APPROVING A PUD GENERAL PLAN FOR POA-SCHERER, LLC. FOR "VICTOR
GARDENS NORTH 3`d ADDITION" ON PROPERTY LOCATED NORTH OF
FRENCHMAN ROAD (CR8) AND EAST OF ELMCREST AVENUE NORTH
WHEREAS, POA -Scherer, LLC has requested approval of a PUD General Plan to allow
construction of approximately 16,000 square feet of commercial on the 7.84 -acre property
legally described as follows:
Outlot A, Victor Gardens North Village, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer,
LLC for a PUD general plan, subject to the following conditions:
1. A PUD general plan/site plan is approved to allow the creation 1 commercial lot for a
gas/convenience store and 1 outlot in accordance with the plans and application received by
the City on January 26, 2006, and revised on April 4, 2006, except as amended by this
resolution.
2. Approval is contingent upon City Council approval of the requested preliminary plat.
3. The development shall be consistent with the Victor Gardens PUD concept plan approvals
(Resolution # 2000-47), except as otherwise noted herein.
4. Development standards for the PUD shall be as indicated on the plans and graphics dated
April 4, 2006, except as amended by this resolution.
5. All platted commercial lots shall comply with the following setbacks:
Front yard (from public street)
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
(exterior property lines
30 feet
6. The gas station and car wash shall comply with the setbacks as shown -on the plans.
7. PUD flexibility is granted to allow 24-hour operation of the gas station and car wash.
8. All commercial buildings must be sprinklered.

9. PUD flexibility is permitted for a 5 -foot encroachment upon the 15 -foot front yard setback
requirement by the car wash building along the east property line, based on the finding that
the building provides 4 -sided architecture and the building wall facing the street has high
quality architecture that for the frontage elevation.
10. At the time of final plat approval for each phase of the development, the applicant shall
submit final development plans for the review and approval of the City staff.
11. Prior to final plat approval, the applicant must comply with the following conditions:
Architecture
a. Mechanical equipment for commercial uses must be screened as shown on the plans.
b. Commercial building materials and architectural details for the gas station and car wash
shall be as shown on the plans received on April 04, 2006.
c. All block within the development shall be integral colored. No painted CMU will be
permitted.
d. All building elevations shall receive nearly equal treatment and visual qualities.
e. All building materials shall be of high quality and constructed of durable materials.
f. The building elevations should be revised to show all four sides of the store, car wash and
gas station canopy. The building elevations should also note which elevation (i.e. north,
south, east or west) is shown.
Trash and Recycling
g. Trash and recycling areas for this and future phases must be designed internal to the
building or as an integral part of the building. The development standards must include
this requirement.
h. Trash receptacles must be provided at a convenient location on site to facilitate liter
control.
Signage
i. A master sign plan must be submitted for review and approval -by the City. The plan
must address the following:
1) PUD flexibility is permitted for one 112 square foot multi -tenant identification
freestanding monument signs where 40 -foot is the maximum sign area allowed.

2) The electronic message board portion of the multi -tenant sign shall maintain
constant illumination and only display motor fuel prices.
3) The multi -tenant identification freestanding monument sign shall be constructed as
shown on the sign dated January 26, 2006. The building materials shall be identical
to the adjacent multi -tenant identification sign in Victor Gardens North Village.
4) One development identification sign (with no tenant signage) shall be allowed on
the east side of the site as shown on the plans.
5) The architectural design of the sign, the total square footage of the sign, and the
proposed building materials shall be identical to the adjacent development
identification sign in Victor Gardens North Village.
6) The development identification signs must be set back 8 feet from the property line,
except that a zero -setback will be allowed adjacent to CSAH 8. Sight -visibility
must be maintained at intersections.
7) The applicant must identify, in square feet, the total amount of area the wall signs
will consume and how the wall signage meets City requirements.
8) The applicant must submit revised sign criteria to regulate tenant signage according
to the City's requirements and consistent with the sign criteria approved for Victor
Gardens North Village.
9) The multi -tenant identification freestanding monument sign shall be relocated off
the property line and outside of the required drainage and utility easement.
i. This shared sign shall be located in a private sign easement as shown.
ii. The applicant shall work with City staff to determine the final sign
location.
Parks and Trails
j. The applicant has satisfied all park dedication requirements with previous phases of this
development. No additional dedication is required.
k. The applicant shall dedicate a 20 -foot public trail easement over all trails located outside
of the public right-of-way.
1. The trail on the north side of the private drive and west of the wetland complex shall be
constructed with this phase
in. All trails shall be 10 -feet wide and paved with a bituminous surface. The trails shall be
constructed by and paid for by the applicant with this plat.

n. The applicant must submit trail construction details for the trails for review and approval
by the City.
o. The applicant should dedicate a 20 -foot trail easement between the Kwik Trip site and the
future restaurant pad for a future trail connection from the private drive to the trail
planned along CSAH 8. The applicant should be required to construct the trail when the
fast food restaurant site is developed. The applicant shall work with City staff to identify
the final trail location prior to final plat approval.
p. The applicant shall dedicate the required trail easement along the east side of Elmcrest
Avenue when the adjacent property is platted.
Streets, Access and Parking
q. The applicant shall construct the entire private drive (Street A) during this phase.
r. The proposed median on Street A should be extended to the west to the easterly edge of
the east driveway opening for the Kwik Trip site.
s. Driving lanes widths on Street should be increased to provide at least a 12 -foot -wide
bituminous drive lane. The street design should allow for turning movements of trucks.
t. A minimum of 60 feet of spacing is required between driveway accesses on Street A.
u. No parking is permitted on Street A.
v. Cross access and maintenance agreements shall be recorded with the final plat for the
shared private drives.
w. The future restaurant entry shall be required to align with one of the Kwik trip driveway
accesses.
x. Two painted stalls shall be provided adjacent to the vacuum area of the car wash. A 20 -
foot drive lane must be maintained at all times for emergency vehicle access.
Landscaping and Open Space
y. The City grants the applicant a waiver from the Victor Gardens Concept Plan approvals
(Resolution 2000-47) requiring 25 percent shade in the parking lot within 15 years. The
retail development in this phase is approved in accordance with the landscape plan,
subject to the following:
1) The applicant must revise the landscaping plans to provide the calculation. for
what percentage of the parking lot will be shaded within 15 years.
2) All future phases shall be subject to the conditions as approved in Resolution
2000-47 regarding parking lot shading.

z. Open space as shown on the plans shall be owned and maintained by the HOA.
aa. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for
review and approval by the City.
bb. The developer and/or the owner's association shall be responsible for maintenance of the
landscaping and irrigation systems within the development.
cc. Landscape details for the foundation plantings around the monument signs must be
submitted.
dd. The landscape plan shall be revised to note that the selected street tree on the private
drive is Autumn Blaze Maple. The landscape plan should identify spacing requirements
for these trees. The street trees shall be planted as shown on the master landscape plan
with the street trees in front of the possible restaurant sites planted when those parcels
develop.
Miscellaneous
ee. The applicant shall submit additional data to the City regarding anticipated water use to
verify that the municipal system has adequate capacity to accommodate the proposed car
wash.
ff. The applicant shall dedicate a drainage and utility easement over the existing wetland and
ponds that are located in Outlot A, over the private drive and adjacent to all lot lines.
gg. The applicant shall dedicate a 10 -foot drainage and utility easement along the right-of-
way of Frenchman Road North, Victor Hugo Boulevard and Rosemary Way.
hh. The preliminary plat should be modified to show a drainage and utility easement over the
sanitary sewer, water main, storm sewer lines, and emergency overflow routes for
drainage that will be located in private Street A and will serve the three potential lots.
ii. Emergency vehicle accesses must comply with City requirements. Details on these
accesses shall be provided for City review and approval.
jj. Underground fuel storage tanks for the gas station are to be positioned to allow adequate
access by motor fuel transports and unloading operations which do not conflict with
circulation, access and other activities on the site. Final design shall be subject to city
review and approval.
kk. The applicant shall comply with all conditions from the City Engineer's memo dated
April 5, 2006.
12. Prior to recording the final plat, the applicant must comply with the following conditions:

a. The existing drainage and utility easement over the outlot shall be vacated.
13. Prior to issuance of building permits, the applicant must comply with the following
conditions:
a. The applicant shall provide copies of the development covenants for City review. A copy
of the covenants shall be filed with the final plat.
b. The association documents shall include language to ensure that the tenant are
responsible for litter control from the premises and litter control is to occur on a daily
basis.
c. The association documents shall be drafted to prohibit the outside sale or storage of
merchandise, vehicles, equipment, or other items.
d. The developer shall submit association or covenant documents for review and approval
by the City attorney.
e. The developer's architectural control committee (ARC) shall review and approve all
building designs for compliance with this resolution, prior to building permit submittal.
A written copy of the ARC approval shall be submitted with the building permit
application for each building. The City shall review the building architecture for
compliance with the approved plans prior to issuance of building permits.
f. The applicant shall obtain all necessary local, state, and federal permits.
14. Site plan approval is required for the commercial development planned for Outlot A, Victor
Gardens North Village 3"d Addition. No development approvals are granted or implied.
15. Commercial development on Outlot A shall comply with all conditions of the Victor Gardens
PUD approvals.
