RESOLUTION 2006 - 20 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC. FOR "VICTOR <br />GARDENS NORTH 3rd ADDITION" ON PROPERTY LOCATED NORTH OF <br />FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE <br />NORTH <br />WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow <br />construction of one commercial lot and one outlot on the 7.84 -acre property legally described as <br />follows: <br />Outlot A, Victor Gardens North Village, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA- <br />SCHERER, LLC for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of one commercial lot and one outlot in <br />accordance with the plans received by the City on January 26, 2006 and revisions received on <br />April 04, 2006, except as amended by this resolution. <br />2. Approval is contingent upon the City Council approval of the requested PUD general plan. <br />3. Development standards shall be as approved as part of the PUD. <br />4. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />5. The developer must obtain all necessary permits from the City. <br />6. The development shall comply with the Fire Chiefs requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane signage. <br />7.
