jurisdictional agencies. 16. The mailboxes must be architecturally compatible with the homes in the development, as shown in the photos submitted January 12, 2006. The applicant must submit final plans for review and approval by the City. 17. The plans must be revised to include painted crosswalks at the sidewalk street crossings. 18. Building elevations' -and materials for the Highland Villas must be submitted for review and approved by City staff.
