APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC FOR
"VICTOR GARDENS 6m ADDITION"
WHEREAS, POA -Scherer, LLC. has requested approval of a Preliminary Plat to allow
construction of 60 single-family units on property legally described as follows:
Outlot E, Victor Gardens East.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by POA -Scherer, LLC. for a preliminary plat, subject to the following conditions:
1. A preliminary plat is approved to allow the creation of 60 single-family units and 6
outlots on 44.23 acres, in accordance with the plans and application received by the
City on January 12, 2006 and February 13, 2006, except as amended by this
resolution.
2. Approval is contingent upon City Council approval of the PUD Amendment.
3. Development standards shall be as approved as part of the PUD.
4. The applicant shall comply with all conditions of PUD concept plan approval
(Resolution #2000-47) and the original development agreement dated June 6, 2002.
5. Prior to issuance of building permits, the applicant shall submit a Final Plat for
review and approval by the City.
6. Prior to issuance of building permits, the applicant shall file the Final Plat at
Washington County.
7. The vacation of the existing drainage and utility easement over Outlot E must be
approved before filing the final plat.
8. The plans must be revised to provide a drainage and utility easement over the
wetlands and stormwater ponds in Oudots C through F.
9. Outlots C through F must be owned and maintained by the Homeowners Association.
10. The plans must be revised to include a trail detail. The trail must be constructed from
bituminous material.

11. Trails may not be located within the floodway.
12. The section of trail along the east side of Everton Avenue between Flora Way and
Outlot F is not entirely within the right-of-way, therefore, an easement must be
provided in this area.
13. The applicant must comply with all conditions outlined in the City Engineer's memo,
dated February 28, 2006.
14. Park dedication requirements for this site have been met with previous additions. No
additional park dedication is required for this phase.
